A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, CERTIFYING ISSUANCE OF A NEGATIVE
DECLARATION AND APPROVAL OF GENERAL PLAN AMENDMENT 01-
03 RELATED TO MINOR MAP CHANGES TO THE LAND USE POLICY
MAPAND DESIGNATION OF POTENTIAL FUTURE SCHOOL SITES (GPA
01-03)
Whereas, staff has identified several designations on the Land Use Policy
Map for specific parcels of land that are not consistent with existing development patterns
that should be adjusted; and,
Whereas, the Capistrano Unified School District has identified the need for
new school sites within the City that should be considered for inclusion on the Land Use
Policy Map as provided in the Public Services and Utility Element of the General Plan; and,
Whereas, the Municipal Code proscribes the process for consideration of
amendments to the City's adopted General Plan; and,
Whereas, in accordance with the Municipal Code, the City Council is the only
body that may consider and initiate consideration of an amendment to the General Plan;
and,
Whereas, the City Council at its meeting of August 7, 2001 did hereby initiate
General Plan Amendment 01-03, to consider minor map modifications and designation of
potential future schools sites to the Land Use Policy Map; and,
Whereas, the Environmental Administrator considered an initial study
prepared to evaluate the environmental impacts of the proposed amendment and
determined that said amendment will not have a significant impact upon the environment
did issue a Negative Declaration on September 11, 2001 and has caused to be carried out
all other applicable provisions of the California Environmental Quality Act (CEQA); and ,
Whereas, the Planning Commission conducted a duly noticed public hearing
consistent with the provisions of the Municipal Code and adopted City Council Policy on
October 9, 2001, to receive and consider public testimony both in favor and in opposition
to the proposed amendments to the Land Use Policy Map; and,
Whereas, the Planning Commission at the conclusion of their public hearing
forwarded a recommendation to the City Council to certify the issuance of a Negative
Declaration and approval of General Plan Amendment 01-03; and,

Whereas, the City Council on November 20, 2001, did conduct a duly noticed
public hearing consistent with the provisions of the Municipal Code and adopted City
Council to receive testimony either in favor of or in opposition to the proposed changes to
the Land Use Policy Map and designation of potential school sites.
Now, Therefore, Be, It Resolved, the City Council for the City of San Juan
Capistrano, California does hereby certify the issuance of a Negative Declaration and
approves General Plan Amendment 01-03, based upon the following findings:
Each of the proposed amendments will not significantly change the vision of the
land use element goals and policies. This is based upon the finding that the
changes reflect existing development patterns of the individual parcels and
previously granted entitlements.
The Capistrano Unified School District has notified the City that they have identified
the need for two future school facilities within the community. The District has
identified the need to locate a new high school in an area at the City's eastern limits.
The Land Use Policy Map provides for the inclusion of a non-specific land use
designation for future school sites. The inclusion of such designations on the Land
Use Policy Map will be consistent with the policy language incorporated into the
Public Services and Utility Element of the General Plan which encourages a joint
cooperative effort in locating new schools in the community, especially a high
school.
The proposed amendments to the Land Use Policy Map are consistent with all other
provisions of the adopted General Plan for the City.
Now, Therefore Be It Further Resolved, that City Council does hereby
approve the specific changes to the Land Use Policy Map as shown on Exhibit "A". Exhibit
"A" incorporates the following amendments:
