including planting, pool, spa, and paving.

Status: Approved with conditions.

After review of the submitted landscape improvement plan s, it has been determined that the
plans are in conformance with the community guidelines and are therefore approved with th e
following conditions:
1. The p atio covers (or pergolas) shall be constructed in accordance with the
noncombustible materials requirements of the Fire Protection Plan described in
Section 2.2 of the Declaration. Subject to the Fire Protection Plan and city of San
Juan Capistrano requirements, including setback from perimeter walls and property
l ines. Th e patio covers may be a maximum of ten (10) feet high from the grade to the
highest point. The appearance of patio covers must be consistent with the appearance
of the house, but also consistent with the requirements of the Fire Protection Plan. The
color must match the h ouse trim or the wall color.
2. The driveway cannot be widened more than 24-inches on either side of the builder
instal led driveway. No dimensions were shown on the plan . Do not wide more than 2-
feet on either side.
3. Item #C -10 on the hardscape plan must be same material as the existing eyebrow.
Style, design, color and materials must look exactly like the existing so that this
improvements appears to be part of the original construction.
4. Item #C -9 must be set back from the corner of the residence a mini mum of 48-inches.
Please install plant material at the base of the residence from the corner to the h ouse
to the new fence/gate.
5. All trees must be installed with root barriers. Any trees that have droppings must
maintain an eight-foot setback from perimeter walls and property line and must be
maintained to stay within property lines.
6. All drainage must tie into the existing builder installed drainage system.
7. Do not disturb builder installed perimeter walls when installing any plant materials.
Vine plant material should be staked on trellises and installed one-foot from perimeter
walls.
8. Any raised planters cannot hold soil directly against neighboring wall, perimeter walls
and/or fences. Raised planters must contain soils on all four sides, so that builder
installed walls, neighboring walls, and/or fences do not retain soil. Planters with built-in
bench must be built with a subwall between soil and perimeter wall.
9. No plant materials on the community undesirable plant palette are permitted.
10. Barbecue must use gas or propane as a fuel source. No combustible materials are
permitted.
GENERAL NOTES:
A. Construction of any improvement prior to receipt of approval or deviation from
approved plans is a violation of the master declaration, and in such event; the owner
may be required to remove the unauthorized improvements at owner’s sole cost and
expense.
B. This application approval does not constitute City or County approval. The Owner
must contact local regulatory agencies and be sure that he or she is following all
building and zoning regulations in force.
