Good Afternoon,
Address 33720 Paseo del Puerto, San Juan Capistrano is cleared by SMWD to proceed
with construction per the submitted plans. There appears to be no impact to Public
Water and Sewer; however, SMWD will provide final clearance after the pool is
constructed and backflow device is inspected.
PLEASE NOTE: SMWD must be notified 48 hours prior to installation of the backflow
device. Once installed, SMWD will inspect the device. Backflow device must be tested
by an approved backflow tester with a Backflow Assembly Testing Certification from an
ANSI accredited organization. After device inspection and successful device testing,
SMWD will provide final clearance.

All plant beds and paved areas must slope to drain at a minimum rate of 1% or 1/8” per foot with a slope of
2% or ¼” per foot preferred.
All drainpipes must drain at a minimum of ½% or 1/16” per foot with a slope of 1% or 1/8” per foot preferred.
All grades in plant beds must be held a minimum of 6 inches below adjacent finish floor and 4 inches below the adjacent
metal house screed
All grades in plant beds must be held a minimum of 6 inches below the top of adjacent planter or retaining wall.
All plant bed grades adjacent to existing walls or fences are not to be changed
All finish surfaces of paving elements are to be held below the adjacent metal house screed
All plant beds and paving are to slope and drain away from the house
Utilize domed grates on catch basins in plant bed areas
3. Make sure to provide adequate drain inlets and drain lines to accommodate
the yard improvements.
4. NO CHANGES, MODIFICATIONS, OR ALTERATIONS ARE TO BE MADE TO
ASSOCIATION MAINTAINED AREAS. ANY CHANGE MADE TO THE ASSOCIATION

RAISED DECK STRUCTURES-
7. DECK ABOVE 30-INCHES
Any decks constructed thirty (30) inches or more above finished grade
shall meet the City of San Juan Capistrano’s Municipal Code minimum
setback requirements for a detached accessory structure. Walls and view
fences installed by the developer and builder shall be considered the
property boundary for calculating minimum distance.
It is the homeowner’s responsibility to obtain all necessary city approval
for any deck greater than (30) inches. Proof of city approval will be
required to be submitted with Notice of Completion. Setbacks for decks
lower than 30 inches shall match the height of the proposed deck, i.e., a
24-inch-high deck shall have a 24-inch setback.
WATER FEATURES-
8. Top of ALL WATER FEATURE ELEMENTS are not to exceed the top of the
adjacent property line wall/fence or 6ft, whichever is most restrictive.
9. Make sure all pool/spa equipment is visually screened and the noise attenuated
for the adjacent lots.
10. Filter and heating equipment – All equipment shall be completely screened from
the street and common areas. Filter, heating, and other pool support
equipment shall be located no closer than twenty (20) feet from any
neighboring dwelling, unless such equipment is placed behind a noise barrier
enclosure to minimum the impact of the neighbor(s).
11. Pools, spas, raised bond beam with planters, etc. CANNOT retain against the
property line fences and wall. All structures are to be self-supporting and
cannot be back-filled against the existing perimeter fences & walls.
12. Pools and spas cannot interfere with the existing drainage system on the
surface or underground. All proper setbacks must be met. Noise barriers are
required for pumps and motors.
EXTERIOR FIRE STRUCTURES-
13. Exterior materials, stucco, block, stone, etc. is to match the existing house
materials and architectural style.

14. Setbacks and installation of exterior fire structures (barbeque, fire pits,
fireplaces, etc.) and underground lines shall comply with local jurisdiction.
15. Barbeque must be setback a minimum 3ft clear from the view fences installed
by the Builder.
16. Fireplace of six (6) feet or less is to be setback a minimum 3 ft. from adjacent
wall/fence.
17. Fireplace greater than six (6) feet and eight (8) feet is to be setback a
minimum 5ft. from adjacent wall/fence.
18. Fireplace that exceeds 8ft in height shall be setback a minimum 10ft and
screened with planting material.
GATES, FENCES, WALLS, & PILASTERS-
No improvements are to be attached to the perimeter fences and walls (side and rear)
19. Exterior materials, stucco, block, stone, etc. is to match the existing house
materials and architectural style.
20. GATES: are to match the existing architectural style, color scheme, and
consistent with the overall community.
21. Overall height of gates, fences, walls and/or fence and wall combination are not
to exceed 6ft. or height of adjacent property line wall/fence, whichever is
most restrictive.
22. Existing fences & walls are not designed to retain dirt from raised planters.
Provide four inch minimum width waterproof flash-wall with a minimum 2-inch air
gap between any new raised planter wall and existing fence/wall.
23. Hold walls and pilasters a minimum of 3 ft. clear from the back of the sidewalk.
EXTERIOR LIGHTING-
The installation of any lighting or string lighting requires the review and approval of the
ARC.
24. Exterior lighting is to be low voltage.
25. Overly ornate light fixtures or commercial light fixtures are not permitted.
26. No exterior lighting placed so as to cause an unreasonable glare or illumination
on any other private property or common area.
27. The use of timers or motion sensors is recommended to keep lights off when
not needed such as when residences retire for the night.

28. Overall height of posts and light fixtures cannot exceed the height of the
adjacent property line fence/walls.
29. Exposed bulbs, string lights, spotlights, colored lights and reflectors are not
permitted.
30. No exterior lighting is permitted to be installed on the boundary walls.
31. STRING LIGHTING GUIDELINES:
String lights shall not be installed above 8ft attached to any home or 8ft
overall.
String lights should not be installed above this level on any exterior
structure except patio covers & gazebos.
String lights are only allowed in the back yard area.
String lights are not allowed to be attached to the Builder installed
perimeter fences/walls.
String lights shall be a minimum distance of 3ft from exterior boundaries
unless completely shielded by landscaping.
Bulbs shall be at least 12” (inches) to 24” (inches) apart and as well as 12”-
24” away from each individual bulb.
String lights attached to an accessory structure such as a patio cover or
gazebo shall be fixed against the ceiling beam line of the structure, to fit
tight and not be drooping from the structure.
String light upright support/posts are allowed but must be painted to
blend in and cannot be higher than 8ft.
Posts must not bend, cannot be reflective and cannot be used for any
other purpose.
Poles need to be removed when lights are no longer on them.
Trees cannot be used as supports for string lighting.
String lights must be supported by guy wires if the span of lights is over
8ft unsupported.
String light bulb rating must not be greater than 1 watt with a 2,700-kelvin
rating for LED lights, or the equivalent for others.
Any bulbs not in compliance will need to be removed or an acceptable bulb
shade will need to be installed on each bulb.
White light color tones greater than 3,000-kelvin, which include the bright
white color tone are prohibited.
32. String lights shall not be controlled by motion sensors and are not permitted
to be used as security lights

TREE NOTES-
Per the CC&Rs - All trees must be planted a reasonable distance from the property line fence/wall to keep
trees from hanging over the property line fences/walls. Homeowner is solely responsible for the pruning of
all trees and shrubs so that the overhang and droppings of the plants/trees are entirely on their own yard
and not a nuisance for the neighboring adjacent lot.
35. All trees installed within 5ft of most structures (fences, houses,
walls, etc.) should have ROOT BARRIERS to prevent root invasion.
36. At least once a week, pick up and dispose of any fruit on the ground or that is
spoiling in the tree.
