Background
•In October 2016,the City-owned parcels were included in an Exclusive
Negotiation Agreement with SJCM LLC for potential future development of
a retail/office project
•In January 2020,the City entered into a Ground Lease with Option to
Purchase with SJC Mission Ventures for installation of site improvements
associated with the adjacent Heritage BBQ/Capo Brew business
•On October 4,2022,the City Council adopted a Resolution of Intention for
Sale of City-Owned Property

Sale Terms-Upper Portion-Camino Capistrano Frontage
•Land Area :0.13 acres
•Supports landscaping improvements and outdoor dining amenities associated
with Heritage BBQ/Capo Brew
•Purchase price established in Ground Lease at 2020 Fair Market Value:
$22,000
•2022 CPI adjusted sales price:$23,750
•Planning Commission found the sale consistent with the General Plan
•Multi-modal parking lot not affected by sale
Recommendation
Approve and authorize the City Manager to execute a Purchase
and Sale Agreement for sale of 0.13-acres of City-owned
property located at 31681 Camino Capistrano to SJC Mission
Ventures,LLC;and find that said action is categorically exempt
from the California Environmental Quality Act (CEQA)under
CEQA Guidelines Sections 15301 and 15312.
