Resolution Number 01-2-6-3263 RESOLUTION NO. 01-2-6-3 APPROVING DEL OBISPO STREET DRIVEWAY IMPROVEMENT PROJECT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CERTIFYING A NEGATIVE DECLARATION AND APPROVING A PROPOSAL TO PROVIDE "FLARED DRIVEWAYS" TO FACILITATE RIGHT TURNS INTO/OUT FROM THE RIGHT LANE ON DEL OBISPO STREET, FROM ORTEGA HIGHWAY TO FORSTER LANE AND MINOR ADJUSTMENTS IN THE ALIGNMENT OF WATERLINES WITHIN DEL OBISPO STREET (DEL OBISPO STREET DRIVE APPROACH/CIP NO. 101) WHEREAS, the City of San Juan Capistrano, 32400 Paseo Adelanto, proposes to provide "flared driveways" to facilitate right turns into/out from the right lane on Del Obispo Street, between Ortega Highway and Forster Lane. The project is located within the General Commercial Zone District and is designated General Commercial on the General Plan Land Use Map; and, WHEREAS, this proposal has been reviewed in accordance with the California Environmental Quality Act (CEQA, 1970). On August 15, 2000, the — Environmental Administrator issued a mitigated negative declaration. All mitigation measures have been included as conditions of approval in this resolution; and, WHEREAS, at its meeting of November 14, 2000, the Planning Commission conducted a public meeting to consider public testimony on the proposed project, and forwarded a recommendation of conditional approval on to the City Council; and, WHEREAS, at its meeting of February 6, 2001, the City Council conducted a public meeting to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find: 1. The Circulation Element of the General Plan includes a policyto apply creative traffic management approaches to address congestion in areas with unique problems. The proposed driveways will incorporate a flared design which is wider and has a smoother transition than the traditional driveway aprons which are currently used along Del Obispo Street. This design will eliminate the need for motorists to'swing-out' into the left lane to make a right turn. These changes will provide improved traffic flow, lessening the impacts of congestion on Del Obispo Street, consi-:-nt v:ith the goals and policies of the General Plan Circulation Element. -1- 264 BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby certify of a negative declaration and approve project subject to the following mitigation measures: Mitigation Measures Mitigation Measure #1: Prior to issuance of a grading permit, the applicant shall retain the services of a SOPA (Society of Professional Archeologists) - certified archeologist who shall monitor all grading and excavation activities which exceed a depth of 18 inches below finish grade for potential impacts on cultural resources including archeological, paleontological, and historic resources. The applicant shall provide an executed contract for services with a SOPA-certified archeologist including a scope -of -work evhich provides for comprehensive monitoring; a contingency for assessment, recovery, and/or evaluation; and the preparation of a technical memoranda or report. In the event cultural resources are encountered during grading, the monitor may cease grading operations, consistent with City Council policy, to allow for the assessment, recovery and/or evaluation of any cultural resources. Mitigation Measures #2: In order to minimize construction related impacts to businesses, construction activity shall: 1.) occur during off-season peak times in the fall or spring; 2.) be performed at night, in accordance with City Council Policy 505; and, 3.) be phased so that only one half of a driveway and sidewalk is replaced at a time.
