Resolution Number 02-08-20-01RESOLUTION NO. 02-08-20-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE CALIFORNIA HERITAGE FUND GRANTS PROGRAM UNDER THE SAFE NEIGHBORHOOD PARKS, CLEAN WATER, CLEAN AIR, AND COASTAL PROTECTION BOND ACT OF 2000 (PROPOSITION 12)(CONGDON FARMHOUSE AND LEARNING CENTER) WHEREAS, the Legislature and Governor of the State of California have approved grant funds for the California Heritage Fund; and WHEREAS, the Office of Historic Preservation has been delegated the responsibility for the administration of the Program within the state and grant Project shown above, setting up necessary procedures; and WHEREAS, said procedures established by the Office of Historic Preservation require the Applicant's Governing Body to certify by resolution the approval of the application before submission of said application to the Office of Historic Preservation; and WHEREAS, the Applicant will enter into a Contract with the Office of Historic Preservation for the subject Project; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Juan Capistrano: 1. Approves the filing of an application for local assistance funds for the above project under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000/Califoria Heritage Fund; and 2. Certifies that the Applicant understands the assurances and certification in the Application Form; and 3. Certifies that the Applicant has reviewed, understands, and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and 4. Certifies that all archeological investigations, studies and reports used as the basis for work on this grant -funded property, as well as interpretation and mitigation, will be professionally prepared and approved by a qualified archeologist for conformance with The Secretary of the Interior's Standards for Archeology and Historic Preservation. Where appropriate, demonstrate consultation with local Native Americans, or other appropriate groups. 1 08-20-02 5. Certifies that for Development and Interpretation Projects, Applicant has adequate control (ownership, leasehold, easement, joint powers or cooperating agreement, or other long term interest in the property, in accordance with Covenant requirements; and 6. Certifies that all architectural plans and specifications used as the basis for construction work on this grant -funded Property will be prepared and approved by a professionally qualified restoration architect and/or engineer for conformance with the Secretary of the Interior's Standards for the Treatment of Historic Properties and the California Historic Building Code; and 7. Certifies the Applicant has or will have sufficient funds to operate and maintain the Project; and 8. Certifies that Applicant shall start the CEQA and, or, NEPA compliance process, if applicable, within 60 days after full execution of the Contract and shall complete and comply with CEQA and, or NEPA, if applicable, prior to the release of grant funds from the Office of Historic Preservation; and 9. Appoints the City Manager or his designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned Project.
