A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING A ONE-YEAR TIME EXTENSION
FOR APPROVED TENTATIVE PARCEL MAP 99-174. (GATEWAY
COMMUNITY CHURCH)
WHEREAS, the applicant, Gregory Morse on behalf of Gateway Community Church,
27129 Calle Arroyo, Suite 1803, San Juan Capistrano, CA 92675, has submitted a request for
a one year time extension for Tentative Parcel Map 99-174, a two lot subdivision of an 11.46
acre parcel. Lot one measures 7.38 acres and would encompass the knoll on the northern
portion of the site and the approved (but un -constructed) Gateway Community Church. Lot
two measures 4.08 acres and would encompass a building pad approved for future
commercial office use. The site is approximately 11.6 acres located southwest of the
intersection of Rancho Viejo Road and Via Escolar; and,
WHEREAS, this proposal has been reviewed in accordance with the California
Environmental Quality Act, (CEQA, 1970). The City's Environmental Administrator (EA) has
reviewed this project and determined that it qualifies for issuance of a Categorical Exemption
(Class 15, Minor Divisions of Land); and
WHEREAS, on February 4, 2003, the City Council held a duly noticed public hearing to
consider testimony both in opposition to, and in favor of a one year extension for Tentative
Parcel Map 99-174.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan
Capistrano does hereby find that:
1. The approved tentative parcel map if granted an extension would not place the
residents of the subdivision or the immediate community, or both, in a condition
dangerous to their health or safety, or both; and,
2. The proposed map has been previously approved and designed to accommodate the
improvements of the site plan for Comprehensive Development Plan 90-02, including
building pads and a single access drive to serve these pads, and the granting of a one
year time extension would not modify any portion of City Council approved Tentative
Parcel Map 99-174.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council hereby
approves a one year time extension for Tentative Parcel Map 99-174, and all conditions of
approval and mitigation measures that have previously been applied to this site, including
those for Architectural Control application 96-06 approving the proposed Gateway Community
Church, and those for Tentative Parcel Map 99-174 shall remain in full force and effect; and
shall include the following added condition of approval:
Conditions of Approval:
Erosion & Sediment Control Plans Using Best Management Practices. Prior to
issuance of any grading and right-of-way improvement permits within the boundaries of
Parcel Map 99-174, the applicant/subdivider shall submit to the City Engineer and
Building Official for their review, and shall obtain approval of, Erosion/Sediment Control
Plans and programs, prepared by a Registered Civil Engineer, for the regulation and
control of pollutant run-off by using Best Management Practices (BMP's). These plans
shall show all temporary and permanent erosion control devices, effective planting of
graded slopes, practical accessibility for maintenance purposes and proper precautions
and fences to prevent public trespass onto certain areas where impounded water may
create a hazardous condition. In order to control pollutant run-off, the
applicant/subdivider shall demonstrate to the satisfaction of the City Engineer that all
water quality best management practices incorporated into the development of this land
subdivision shall be designed in accordance with the National Pollutant Discharge
Elimination System (NPDES) standards, and the requirements of Sections F.1.b(2)(b)
and F.1.b(2)(c) of California Regional Water Quality Control Board (San Diego Region)
Order No. R9-2002-0001 and City guidelines, regulations and City's Water Quality Local
Implementation Plan, as adopted and last revised, and shall show evidence satisfactory
to the City Engineer that a permit has been obtained. (Engr.)
2. Prior to final map, the applicant shall complete the replacement slope planting adjacent
to Rancho Viejo Road in accordance with previously approved plans for Architectural
Control Applications 96-06.
