PC Minutes-2023-05-24 MINUTES May 24, 2023 SAN JUAN CAPISTRANO PLANNING COMMISSION REGULAR MEETING ORGANIZATION: Chair Gaffney called the Regular Meeting of May 24, 2023, of the Planning Commission of the City of San Juan Capistrano to order at 5:01 p.m. ROLL CALL: PLANNING COMMISSIONERS PRESENT: Commissioners, Matt Gaffney, Darren Fancher, Stan Braden, Ted Rosenfeldt, and Tami Wilhelm . COMMISSIONER ABSENT: None. STAFF PRESENT: Joel Rojas, Development Services Director Paul Garcia, Acting Principal Planner Justin Poley, Associate Planner Alisha Winterswyk, Deputy City Attorney Agenda items are presented in the originally agendized format but were not necessarily heard in that order. PLEDGE OF ALLEGIANCE: Chair Gaffney led the Pledge of Allegiance. ORAL COMMUNICATIONS: CONSENT CALENDAR: Commission Action: Moved by Commissioner Wilhelm, seconded by Commissioner Fancher, to approve consent calendar item C1 with corrections made to the motion on item F1. Consideration of Sign Permit (SP) 23-003,The Alliance for San Juan Art Mural: A request to allow a 180 square foot mural to be installed on the rear wall of the Capistrano Trading Post building, located at 31741 Camino Capistrano (APN: 124-181- 06) and a request for a sign exception to allow the mural to exceed the Land Use Code maximum sign area and height requirements for murals and a finding that said actions are categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15311. (Applicant: Richard Heimann, The Alliance for San Juan Art) (Project Manager: Justin R. Poley, Associate Planner). Justin Poley provided the staff presentation and responded to questions. Rich Heimann, applicant representative, responded to questions. Chair Gaffney opened the public meeting, and Tom Scott, Lou Heimann, Howard Hart, Jennifer Kiel, Kristina Brown, and Frank Larkin Robert Montgomery provided public testimony. Commission Action: COMMISSIONER Wilhelm made a motion, seconded by COMMISSIONER Fancher, to adopt a resolution approving Sign Permit (SP) 23-003 to allow a 180 square foot mural to be installed on the rear wall of the Capistrano Trading Post building, located at 31741 Camino Capistrano (APN:121-181-06) and approving a sign exception to allow the mural to exceed the Land Use Code maximum area and height standards for murals with a condition that the mural be reviewed by the Planning Commission five years after installation, and finding that said actions are exempt from CEQA review pursuant to CEQA Guidelines Section 15311 (Class 11 categorical exemption). Consideration of Tentative Parcel Map (TPM) 22-001, Ortega Village Commercial Center: A request to allow the subdivision of Parcel 16 of Parcel Map 79-856, a 6.27-acre parcel addressed as 31654 Rancho Viejo Road (APN 666-261-14), into three parcels: 3.72-acre Parcel 1; 2.19-acre Parcel 2; and .36-acre Parcel 3, and a finding that said action is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15315. Chair Gaffney opened the public hearing, and no one provided public testimony. Commission Action: COMMISSIONER Rosenfeldt made a motion, seconded by COMMISSIONER Wilhelm, to adopt a resolution recommending that the City Council conditionally approve Tentative Parcel Map (TPM) 22-001 and find that said action is Categorically Exempt from CEQA pursuant to State CEQA Guidelines,15315. COMMISSION/STAFF COMMENTS: At Commissioner Fancher’s request, staff and the Deputy City Attorney provided an update on the regulations for participating in Planning Commission meetings from a remote location since Executive Orders in response to COVID have been rescinded. ADJOURNMENT: There being no further business, Chair Gaffney adjourned the meeting at 6:02 p.m. to Wednesday, June 14, 2023, at 5:00 p.m. in the City Council Chamber at the Nydegger Building - 31421 La Matanza Street, San Juan Capistrano.
