REGULAR MEETING
ORGANIZATION:
Chair Fancher called the Regular Meeting of July 24, 2024, of the Planning Commission of the
City of San Juan Capistrano to order at 5:02 p.m.
ROLL CALL:
PLANNING COMMISSIONERS PRESENT: Chair Darren Fancher, Vice Chair Tami Wilhelm,
Commissioners Stan Braden, Jeff Moore, and Ted Rosenfeldt arrived at 5:06 p.m.
COMMISSIONERS ABSENT: None
STAFF PRESENT: Laura Stokes, Principal Planner
Justin Poley, Associate Planner
Laurel Reimer, Contract Planner
Alisha Winterswyk, Deputy City Attorney

Commission Action: Moved by Commissioner Moore, seconded by Commissioner Wilhelm to
approve consent calendar item C1. Motion passed by a 4-0 vote.

E1. Request to Pay a Fee In Lieu of Constructing a Historic Depiction Program at 30700
Rancho Viejo Road (Assessor Parcel Number 650-111-15) and a finding that said
action is exempt from the California Environmental Quality Act (CEQA) pursuant to
CEQA Section 15061 (b)(3) (Applicant Benjamin Horning, Dedeaux Properties, LLC)
(Project Manager: Laurel Reimer, Contract Planner).
Laurel Reimer provided the staff presentation and responded to questions.
Chair Fancher opened the public meeting, and no one provided public testimony.
Commission Action: COMMISSIONER Wilhelm made a motion, seconded by
COMMISSIONER Braden, to move in accordance with City Council Policy No. 606,
approve the payment of a $25,000 fee in lieu of constructing a Historic Depiction
Program at the Swallows Creek Project site at 30700 Rancho Viejo Road. The motion
passed by a 5-0 vote.

PUBLIC HEARINGS:
F1. Consideration of Grading Plan Modification (GPM) 23-018; Johnson and Titus
Residence, a request to modify the grade on a previously developed parcel to
accommodate the construction of a new single-family residence and related accessory
structures located at 26132 Calle Roberto (APN: 649-311-07) and a finding that said
Project is Categorically Exempt from the California Environmental Quality Act per State
CEQA Guidelines Section 15303. The proposed grading activities involve 600 cubic
yards of cut, 1,450 cubic yards of fill and 850 cubic yards of export with a series of
retaining walls up to 8’ in height (Applicant: Charles d’Arcy, d’Arcy Architecture) (Project
Manager: Justin R. Poley, Associate Planner).
Commissioner Wilhelm recused and removed herself from the meeting due to a conflict
of interest with item F1.
Justin Poley provided the staff presentation and responded to questions.
Chad Peterson, Applicant, responded to questions.

Chair Fancher opened the public hearing, and no one provided public testimony.
Commission Action: COMMISSIONER Braden made a motion, seconded by
COMMISSIONER Moore, to adopt a resolution approving GPM 23-018, as conditioned,
and finding that the proposed Project is Categorically Exempt from the California
Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15303.
The motion passed by a 4-0 vote.

single-family residence and related accessory structures located at 31721 Peppertree
Bend (APN: 649-342-05) and a finding that said Project is Categorically Exempt from
the California Environmental Quality Act per State CEQA Guidelines Section 15303.
The proposed grading activities involve 6,665 cubic yards of cut, 150 cubic yards of fill
and 6,515 cubic yards of export with a series of retaining walls up to 9’ in height
(Applicant: Rob Williams) (Project Manager: Justin R. Poley, Associate Planner).
Commissioner Braden recused and removed himself from the meeting due to a conflict
of interest with item F2.
Justin Poley provided the staff presentation and responded to questions.

Commission Action: COMMISSIONER Wilhelm made a motion, seconded by
COMMISSIONER Rosenfeldt to adopt a resolution approving GPM 24-009, as
conditioned, and finding that the proposed Project is Categorically Exempt from the
California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines
Section 15303. The motion passed by a 4-0 vote.
