A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING COMPREHENSIVE
REVISIONS TO THE SAN JUAN CAPISTRANO ARCHITECTURAL
DESIGN GUIDELINES AND ADOPTING REVISED CITYWIDE DESIGN
GUIDELINES. (DESIGN GUIDELINES)
WHEREAS, the General Plan's Community Design Element sets forth goals and
policies related to the conservation and enhancement of the visual quality of San Juan
Capistrano's environment; and,
WHEREAS, the City of San Juan Capistrano desires to enhance the City's
unique identity and character; stimulate investment and strengthen the economic vitality
of the City; protect and enhance property values; maintain a high quality of life without
unduly restricting private enterprise, initiative or innovation in design; and,
WHEREAS, on March 19, 2002 the City Council directed staff to initiate
comprehensive revisions to the San Juan Capistrano Architectural Design Guidelines;
and,
WHEREAS, a draft Design Guidelines document has been prepared and has
been reviewed and endorsed by the Design Review Committee (DRC) and Planning
Commission; and,
WHEREAS, the proposed project has been processed pursuant to Section 9-
2.301, General Review Procedures of the Land Use Code; and,
WHEREAS, the Environmental Administrator has reviewed the proposed project
and has determined that the proposed revisions to the existing Architectural Design
Guidelines are consistent with the General Plan and within the scope of the project
covered by the General Plan Program EIR, as discussed in the Initial Study contained in
the document entitled "Findings of Consistency for the Citywide Design Guidelines with
the Previously Certified Environmental Impact Report for the San Juan Capistrano
General Plan"; and,
WHEREAS, Section 15168 of the CEQA Guidelines allows the City to approve
the revisions to the existing Architectural Design Guidelines without requiring additional
environmental documentation if the City finds that pursuant to Section 15162 of the
CEQA Guidelines, no effect could occur and no new mitigation measures are required
that were not already analyzed as part of the Program EIR for the General Plan; and,
WHEREAS, The Environmental Administrator at his meeting of March 25, 2003
made said determination per Section 15162 of the CEQA Guidelines; and,

WHEREAS, the City Council has considered the Environmental Administrator's
determination pursuant to Section 15062 of the California Environmental Quality Act --
(CEQA), has considered all project environmental documentation and technical studies
and,
WHEREAS, the City Council conducted a duly -noticed public hearing on
November 18, 2003 pursuant to Section 9-2.335 of the Municipal Code, to consider
public testimony on the proposed project and has considered all relevant public
comments.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby make the following findings:
1. The Design Guidelines are consistent with the policies and objectives of the San
Juan Capistrano General Plan; and,
2. The Design Guidelines comply with all applicable provisions of the Land Use
Code;and,
3. The Design Guidelines will promote and enhance the visual quality of the
community and promote the public health, safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby approve comprehensive revisions to the San Juan
Capistrano Architectural Design Guidelines and adopts the Design Guidelines (dated
September 1, 2003) as referenced and on file in the office of the City Clerk.
PASSED, APPROVED, AND ADOPTED this 18th day of November 2003.
