A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING THE ENGINEER’S REPORT
AND DECLARING ITS INTENTION TO LEVY AND COLLECT
ASSESSMENTS WITHIN EXISTING LANDSCAPE MAINTENANCE
DISTRICTS AND OPEN SPACE MAINTENANCE DISTRICTS FOR FISCAL
YEAR 2023-2024 PURSUANT TO THE PROVISIONS OF DIVISION 15,
PART 2 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF
CALIFORNIA AND CHAPTER 2.5 OF DIVISION 1 OF TITLE 5 OF THE
GOVERNMENT CODE OF THE STATE OF CALIFORNIA, RESPECTIVELY,
SETTING A TIME AND PLACE FOR THE PUBLIC HEARING THEREON,
AND MAKING CERTAIN FINDINGS AND TAKING OTHER ACTIONS
RELATING THERETO
WHEREAS, the City Council (the “City Council”) of the City of San Juan Capistrano,
California (the “City”) has previously formed two landscape maintenance districts pursuant
to the terms and provisions of the “Landscaping and Lighting Act of 1972,” being Division
15, Part 2 of the Streets and Highways Code of the State of California (together, with the
Open Space Maintenance Act, referred to herein as the “Act”), in what is known and
designated as: Capistrano Royale Landscape Maintenance District, and Belford Terrace
Landscape Maintenance District, and has also previously formed four open space
maintenance districts pursuant to the terms and provisions of the “Open Space
Maintenance Act,” being Chapter 2.5 of Part 1 of Division 1 of Title 5 of the California
Government Code, in what is known and designated as: Mission Woods Landscape
Maintenance District, Mission Springs Landscape Maintenance District, Seaview Estates
Landscape Maintenance District, and Los Corrales Landscape Maintenance District
(hereinafter referred to as the “Districts”); and
WHEREAS, the City Council previously initiated proceedings for the annual levy of
assessments for the Districts for Fiscal Year 2023-2024 pursuant to the Act for the purpose
of financing the maintenance of landscaping improvements within each respective District,
including landscaping, water, electricity, planting, shrubbery, trees, turf, irrigation systems,
hardscapes, fixtures and appurtenant facilities in public rights-of-way, parkways, slopes,
and dedicated easements within the boundaries of the Districts, and ordered the City’s
Public Works Department to prepare and file a report (the “Engineer’s Report”) with the City
Clerk in accordance with Article 4 (commencing with section 22565) of the Act; and
WHEREAS, at this time there has been presented and approved by this City
Council, the preliminary Engineer’s Report as required by law, and this City Council desires
to continue with the proceedings for said annual levy.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby resolves, determines and orders as follows:

SECTION 1 – INTENTION
The City Council hereby declares its intent to levy and collect the annual
assessment for Fiscal Year 2023-2024 within each of the Districts for the continual
maintenance of landscaping, as authorized under the Act. The areas to be
assessed are located in the City of San Juan Capistrano, Orange County, as more
specifically shown and delineated on the maps provided in the Engineer’s Report.
The Engineer’s Report is attached hereto as Exhibit “A” and is available for
inspection in the Office of the City Clerk, and by this reference made a part hereof.
SECTION 2 – REPORT
The preliminary Engineer’s Report regarding the annual levy for the Districts for
Fiscal Year 2023-2024, is hereby approved and is directed to be filed in the Office of
the City Clerk. The Engineer’s Report may be referred to for a full and detailed
description of the improvements, the boundaries of the Districts, and the proposed
assessments, none of which are proposed to be increased from the previous fiscal
year.
SECTION 3 – DESCRIPTION OF MAINTENANCE
The assessment levied and collected shall be for the special benefit conferred on
assessed properties, for maintenance of certain landscaping improvements,
including landscaping, water, electricity, planting, shrubbery, trees, turf, irrigation
systems, hardscapes, fixtures and appurtenant facilities in public rights-of-way,
parkways, slopes, and dedicated easements within the boundaries of the Districts,
as set forth more fully in the Engineer’s Report, referenced and so incorporated
herein. The City Council is not proposing any new improvements or substantial
changes to existing improvements in any of the District.
SECTION 4 – COUNTY AUDITOR
The County Auditor shall enter on the County Assessment Roll the amount of the
assessments and shall collect said assessments at the time and in the same
manner as County taxes are collected. After collection by the County, the net
amount of the assessments after the deduction of any compensation due to the
County for collection, shall be paid to the Treasurer for purposes of paying for the
costs and expenses of said District.
SECTION 5 – SPECIAL FUND
All monies collected shall be deposited in a special fund established for each
District. Payment shall be made out of each District’s respective special fund only
for the purposes provided for in this Resolution. In order to expedite financing any
authorized maintenance for any of the Districts, the City Council may transfer into
the respective special fund other monies, as it may deem necessary. Any funds so
transferred shall be repaid by the respective District from proceeds of the
assessments provided for in this Resolution.
SECTION 6 – PUBLIC HEARING
Notice is hereby given that Tuesday, the 6th of June, 2023, at 5:00 p.m., in the City
Council Chambers located at 31421 La Matanza Street, San Juan Capistrano, is the

time and place fixed by this City Council for the hearing of protests or objections in
reference to the annual levy of assessments, to the extent of the maintenance, and
any other matters contained in this resolution by those property owners affected
hereby. Any persons who wish to object to the proceedings for the annual levy
should file a written protest with the City Clerk prior to the time set and scheduled for
said public hearing.
SECTION 7 – NOTICE
The City Clerk is hereby authorized and directed to publish, pursuant to Section
22626(a) of the Act, and Government Code Section 6061, a notice of the Public
Hearing in the Capistrano Valley News, a newspaper of general circulation within
said City, said initial publication to be not less than ten (10) days before the date set
for said Public Hearing. Said notice shall include that information required pursuant
to applicable law.
The City Clerk is further directed to cause a copy of the Resolution of Intention and
said notice to be posted upon the official bulletin board customarily used for the
posting of notices.
SECTION 8 – EFFECTIVE DATE
This Resolution shall take effect immediately upon its adoption.

DEFINITION & GENERAL INFORMATION
Assessment District
An Assessment District is a financing mechanism under The California Streets and Highways Code,
Division 10 and 12, which enables cities, counties, and special districts organized for the purpose of
aiding in the development or improvement to, or within the district, to designate specific areas as
Assessment Districts, with the approval of a majority of the landowners based on financial
obligations, and allows these Districts to collect funds to finance maintenance efforts or construct
improvements. Assessment Districts help each property owner pay a fair share of the costs of such
improvements or maintenance obligations over a period of years at reasonable rates and ensures
that the cost will be spread to all properties that receive direct and special benefit by the
improvements constructed or maintained.
“Assessment” means any levy or charge by an agency upon real property that is based upon the
special benefit conferred upon the real property by a public improvement or service that is imposed
to pay the capital cost of the public improvement, the maintenance and operation expenses of the
public improvement, or the cost of the service being provided. “Assessment” includes, but is not
limited to, “Special Assessment,” “Benefit Assessment,” and “Maintenance Assessment.”
Current Annual Administration
As required by the Landscaping and Lighting Act of 1972, this Engineer’s Report describes the
improvements to be operated, maintained, and serviced by the District, provides an estimated
budget for the District, describes the properties and zones of benefit within the District, describes
the method used to allocate the costs to the benefiting properties within the District, and lists the
proposed assessments to be levied upon each assessable lot or parcel within the District.
Payment of the assessment is placed on each property owner’s secured property tax roll bill. All
funds collected through the assessment must be placed in a special fund and can only be used for
the purposes stated in this report.

accordance with the Resolution of Initiation adopted by the Council of the City of San Juan

Herein after referred to as the "Assessment Districts" or “Districts”, I, Jerome Parco, P.E., the duly
appointed ENGINEER OF WORK, submit herewith the "Report" consisting of six (6) parts as
follows:
PART A: DESCRIPTION OF IMPROVEMENTS
Part A describes the improvements in the District. Plans and specifications for the improvements
showing and describing the general nature, location and extent of the improvements are on file in
the Office of the City Clerk of the City of San Juan Capistrano, and are incorporated herein by
reference.
PART B: ESTIMATE OF COST
Part B contains an estimate of the cost of the proposed improvements for Fiscal Year 2023-2024,
including incidental costs and expenses in connection therewith.
PART C: ASSESSMENT DISTRICT DIAGRAM
The Diagram of the Assessment Districts’ Boundaries showing the exterior boundaries of the
Assessment Districts, the boundaries of any zones within the Assessment Districts and the lines
and dimensions of each lot or parcel of land within the Assessment Districts.
The lines and dimensions of each lot or parcel within the Assessment Districts are those lines and
dimensions shown on the maps of the Assessor of the County of Orange for the year when this
Report was prepared. The Assessor's maps and records are incorporated by reference herein and
made part of this Report.
PART D: METHOD OF APPORTIONMENT OF ASSESSMENTS
The method of apportionment of assessments, indicating the proposed assessment of the total
amount of the costs and expenses of the improvements upon the several lots and parcels of land
within the Assessment Districts, in proportion to the estimated benefits to be received by such lots
and parcels.

Maintenance Districts described herein. The facilities include, but are not limited to the following:
landscaping, water, electricity, planting, shrubbery, trees, turf, irrigation systems, hardscapes,
fixtures and appurtenant facilities in public rights-of-way, parkways, slopes, and dedicated
easements within the boundaries of said Landscape Maintenance Districts.
The facilities are specifically described as follows:
Mission Woods Open Space Maintenance District (Tract 7673)
0.828 acres of maintenance including:
Ortega Highway right-of-way, exclusive of the street section to the southerly curb, along the
northerly boundary of Tract 7673; and the area northerly of the curved walls at the intersection of
Ortega Highway and Via Cuartel, being a portion of Lot I and Lot 79.
Lot C
The westerly two feet, lying northerly of Lot B, being a portion of Lots 71 and 72.
The slope area along the westerly boundary, lying southerly of Lot B and westerly of the block wall,
being a portion of Lots 44 through 52, inclusive.
The slope area along the northerly right-of-way of Calle Arroyo, exclusive of street intersections,
lying southerly of the block wall, being a portion of Lots 32, 43, 44, and 61.
Mission Springs Open Space Maintenance District (Tract 8485)
0.802 acres of maintenance including:
The Ortega Highway right-of-way, exclusive of the street section to the southerly curb, along the
northerly boundary of Tract 8485; and the area lying northerly of the curved walls at the intersection
of Ortega Highway and Via Errecarte, including the area extending from the intersection of Via

Anzar and Via Errecarte to block wall entrance, being a portion of Lot 1 and Lot 74.
The slope area along the northerly right-of-way of Calle Arroyo, including the portion of said right-of-
way lying northerly of 5 foot wide sidewalk, including the northeast side of Via Estenaga extending
from the intersection of Via Estenaga and Calle Arroyo to the intersection of Via Estenaga and Via
Ordaz, being a portion of Lots 12 through 24, inclusive, and a portion of Lot 54.

angle point in the centerline of Paseo Peregrino, being a portion of Lot 16

Approximately 33,000 square feet of maintenance including:

Total: Approximately 59,000 sq. ft.
The Ortega Highway right-of-way, exclusive of the street section to the northerly curb, along the
southerly boundary of Tract 9382; the slope area along the northerly right-of-way of Ortega
Highway, lying southerly of the block wall, being a portion of Lots 1 through 8, inclusive, of Tract
9382.
The slope area along the easterly right-of-way of Belford Drive, including the portion of the right-of-
way easterly of the 5 foot wide sidewalk, bounded on the south by Ortega Highway and bounded on
the north by Rosedale Drive, being a portion of Lot 1 of Tract 9382.
The southerly 10 feet of the 56 foot right-of-way of Rosedale Drive, bounded on the west by Belford
Drive, and bounded on the east by a line parallel with and distant 65 feet from the centerline of
Belford Drive.
The remanufactured slopes lying within Lots 62, 63, and 64 of Tract 9382, excepting there from the
portion of the remanufactured slope within Lot 62 lying southwesterly of the southwesterly line of the
150 foot wide easement to San Diego Gas & Electric Company, as shown on the map of Tract
9382.

Maintenance means the furnishing of services and materials for the ordinary and usual
maintenance, operation and servicing of the landscaping and appurtenant facilities, including repair,
removal or replacement of all or part of any of the landscaping or appurtenant facilities; providing for
the life, growth, health and beauty of the landscaping, including cultivation, irrigation, trimming,
spraying, fertilizing and treating for disease or injury; the removal of trimmings, rubbish, debris and
other solid waste; and the cleaning, sandblasting and painting of walls and other improvements to
remove or cover graffiti.
Servicing means the furnishing of water for the irrigation of the landscaping and the maintenance of
any of the public lighting facilities or appurtenant facilities and the furnishing of electric current or
energy, gas or other illuminating agent for the public lighting facilities, or for the lighting or operation
of landscaping or appurtenant facilities.
The plans and specifications for the improvements, showing and describing the general nature,
location and the extent of the improvements, are on file in the office of the Director of Public Works
and are incorporated herein by reference.

PART B
ESTIMATE OF COST
The 1972 Act provides that the total cost of installation, construction, operation, maintenance and
servicing of the improvements described in Part A can be recovered by the Districts. Maintenance
can include the repair and replacement of existing facilities. Servicing can include electrical and
associated costs from a public utility. Incidental expenses, including administration of the Districts,
engineering fees, legal fees, printing, posting and mailing of notices, and all other costs associated
with the annual assessment process can also be included.
The estimated costs of the operation, servicing and maintenance of the improvements for Fiscal
Year 2023-2024, as described in Part A, are summarized herein and described in the Proposed
Budgets on the subsequent pages.
The 1972 Act requires that a special fund be set up for the revenues and expenditures of the
Districts. Funds raised by assessment shall be used only for the purpose as stated herein. A
contribution to the District by the City may be made to reduce assessments, as the City Council
deems appropriate. Any balance or deficit remaining on July 1 must be carried over to the next
fiscal year.

METHOD OF APPORTIONMENT OF ASSESSMENT
GENERAL
Part 2 of Division 15 of the Streets and Highways Code, the Landscaping and Lighting Act of 1972,
permits the establishment of assessment districts by public agencies for the purpose of providing
certain public improvements which include operation, maintenance and servicing of street lights,
traffic signals, and landscaping.
Section 22573 of the Landscape and Lighting Act of 1972 requires that maintenance assessments
be levied according to benefit rather than according to assessed value. This Section States:
"The net amount to be assessed upon lands within an assessment district may be
apportioned by any formula or method which fairly distributes the net amount among
all assessable lots or parcels in proportion to the estimated benefit to be received by
each such lot or parcel from the improvements.”
In addition, Article XIIID, Section 4(a) of the California Constitution limits the amount of any
assessment to the proportional special benefit conferred on the property.
The Act permits the designation of benefit zones within any individual assessment district if "by
reasons or variations in the nature, location, and extent of the improvements, the various areas will
receive different degrees of benefit from the improvement" (Sec. 22574). Thus, the 1972 Act
requires the levy of a true "benefit assessment" rather than a "special tax." Excepted from the
assessment would be the areas of all publicly owned property in use in the performance of a public
function. Utility rights-of-way are also exempt from assessment.
ASSESSMENT METHODOLOGY
The total operation, maintenance and servicing costs for the landscape maintenance district
improvements are apportioned in accordance with the benefit spread methodology described below.
General Versus Special Benefit
The City may only assess property owners for that portion of the improvements which provide a
special and direct benefit to the properties located within the boundaries of the District. General
benefits are not assessable, and the City must fund that portion of the improvements which
provides a general benefit to the public at large with some other funding source such as the general
fund. The 1972 Act does not specify a formula or method to use when determining the amount of
general versus special benefit. The Engineer of Work is responsible for conducting the general
versus special benefit analysis and then making a recommendation to the City Council, which
makes the final determination.

Orange Assessor's Office, are contained in the Assessment Rolls as shown in this section. The
description of each lot or parcel is part of the records of the Assessor of the County of Orange and
these records are, by reference, made part of this Report.
The included tracts of land have been subdivided into Single-Family Residential (SFR) lots, with
each of these lots benefiting equally from the improvements being maintained. Therefore, the costs
associated with the landscaping within and directly adjacent to each tract, as shown in Part B of this
report will be apportioned equally to the residential lots within each tract. The table below
summarizes the assessment apportionment by District.

FINANCIAL SUMMARY
OPERATING EXPENDITURES
The following information describes the types of costs associated with maintaining the Districts.
CPI-U – Annual Increase According to Need
Staff recommends that assessments are increased annually per the Consumer Price Index – All
Urban Consumers for the Los Angeles, Riverside and Orange County Areas (CPI-U) on an as
needed basis. Should the District reach a reserve level of 50% of operating revenues, the
assessment will not be increased per the CPI-U for the year. Each year, the City will evaluate the
reserves and the expenditures, and inform the residents whether or not an increase per the CPI-U
will be necessary for the upcoming year.
Contract and City Forces
Most of the work performed at the District is contracted out and includes landscape maintenance,
herbicide and pesticide, and tree trimming. The “City Forces” line item in the proposed budget
includes the City field staff time that it takes to monitor the work that is being performed per the
contracts. As an estimate, this cost includes one hour per week for a Maintenance Worker II
position and one-half hour per week for a Public Works Supervisor. Actual staffing costs and
expenditures are charged to each District. The City currently charges for administrative and
management staff time associated with administering the landscape maintenance districts.
Irrigation Repairs/Extras
The line item in the proposed budget and the financial study for “Irrigation Repairs/Extras” includes
any repairs that are not typically scheduled throughout the year such as irrigation repairs, broken
tree limbs, vandalism, etc. An estimate has been included to cover such expenditures, and if the
amount actually spent each year is less than the estimate, the remaining balance returns to the
District’s reserve fund. Should the amount exceed the estimate, then the funds needed would be
taken from the reserve fund.
Maintenance Upgrades/Projects
The line item in the proposed budget and financial study for “Maintenance Upgrades/Projects”
includes any new projects such as painting, plantings, fencing repairs, etc. that can be scheduled
for the upcoming year. Often, City staff receives input from residents on any projects that a District
may like to see completed. The proposed budget includes an estimate for these projects, and if the
amount actually spent each year is less than the estimate, the remaining balance returns to the
District’s reserve fund. Should the amount exceed the estimate, then the funds needed would be
taken from the reserve fund.
Reserve Fund
Any remaining funds not used from the previous year are added to the District’s reserve fund. The
reserve fund should have sufficient funds available to lessen the fiscal impact of any unforeseen
expenditures. At City Council direction, each District needs to maintain a healthy reserve balance
at 50% of the total annual assessments.
