A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN
CAPISTRANO FINDING THAT THE FISCAL YEAR 2021 THROUGH 2028 CAPITAL
IMPROVEMENT PROGRAM CONFORMS TO THE CITY'S ADOPTED GENERAL PLAN
Whereas, the City's Capital Improvement Program represents an important
mechanism for implementing the goals, policies, and recommendations of the General
Plan, in particular the circulation, safety, parks and recreation, and growth management
policies; and,
Whereas, the City of San Juan Capistrano Municipal Codes Section 2-2.703
and Section 9-2.337 establishes duties for the Planning Commission to review the City's
Capital Improvement Program for consistency with the City's General Plan and to
forward recommendations to the City Council; and,
Whereas, the Environmental Administrator has reviewed the project pursuant to
Section 15262 of the Guidelines for the California Environmental Quality Act (CEQA) and
has determined that the project is a planning study and is therefore exempt from further
environmental review, because each project identified in the Capital Improvement Program
will be subject to a separate environmental review process at such time as design and
funding for each project is approved; and,
Whereas, California Government Code section 65103 requires the Planning
Commission to annually review the Capital Improvement Program for consistency with the
General Plan; and,
Whereas, California Government Code Section 65401 mandates that Capital
Improvement Programs may only be adopted by decision-making bodies following
determination of General Plan consistency by the Planning Commission; and,
NOW, THEREFORE, BE rr FURTHER RESOLVED, thatthe Planning Commission
of the City of San Juan Capistrano hereby finds that the Draft FY 2021-2028 Capital
Improvement Program substantially conforms to and implements the goals and policies
of the City's General Plan.
