PC Resolution-21-01-26-01PC RESOLUTION NO. 21-01-26-01 SIGN PERMIT (SP) 19-029 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA APPROVING SIGN PERMIT (SP) 19-029 FOR THE CAPISTRANO GARDEN HOMES #1 SUBDIVISION MONUMENT SIGNS LOCATED ALONG CALLE LORENZO BETWEEN PASEO EL MARMOL AND PASEO SANTIAGO (ADJACENT TO APN: 649-134-16), AND ADJACENT TO THE HOMEOWNER’S ASSOCIATION STORAGE LOT, LOCATED AT THE NORTHWEST CORNER OF CALLE SANTA ROSALIA AND CALLE BONITA (ADJACENT TO APN: 649-172-01) Whereas, Amanda Seibel, the (the “Applicant”), has requested approval of Sign permit (SP) 19-029 for Capistrano Garden Homes #1 to establish two subdivision monument signs for the residential subdivision Capistrano Garden Homes #1, which is General Plan designated Single-Family 4,000 District (RS-4,000), and classified as Medium High Density on the Official Zoning Map (the “Project”); and, Whereas, The City of San Juan Capistrano, the owner of real property located along Calle Lorenzo between Paseo El Marmol and Paseo Santiago (APN: 649-134-16) and located at the northwest corner of Calle Santa Rosalia and Calle Bonita (APN: 649- 172-01), has consented to such application by way of an encroachment permit and HOA acceptance of all maintenance for the sign and landscaped area around the sign; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review of the Land Use Code; and, The City's Environmental Administrator has determined that the project is Categorically Exempt (Section 15311; Class 11 “Accessory Structures”) from further review. The project is consistent with Section 15311 because the project consists of construction of two on-premise signs, a minor structure, and accessory to an existing residential subdivision. A Notice of Exemption (NOE) will be posted should the project receive final approval; and, Whereas, the Planning Commission has considered the Environmental Administrator’s determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, Whereas, the Planning Commission conducted a duly-noticed public meeting on January 26, 2021, pursuant to Title 9, Land Use Code, Section 9-2.302 to consider public testimony on the proposed project and has considered all relevant public comments. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby find that the project is Categorically Exempt (Section 15311; Class 11 “Accessory Structures”) from further review under the California Environmental Quality Act. The project is consistent with Section 15311 because the project establishes two signs, considered accessory to the overall subdivision. PC Resolution 21-01-26-01 2 January 26, 2021 NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings as established by, Section 9-2.343(k), Sign Permit of Title 9, Land Use Code of the City of San Juan Capistrano: 1. The proposed signs comply with all other applicable criteria in the sign code, specifically the design of the signs is consistent with the surrounding community buildings, the non- illuminated signs comply with the illumination standards of the code, the signs are within the maximum size requirements for subdivision and monument signs, and the proposed HOA maintained landscaping at the base of the monument signs meets the design guidelines requirement. The request for two subdivision monument signs includes a request for an exception to the Sign Code to allow for two permanent signs in the public right-of-way. The proposed signs meet the most restrictive standards for subdivision and monument signs which apply to the Residential and Town Center zones. The location of the signs is consistent with the subdivision and monument sign requirements, which allow for two residential subdivision signs at each project entry to a subdivision community. 2. Each 5.5’ high sign, with 11.7 square feet of sign copy area, will be in harmony with the site, with the surrounding properties and in scale with the location, similar to other subdivision monument signs located throughout San Juan Capistrano. 3. The signs are proposed to be located outside of the visibility triangle necessary for safe vehicular travel, which ensures that the signs would not create a hazard to pedestrians or vehicular traffic. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings as established by, Section 9-2.343, Sign Permit of Title 9, Land Use Code of the City of San Juan Capistrano: 1. The proposed Capistrano Garden Homes #1 subdivision monument signs meet all design criteria within Municipal Section 9-3.543, because the signs consist of a painted wood background with an autumn stone ledgestone veneer base, which are common materials and colors used throughout the subdivision community, and the signs are proposed to have drought tolerant landscaping at their base. Additionally, the signs meet Community Design Element Policy 1.2 Encourage high quality and human scale design in development to maintain the character of the City, because the signs would provide high quality materials, are designed with vehicular traffic and circulation orientation in mind, and maintain similar designs as residential subdivision signage found in the City. 2. Staff has determined that no Sign Program exists for the site. The most restrictive standards for a subdivision and monument sign are a maximum sign area of 24 square feet and a maximum height of 6’-0” as established in the Residential and Town Center zones. The proposed sign height of 5’-0.6” and sign copy area of 11.7 square feet conforms to the most restrictive standards, and other applicable requirements of Section 9-3.543.
