Resolution Number 03-10-07-01RESOLUTION NO. 03-10-07-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING A FEE SCHEDULE FOR INSPECTION, DUPLICATION AND PURCHASE OF VARIOUS CITY DOCUMENTS AND REPEALING RESOLUTION NO. 90-11-20-4 WHEREAS, the City receives numerous requests from the general public for copies of pubic records and official documents, in various formats; and, WHEREAS, original public records and official documents are an important public resource and it is in the public's interest that these documents are safely handled to preserve and protect the documents; and, WHEREAS, there is a cost to the City to provide copies and the cost can be considerable due to the costs of duplicating sizable individual documents, the cumulative total of providing many small quantities of documents, the process of producing accurate copies, or providing the staff time to supervise the copying of documents; and, WHEREAS, it is reasonable for the City to be reimbursed for the cost of providing copies of documents when requested for private use. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of San Juan Capistrano, that the following procedural rules and fees are adopted in accordance with Government Code section 6353(b) (California Public Records Act). SECTION 1. Procedural Rule for Duplication of Records a. Requests for copies are to be made during regular business hours. The reasonable time period for producing the copies and amount of fee deposit, if any, will be determined by the Department Director. b. Requests that ran not be reasonably handled by City staff, may be handled by a professional bonded to handle duplication of records. C. The City Clerk maintains a list of bonded professionals who may be retained to make copies of original records. Bonded professionals not listed must provide proof of current bonding, to the satisfaction of the City Clerk, or her designee, prior to receiving City records. 10-07-2003 A bonded professional may make copies either on-site or records may be released to the bonded professional. Arrangements to make copies on- site must be made in advance with the responsible staff member to avoid disrupting current work. SECTION 2. Waiver of Fees The above fees may be waived at the discretion of the Department Director when it is determined that the general public and/or City will benefit by providing the service at no cost. Examples of appropriate fee waivers include: a. Requests from City Officials, Commissioners, Committee Members, etc. needing copies to conduct City business. b. Requests from other pubic agencies. C. Requests from non-profit or charitable groups that provide service to community members. d. Requests from members of the press, representing media circulated to City residents, for the purpose of disseminating information to public. e. Requests from individuals or other private concerns directly...impacted by related pending actions of the legislative body. Questionable fee waivers will be determined by the City Manager. 3 1"7-2003 SECTION 6. Appeal of Fees Charged Appeals to the City Council may be filed with the City Clerk by those protesting -- fees charged or requesting waivers. SECTION 7.
