Neither the Association, its Architectural Committee, nOr any member thereof shall be liable to any Owner for any damage,
1oss, Or Pr匂udice suffered or claimed on account of any mistakes in judgment, negligence, Or nOnfeasance arising out of (a)
the approval or disapproval of any plans, drawings, and specifications, Whether or not defective; (b) the construction or
Perfomance of any Improvement prQject, Whe血er or not under approved plans, drawings, Or SPeCifications; Or (C) the
execution and filing of a Notice of Noncompliance, Whether or not the facts therein are correct, PrOVided, however, that such
member has acted in good faith on the basis ofsuch infomation as he or she possessed at血e time the act or omission
