This approval is three (3) pages in length. Any changes to the plans that affect the exterior, or exterior materials, shall be resubmitted and approved by the committee prior to the start of work or that portion of the work. The committee does not need to approve any interior plan changes. 1.The fences between residences shall not be changed or disturbed. 2.Existing trees and hedges between residences shall not be removed without written approval from the Committee. 3.The sidewalk, street and the front of the site shall be kept as clean as reasonably possible during construction. All trash shall be placed in containers by the end of the work day. Trash piles are never allowed on the driveway or the front yard for more than two (2) consecutive days. 4.All work hours shall conform to the City of San Juan Capistrano’s hours for contractors. 5.All work, including cleanup of the site and street, shall be completed within one hundred twenty (120) days from when the construction beings as defined by any work on the site. Extension shall be coordinated in advance with the committee and acknowledged in writing by the committee. 6.Any signs advertising any company, e.g., contractor shall not be displayed for no more than one (1) day after the work is complete, or for 90 calendar days total, whichever is less. Any signs that remain after 90 days may be removed by Mission Woods Architectural and Landscaping Committee without the homeowner’s or the contractor’s permission(s). The Mission Woods Architectural and Landscaping Committee will not be held accountable or responsible for any signs removed. This approval is void for all purposes if not submitted to the City of San Juan Capistrano, California by 7/1/2025 7.By using this approval you, the owner, agree that any changes in plans that affect the external appearance, or external materials, shall require written re-approval by the Architectural and Landscaping Committee PRIOR to any work being started. I also agree that any failure to comply shall: ▪Permit the committee to verbally order your contractor to immediately stop work, and I/we (the homeowners) assume all expenses with the order to stop work – Your contractor shall stop work when first requested by any committee member. ▪Permit the committee to revoke this approval without prior notice to you. ▪Permit the committee to employ a contractor to enter upon your property without your consent, and to remove any non-conforming materials, and to place a lien on your property to pay for the removal of the non-approved materials, and replacement with approved materials. ▪Agree that all requirements of this approval are enforceable by Article VII, Section 1, “Enforcements”, as noted in Declaration of Covenants, Conditions, and Restrictions (CC&Rs) pertaining to your residence. 12.The Architectural and Landscaping Committee provides approval for external cosmetic appearance only. The Architectural and Landscaping Committee makes no assurances or guarantees for the quality of materials, engineering or workmanship. 13.This approval is for the Approval of Retaining Wall Surrounding ADU. All other work requires separate written approval from the committee. 14.Use of the ADU shall conform to the City of San Juan Capistrano regulations, zoning and planning. 15.In the event of a conflict between approval letter copies, the copy held by the committee shall be the factual and legal version. Note to the Building and Planning Departments of San Juan Capistrano: The Mission Woods Architectural and Landscaping Committee approves all requests for building permits prior the commencement of any work, in accordance with our Declaration of Covenants, Conditions, Restrictions and Reservations.
