Mr. Rojas,
The Santa Margarita Water District (SMWD) has received questions from City of San Juan Capistrano
(CSJC) staff and from residents regarding accessory dwelling unit (ADU) connection requirements. SMWD
is aware of CSJC Municipal Code Land Use (MCLU) revisions regarding ADUs adopted in December 2022
that are summarized within Section 9-3.501.1. The email sent to Mike Marquis of SMWD by James Wiatrak
on 12/21/2022 which described the CSJC Building Department views on the ADU utility connection topic is
appreciated. SMWD has reviewed the ADU project at the subject address and issued a Sanitation Clearance
(SC) message (attached) for the water and sewer (W&S) facilities in public right-of-way (ROW). Please
consider this SMWD correspondence a release to not require new off-site W&S utility connections in ROW
as defined in the CSJC MCLU criteria unless determined otherwise as described below.
For reference, Subsection 4.2a of the “SMWD Rules and Regulations for Water, Recycled Water and
Wastewater Service” (effective date October 23, 2015 and amended on January 17, 2020), states that “two or
more buildings, under one ownership and on the same lot or parcel of land, may be supplied by a single
water (domestic) service”. SMWD reviews ADU applications to determine if the existing facilities in ROW
or easement serving an existing residence can accommodate the additional demand and wastewater
generation rate per the latest edition of the California Plumbing Code (CPC). If the ADU applicant does not
specifically request new separate W&S services and SMWD’s review determines that the existing laterals in
ROW or easement can accommodate the CPC demands added by the ADU, then separate W&S laterals and
all substantial connection fees and related costs are not required. As noted above, please consider the SC on
the following page for this site.
Please note that CPC criteria still needs to be reviewed by the CSJC to determine if the ADU can properly
drain to the existing on-site sewer lateral. CSJC staff and support consultants who are working on the subject

Introduction
Enviro Diagnostics was retained to perform an asbestos survey at the subject property to
determine the asbestos content of suspect asbestos-containing building materials planned for
renovation activities. The subject property is a condominium built in 1978. No obvious fire or
structural damage to the subject property was observed. The structure was occupied at the time
of the inspection. The asbestos survey was limited to the sampled areas and/or building
materials described in the provided tables and laboratory sample data reports. Other areas and/
or building materials were not sampled at the subject property at the time of this survey. The
inspection and sample collection was performed by Gabriel Klein, California Certified Asbestos
Consultant.
Asbestos Survey Summary
•No asbestos was detected in the collected samples.
Asbestos Bulk Sample Collection & Laboratory Methodology
Bulk samples were collected to determine the asbestos content of suspect asbestos-containing
material (ACM) planned for renovation and/or demolition activities at the subject property. The
building materials were sampled in accordance with federal EPA AHERA / SCAQMD Rule 1403
protocols. Suspect ACM are classified and grouped as homogenous materials based on their
texture, color, substrate, etc. Non-suspect asbestos-containing materials such as metal, wood,
glass, etc. were not sampled at the time of this survey. The bulk samples were collected in such
a manner as to minimize potential fiber release. Material type, sample location and other
relevant information were recorded at the time of sample collection. The samples were placed in
an airtight polyethylene bag, labeled with a unique number, and submitted to the laboratory with
a proper chain of custody form.
The samples were analyzed for asbestos content at EMLab P&K located at 2841 Dow Avenue,
Suite 300, Tustin CA 92780. EMLab contact phone number: 886-888-6653. EMLab P&K is a
NVLAP accredited laboratory for asbestos analysis in compliance with existing federal, state,
and local regulations (NVLAP Lab: 200757-0). The samples were analyzed in accordance with
EPA Method 600/R-93-116 using polarized light microscopy (PLM) with dispersion staining and
using visual estimation to determine the percentage of asbestos content. The PLM method
identifies and quantifies the primary types of asbestos found in the collected samples. The lower
limit of detection for this method is 1%. Samples containing less than 1% percent asbestos are
reported as trace or <1%. If no asbestos fibers are detected in a sample the lab reports the
findings as non-detect (ND).
A material is considered by the EPA to be ACM if at least one sample result shows asbestos
present in an amount greater than one percent (>1%). In the State of California, the Division of
Occupational Safety and Health (Cal/OSHA) considers a material to be asbestos-containing
construction material (ACCM) if at least one sample result shows asbestos present in an
amount greater than one-tenth of one percent (>0.1%). Sample results of less than one percent
(<1%) may be further analyzed utilizing the 1000-point count method. Specific removal
requirements apply if ACM / ACCM will be disturbed during maintenance, renovation, or
demolition activities.

Recommendations
•If the planned renovation activities will impact additional suspect asbestos-containing
materials and/or areas not identified in this report, work practices should be halted until
additional sampling and analysis can be conducted.
Conditions & Limitations
The inspection and sample collection was performed by certified, trained personnel. The limited
sampling strategy used indicates the status of the building materials that were sampled only and
does not determine the potential presence of asbestos or other hazardous materials in any
other building materials or areas. Enviro Diagnostics is not responsible for any changes made to
the original scope of work. Sample collection is limited to accessible building materials only and
does not include the assessment of inaccessible or hidden building materials such as building
materials located inside of wall-cavities. Enviro Diagnostics is not responsible for the presence
of asbestos or hazardous materials in any of these areas. If additional suspect asbestos-
containing materials are encountered during demolition and/or renovation activities, work
practices should be halted and the additional suspect materials should be analyzed for asbestos
content. Further testing and/or abatement may be required to address any additional asbestos-
containing building materials. Enviro Diagnostics has performed the tasks set forth in a
professional manner, consistent with industry standards. However, Enviro Diagnostics can
neither guarantee and does not warrant, that this limited assessment has revealed all adverse
environmental conditions affecting the property, nor can Enviro Diagnostics warrant the
assessment requested would satisfy the dictates of, or provide a legal defense in connection
with, environmental laws or regulations. This report must be read and considered in its entirety.
It is the responsibility of the property owners, representatives and/or residents to disclose any
pertinent information regarding the environmental history of the property. This report is not for
the purposes of determining potential health risks associated with any hazardous materials. If
inhabitants have health concerns a physician should be consulted. Enviro Diagnostics cannot
