Your Project Manager, Ms. Debbie Frank, brings more than twenty years of water and wastewater experience to our project team. Because of her extensive regulatory and technical knowledge, including knowledge of Title 22, Reuse and NPDES regulatory/permits thresholds, Ms. Frank is able to provide advanced notice of results critical to treatment plant operations Our consciousness of your diverse and specific reporting limit requirements affords us the opportunity to advise you in advance concerning potential out of compliance situations. This advance warning provides time for recollection, analysis and verification of correct results prior to submission to regulatory agencies. A similar approach is taken concerning data that does not match historical trends. Eurofins' LIMS archives all historical data into a reference table and submits alert reports to the Project Manager to advise whenever a result is outside of the median range so that we can pass along these advanced alerts to you for feedback and proper follow up actions. Pre-labeled containers are included with ice packs, packaging material, customized custody form and kit inventory for every entry point, plant effluent and set of source and/or distribution system sample sites. Foam inserts Al and color coded caps are used for UCMR3 kits to provide a user-friendly mechanism to complete these complex sampling requirements. Our login staff also plays a special role in discerning the important distinction of your samples. All City samples are received the day of collection and immediate inspected to verify acceptability for compliance analysis. If problems are identified with samples upon our receipt, we notify you to inform concerning the need for recollection to meet compliance requirements. Verbal and electronic documentation of compliance concerns as well as electronic acknowledgment of acceptable sample receipt are submitted to you for your tracking and project management purposes. Our LIMS is customized to capture data specific to UCMR3 requirements. Information entered into the LIMS to document sample condition, analysis results, FB results (relative to the MRL), LRB-LFB-MRL checks acceptance,MS/MSD frequency and holding times is used to prompt us to contact you immediately whenever any of these UCMR3 criteria are not met. preservation chedc exceedance on containers for the method specified in this notice, rew nple required within 30 days. RECOMMENDATION: By motion, approve a Personal Services Agreement for a one (1) year term with three (3) one (1) year optional extensions for water sample collection and laboratory testing services with Eurofins Eaton Analytical, Inc. in an amount not to exceed the adopted budget. EXECUTIVE SUMMARY: The United States Environmental Protection Agency and the State of California Department of Public Health (DPH) regulate and monitor the safe treatment, delivery and quality of the water that the City supplies to its consumers and requires that the City ensures that water delivered is safe and acceptably meets regulatory standards at all times. To ensure the City's water is safe and acceptable at all times, over 4,000 water samples are collected each year from the City's water system and tested by a Federal and State Accredited Water Quality Laboratory, certified in the drinking water field. Based on previous errors made by the City's existing laboratory services provider, the City solicited proposals for a new laboratory service provider. Staff recommends that the City Council approve a Personal Services Agreement for a one (1) year term with three (3) one (1) year optional extensions for water sample collection and laboratory testing services with Eurofins Eaton Analytical, Inc. in an amount not to exceed the adopted budget (Attachment 1). DISCUSSION/ANALYSIS: On May 3, 2013, the City released a Request for Proposal (RFP) to six (6) accredited laboratories for the collection and testing of water samples from the City's water system. City Council Agenda Report August 6, 2013 Page 2 of 3 the Certificates of Accreditation, the laboratory's familiarity and ability to deliver high quality data electronically to the City's Laboratory Information Management System (LIMS), their history in the industry, and a line item evaluation of the pricing provided within each proposal. The following is the breakdown of the estimated laboratory analysis and water sample collection costs received from the four (4) firms using the water sample collection schedule for Fiscal Year 2013-2014: Lab Testinq Collection Total Sierra Analytical Laboratories $144,225 $11,020 $155,245 Babcock & Sons $104,477 $60,000 $164,477 Eurofins Eaton Analytical, Inc $109,207 $65,300 $174,507 Truesdail Laboratories $137,405 $67,200 $204,605 Based on the review of the proposals, Sierra Analytical Laboratories outsources greater than 2% of their laboratory services and therefore did not meet the requirements of the RFP. Babcock & Sons does not have an office within 30 minutes of the City and therefore there is concern over their ability to provide the testing of the water samples within the required time constraints and their ability to respond quickly to the City's needs for additional, non-scheduled, and time-sensitive, testing. Only Eurofins Eaton Analytical, Inc. and Truesdail Laboratories meet the requirements of the RFP, have offices within 30 minutes of the City, and have the necessary qualifications, certifications, and supporting references to provide this valuable service to the City. Staff recommends selecting Eurofins Eaton Analytical, Inc. over Truesdail based on the lower cost proposal. FISCAL IMPACT: For Fiscal Year 2013-2014, the Utilities Department has budgeted $200,000 for water sample collection and laboratory testing services. The laboratory analysis and water sample collection costs for Fiscal Year 2013-2014 are estimated to be $174,507. No additional appropriations are required at this time. For the upcoming budget cycles, staff will seek to have the City Council appropriate a like amount for each of the optional extensions. ENVIRONMENTAL IMPACT: Not applicable. PRIOR CITY COUNCIL REVIEW: Not applicable. COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS: • This item will be reviewed by the Utilities Commission at its August 6, 2013, regular meeting. Staff will prepare a Supplemental Agenda Report to update the City Council on the action taken. City Council Agenda Report August 6, 2013 Page 3 of 3 NOTIFICATION: Babcock & Sons, Inc. The Eurofins' general Quality Assurance Program (QAP) is modeled after the , ,. EPA Lab Certification Manual for Drinking Water Laboratories and the TNI °°"L'' AQUALM 2009 Lab Standards to meet our NELAP accreditation requirements. Our program follows a logical work sequence and employs a number of criteria to _. reflect our commitment to generating accurate, legally and scientifically defensible compliance data. The QAP is on its 30 revision, is reviewed at w- least annually, and includes the following elements: • Formalized, validated analytical and operational standard operating procedures. m Annual demonstrations of capability and method detection limits for all compliance tests. ® Ongoing checks to ensure the use of current and acceptance standards. ® Use of minimum reporting levels that are at or above the lowest calibration standard and also above the method detection limit to help foster a high degree of data accuracy. Strict adherence to chain of custody procedures and sample documentation. Calibration levels that are established at or below federal triggers for increased monitoring. Multiple data reviews at the peer, supervisor, independent QA validator and project management levels. ® Use of sophisticated queries for data storage, retrieval, interpretation, control charting and early warning of preliminary results inconsistent with sample history or exceeding regulatory thresholds. • Data mining and query by location, date or constituent for clients from our LIMS. • Pre-qualified subcontract laboratories for subcontracted analyses + contingency for tests performed in-house. Additionally Eurofins maintains a UCMR3-specific Quality Assurance Program Plan (QAPP) that has been subjected to EPA review. This QAPP incorporates the aforementioned QAP plus additional specific unique UCMR3 QA/QC protocols, such as those referenced earlier. Eurofins also maintains an Ethics and Data Integrity Program that includes all elements outlined in the TNI lab standards.
