KNOW ALL MEN BY THESE PRESENTS:
WHEREAS the City of San Juan Capistrano (“City”) and ___________________
(“Principal”), have executed an agreement for work consisting of, but not limited to, the furnishing
of all labor, materials, tools, equipment, services, and incidentals for all grading and installation of
related improvements for Tract Map Nos. _____________________ (“the Work”);
WHEREAS, the Work to be performed by Principal is more particularly set forth in
that certain Grading Surety Agreement dated _________________, 20___ (“Agreement”), which
Agreement is incorporated herein by this reference; and

bond for performance of the Agreement, and to guarantee and warranty the Work performed
thereunder.

time, alteration, or addition to the terms of the Agreement, or to any plans, profiles, and
specifications related thereto, or to the Work to be performed thereunder, shall in any way affect its

Introduction
In accordance with your request, LGC Geotechnical, Inc. (LGC Geotechnical) has prepared this letter to
provide geotechnical release from rough grading of “Avelina”, Phase 5, Buildings 2 and 3 (Units 48
through 60) of Tract No. 18148 within the proposed residential development located at the southwest
corner of Calle Arroyo and Paseo Tirador, in the City of San Juan Capistrano, California.
Geotechnical Release from Rough Grading
LGC Geotechnical recently provided geotechnical observation and testing services during grading for the
subject area. Observation included over-excavation and removals of unsuitable materials, placement of
compacted engineered fills and finish grade testing. Where tested, compacted fill materials were found to
meet the project specification of at least 90 percent relative compaction, as determined by ASTM Test
Method D1557. Rough grading of the subject tract was reported in the referenced report (LGC
Geotechnical, 2023).
Based on our observations and testing during grading, we consider the subject lots to be generally
suitable for their proposed use from a geotechnical standpoint provided the recommendations included
in the referenced reports (LGC Geotechnical, 2021a, 2021b, 2021c, and 2023) and future applicable
geotechnical reports are appropriately implemented. The subject area was constructed in general
accordance with our recommendations and the requirements of the City of San Juan Capistrano.

Retaining wall footing for Wall A Stake in wall footing
Violation and repair:
1) Red box shows wood stake found in retaining Wall A footing adjacent to the footing
step.
2) The repair shall be to remove the wood stake by drilling is out from the top to the
bottom of the footing. The void will then be filled with Quikrete Fast Set Non-Shrink
Grout. The Grout will reach up to 8000 psi compressive strength.
