Resolution Number 02-03-19-01RESOLUTION NO. 02- 03-19 - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO RECOMMENDING THE ESTABLISHMENT OF NUMERICAL LIMITS FOR CALENDAR YEARS 2003 THROUGH 2005 (RESIDENTIAL GROWTH MANAGEMENT PROGRAM) WHEREAS, Chapter 7 of Title 9, Land Use Code, codified by Ordinance No. 398 on February 20, 1980, establishes the City's Growth Management Regulations and regulates the allocation of residential building permits; and, WHEREAS, Section 9-7.08 of the ordinance requires that the City annually establish Numerical Limits for residential building permits to be issued for each of the succeeding three calendar years; and, WHEREAS, the potential environmental impacts of the Residential Growth Management Program were fully disclosed in environmental documents prepared in conjunction with adoption of Ordinance No. 398 in accordance with the California Environmental Quality Act (1970); and, WHEREAS, the Planning Commission has previously considered the — environmental determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, WHEREAS, the Planning Commission conducted a duly noticed public hearing on January 22, 2002 pursuant to Section 9-3.200 of the Municipal Code to consider testimony and has forwarded a recommendation of approval for the Numerical Limits as set forth in this resolution: and, WHEREAS, the City Council has conducted a duly noticed public hearing on February 19, 2002 to consider testimony on the establishment of numerical limits for the next three calendar years and continued consideration of the item to March 19, 2002 to provide staff an opportunity to prepare a response to several issues related to the establishment of the numerical limits and the relationship with the California Government Code and provisions of the City's adopted Housing Element to the General Plan; and, WHEREAS, the City Council at their meeting of March 19, 2002 received a report on the issues raised at the previous meeting, considered the report and additional testimony. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: The draft 2003-2005 Numerical Limits are consistent with the policies and objectives of the San Juan Capistrano General Plan, in that it provides for the number of building permits that will be necessary to comply with the _ Housing Element; and, 2. The draft 2003-2005 Numerical Limits provide building permit allocations consistent with the provisions of Title 9, Chapter 7, Residential Growth Management of the Municipal Code. 3. The Numerical Limits have been adjusted to account for the possible construction of an affordable rental project that would be built in partnership with the City/Redevelopment Agency. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council establishes the Numerical Limits forthe Calendar Years 2003 through 2005 in accordance with the requirements of Title 9, Chapter 7 of the Municipal Code as follows: �alend arY 2003 140 2004 135 2005 130 PASSED, APPROVED AND ADOPTED this 19`h day of March, 2002.
