A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING GENERAL PLAN
AMENDMENT 03-01, AMENDING THE CONSERVATION & OPEN
SPACE ELEMENT TO MODIFY AND EXPAND THE POLICIES
RELATED TO WATER QUALITY, AND MINOR CHANGE TO THE LAND
USE POLICY MAP OF THE LAND USE ELEMENT (GPA 03-01)
WHEREAS, the City Council at its meeting of February 4, 2003, initiated an
amendment to the Conservation & Open Space Element to the General Plan in support
of enhancing the water quality of the City's watershed areas; and,
WHEREAS, the initiation of this amendment is related to the establishment of
policies and implementation programs to improve the quality of water as set forth in the
adopted Drainage Area Master Plan (DAMP) and the Local Implementation Plan (LIP)
as required by the stormwater permit issued by the San Diego Regional Water Quality
Control Board; and,
WHEREAS, the Planning Services Department has become aware of a land use
designation on a parcel of land on the area known as "McCracken Hill" that was not
reflective of the considerations in adopting the General Plan in December of 1999; and,
WHEREAS, the Municipal Code prescribes the process for consideration of
amendments to the City's adopted General Plan; and,
WHEREAS, the Environmental Administrator considered an initial study prepared
to evaluate the environmental impacts of the proposed amendment and determined that
said amendment will not have a significant impact upon the environment, did issue a
Negative Declaration on March 25, 2003, and has caused to be carried out all other
applicable provisions of the California Environmental Quality Act (CEQA); and,
WHEREAS, the Planning Commission conducted a duly noticed public hearing
on May 13, 2003, consistent with the provisions of the Municipal Code, and adopted
City Council Policy to receive and consider public testimony both in favor and in
opposition to the proposed amendments to the Land Use Policy Map and forwarded a
recommendation of approval to the City Council; and,
WHEREAS, the City Council has conducted a duly noticed public hearing on July
15, 2003, consistent with the provisions of the Municipal Code and adopted City Council
Policy to receive and consider public testimony both in favor and in opposition to the
proposed amendments to the Land Use Policy Map.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano, California does hereby certify the issuance of a Negative Declaration
based upon the following findings:

The amendment to the Conservation & Open Space Element sets forth a more
focused goal and supporting policies that are designed to enhance the water
quality of the City's watershed.
The implementation programs that are identified as part of this amendment to the
Conservation & Open Space Element to the General Plan are part of the City's
current on-going program to enhance the quality of water within the City's
watershed.
The contents of the proposed amendment will not result in a significant adverse
impact upon the environment as set forth in the Initial Study prepared for this
amendment.
4. The minor change to the Land Use Policy Map was part of the baseline land use
that was considered ' as part of the Final Program Environmental Impact Report
prepared on the General Plan.
5. An environmental assessment was conducted by the County of Orange with the
local agencies of the San Juan Creek Watershed on the impacts of the Drainage
Area Master Plan and the Local Implementation Plan, which are the specific
actions that have been adopted to satisfy the minimum permit requirements of
the San Diego Regional Water Quality Control Board. The County of Orange,
acting as "lead agency," prepared and certified a Negative Declaration which fully
addressed the potential impacts from enacted specific regulations that in fact flow
from and support the policies set forth in this amendment.
NOW, THEREFORE BE IT FURTHER RESOLVED, that the City Council does
hereby approve an amendment to the Conservation & Open Space Element of the
General Plan as fully set forth in Exhibits "A" and "B", attached.
PASSED, APPROVED, AND ADOPTED, this 15th day of July 2003.

EXHIBIT "A"
Conservation & Ooen Soace Element Amendment
The Conservation & Open Space Element (starting at page 10) is hereby amended to
include the following provisions:
Water Quality
San Juan Capistrano contains three creeks which are subject to various sources of
pollution within the community. The source of such pollution can come from a number of
areas. Pollution that originates from a specific, discrete location, referred to a s "point'
source, includes: effluent from municipal wastewater treatment plants; regulated industrial
wastewater discharges; hazardous wastes and materials from spills, mishandling, and
industrial accidents; effluent from inadequate functioning septic systems and illegal
dumping activities.
There are also pollutants contained in stormwater runoff, referred to as "non -point" source
pollution, due to the diffuse origins of such pollutants. These include metals, organic
wastes, pesticides, and a variety of other pollutants. Othertypes of pollutants include those
that result from disinfection of drinking water and the intrusion of salt water from the ocean
into nearby groundwater aquifers. It is these "non -point" source pollutants that are to be
addressed by the Conservation & Open Space Element in order to protect the receiving
waters
Conservation & Open Space Goal 7: Protect and enhance the quality of water in local
creeks and wetlands from "non -point" source pollutants in order to maintain and
enhance the quality of life valued by residents and visitors to the City.
Policy 7-1: Coordinate with other agencies in the watershed area to develop a public
education program that will inform the public on the importance of water quality and actions
that they can take in improving this resource.
Policy 7-2: Coordinate with existing public outreach programs and create additional
programs to involve the community in addressing urban runoff pollution problems and
raising awareness of how individuals' activities contribute to runoff pollution.
Policy 7-3: Encourage measures to promote proper disposal of pollutants to the sanitary
sewer or disposal at hazardous waste collection facilities rather than to the storm drainage
system.
Policy 7-4: Encourage contractors to complywith accepted stormwater pollution prevention
planning practices for all projects subject to erosion potential.

Policy 7-5: Establish requirements for installation and maintenance of stormwater
structural controls to reduce peak discharges and to maximize pollutant removal from
runoff.
Policy 7-6: Establish and coordinate good housekeeping procedures for all City
Departments to ensure that water quality objectives are not threatened by in-house
operations and creating an example for the community.
Conservation & Open Space Implementation Plan
The implementation plan is to be amended to include the following implementation
measures. These programs identify a series of actions, procedures and techniques which
includes a description of the responsible agency/department, funding source, time frame
and related policies in the Conservation & Open Space Element.

activities and coordination with the existing
regional program.

1. Establish requirements for the installation and

in covenants, conditions, and restrictions
(CC&R's) for private development for private
development, and similar obligations for City
projects.

are met by all public facilities. These procedures
are to include the following:
1. Incorporation of water quality objectives into
existing regular safety inspections and other
inspection programs where found necessary.
2. Establish "Best Management Practices" to be
followed by City departments and include
training sessions on a regular basis to ensure
that employees are familiar with those
procedures.
3. Educate City employees on sources and
impacts of pollutants in urban runoff and actions
that can be taken to reduce these sources.
4. Ensure that all contractors used by the City
are aware and implement urban runoff control
programs.
