A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, ADOPTING THE DEVELOPMENT CHARGES
FEE SCHEDULE (CIP NO. 761)
WHEREAS, the March 2004 Domestic Water Master Plan Update includes an
integrated water system for the entire City service area and was adopted May 18, 2004;
and,
WHEREAS, the March 2004 Domestic Water Master Plan Update identified
improvements necessary to satisfy the demands of the existing customers and potential
new development consistent with the City land use plan; and,
WHEREAS, the March 2004 Capital Improvement and Replacement Projects
Funding Alternative Update valued these projects at $49,695,000 based on the February
2004 estimates corresponding to the Engineering New Record. Construction Cost Index of
7,690 for the Los Angeles area; and, I
WHEREAS, the City Council of the City of San Juan Capistrano on May 18, 2004,
adopted option three (3), of the March 2004 Capital Improvement and Replacement
Projects Funding Alternatives report to provide funding for needed system improvements;
and,
WHEREAS, the City Council has received a report titled "Consideration of the
Updated Domestic Water Master Plan, Negative Declaration, and Related Development
Charges Fee Increases" dated May 18, 2004.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Juan Capistrano, does hereby resolve as follows:
Section One — Findings
The City Council, based upon review of the Proposed Increase in Development
Charges Report, the Domestic Water Master Plan Update dated March 2004, the
March 2004 Capital Improvement and Replacement Projects Funding Alternatives,
and such other information as has been presented at a noticed public hearing on
May 18, 2004, which was conducted as required by Government Code Section
66016, does hereby find as follows:
A. The notice of hearing requirements of Government Code Section 66016 has
been satisfied.

B. The Development Charges proposed in the Development Charges Report is
a connection fee and/or a capacity charge and/or storage charge. The
amount of the proposed Development Charges does not exceed the -
estimated reasonable cost of providing the service and no election is
required for approval of the proposed Development Charges pursuant to
Government Code Section 66016.
C. As set forth in the Development Charges Report, the purpose of the
proposed Development Charges is to provide funding for water system
improvements required to supply new development and customers as
outlined in the Updated Domestic Water Master Plan.
D. The proposed Development Charges are proposed to be imposed on new
water service connections, which place additional demands on the City's
water system. The Development Charges vary according to the number and
size of service connections required by each development project and is a
pro rata share, according to demand of capital facilities costs that have been
and will be expended to complete the City's Domestic Water Master Plan.
There is a reasonable relationship between the fee's use and the types of
development projects on which the fee is imposed. There is also a
reasonable relationship between the need for water system improvements
and the types of development projects on which the fee is imposed.
Section Two — Development Charges
The portion covering the Developer Charges of the March 2004 Capital
Improvement and Replacement Projects Funding Alternatives Update is hereby
adopted, and the revised schedule of Development Charges (Exhibit A) is hereby
adopted. The City Manager is authorized and directed to assess and collect
Development Charges according to the schedule with respect to each new service
connection to the water system.
Section Three — Water Capital Improvement Proaect Fund.
All proceeds of the Development Charges shall be deposited to the Water Capital
Improvement Project Fund ("the Fund"), and together with any earnings thereof,
shall be separately accounted for. Expenditures from the Fund shall be exclusively
for capital costs of the City's Domestic Water Master Plan. The City Manager is
directed to notify this City Council when any amounts, on a first in, first out basis,
remain unexpended in the Fund for a period longer than five years.
Section Four — Effective Date.
The developer charges shall take effect sixty (60) days after the adoption of this
resolution.

The City Council approves and adopts the use of the Engineering News Record
(ENR) Construction Cost Index, Los Angeles Area, as the cost index for

Development Charges. The City Manager is authorized to administratively adjust
the Development Charges per the ENR Construction Cost Index without furtherCity
Council review.
