13-0423_MBF CONSULTING, INC_Personal Services AgreementPERSONAL SERVICES AGREEMENT rd THIS AGREEMENT is made, entered into, and shall become effective this L day of April, 2013, by and between the City of San Juan Capistrano (hereinafter referred to as the "City") and MBF Consulting, Inc, (hereinafter referred to as the "Consultant"). RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to prepare plans and specifications for the San Juan Creek Road Recycled Water Pipeline Project; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by the Consultant shall consist of those tasks as set forth in Exhibit A, attached and incorporated herin by reference. To the extent that there are any conflicts between the provisions described in Exhibit "A" and those provisions contained within this Agreement, the provisions in this Agreement shall control. Section 2. Term. This Agreement shall commence on the effective date and shall terminate, and all services required hereunder shall be completed, no later than 8 months after the notice to proceed. Section 3. Compensation. 3.1 Amount. Total compensation for the services shall not exceed $54,693, as set forth in Exhibit B, attached and incorporated herein by reference. 3.2 Method of Payment. Subject to Section 3.1, Consultant shall submit monthly invoices based on total services which have been satisfactorily completed for such monthly period. The City will pay monthly progress payments based on approved invoices in accordance with this Section. 3.3 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to the City. Invoices shall be addressed as provided for in Section 16 below. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of the City, and shall obtain no rights to any benefits which accrue to Agency's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for the City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to the City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. Section 6. Changes to Scope of Work. For extra work not part of this Agreement, a written authorization from City is required prior to Consultant undertaking any extra work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and/or Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) if applicable, it has investigated the work site(s), and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work to be performed under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform the City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. E Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the work, Consultant shall have delivered to City at least one (1) copy of any final reports and/or notes or drawings containing Consultant's findings, conclusions, and recommendations with any supporting documentation. All reports submitted to the City shall be in reproducible format, or in the format otherwise approved by the City in writing. Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. To the fullest extent permitted by law, Consultant agrees to protect, defend, and hold harmless the City and its elective and appointive boards, officers, agents, and employees from any and all claims, liabilities, expenses, or damages of any nature, including attorneys' fees, for injury or death of any person, or damages of any nature, including interference with use of property, arising out of, or in any way connected with the negligence, recklessness and/or intentional wrongful conduct of Consultant, Consultant's agents, officers, employees, subcontractors, or independent contractors hired by Consultant in the performance of the Agreement. The only exception to Consultant's responsibility to protect, defend, and hold harmless the City, is due to the negligence, recklessness and/or wrongful conduct of the City, or any of its elective or appointive 3 boards, officers, agents, or employees. This hold harmless agreement shall apply to all liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Consultant. Section 14. Insurance. On or before beginning any of the services or work called for by any term of this Agreement, Consultant, at its own cost and expense, shall carry, maintain for the duration of the agreement, and provide proof thereof that is acceptable to the City, the insurance specified below with insurers and under forms of insurance satisfactory in all respects to the City. Consultant shall not allow any subcontractor to commence work on any subcontract until all insurance required of the Consultant has also been obtained for the subcontractor. Insurance required herein shall be provided by Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or better. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in an amount not less than one million dollars per occurrence ($1,000,000.00), combined single limit coverage for risks associated with the work contemplated by this agreement. If a Commercial General Liability Insurance form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this agreement or the general aggregate limit shall be at least twice the required occurrence limit. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non - owned vehicles in an amount not less than one million dollars per occurrence ($1,000,000.00). 14.3 Workers' Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Workers' Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit 4 the insurance certificates, including the deductible or self -retention amount, and an additional insured endorsement naming City, its officers, employees, agents, and volunteers as additional insured as respects each of the following: Liability arising out of activities performed by or on behalf of Consultant, including the insured's general supervision of Consultant; products and completed operations of Consultant; premises owned, occupied or used by Consultant; or automobiles owned, leased, hired, or borrowed by Consultant. The coverage shall contain no special limitations on the scope of protection afforded City, its officers, employees, agents, or volunteers. 14.5 Errors and Omissions Coverage Throughout the term of this Agreement, Consultant shall maintain Errors and Omissions Coverage (professional liability coverage) in an amount of not less than One Million Dollars ($1,000,000). Prior to beginning any work under this Agreement, Consultant shall submit an insurance certificate to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.6 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.7 Terms of Compensation. Consultant shall not receive any compensation until all insurance provisions have been satisfied. 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written "Notice to Proceed" verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to Consultant. In addition, this Agreement may be terminated by any party for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. 5 Section 16. Notice. All notices shall be personally delivered or mailed to the below listed addresses, or to such other addresses as may be designated by written notice. Attorneys' Fees. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs and necessary disbursements in addition to any other relief to which he may be entitled. Section 18. Dispute Resolution. In the event of a dispute arising between the parties regarding performance or interpretation of this Agreement, the dispute shall be resolved by binding arbitration under the auspices of the Judicial Arbitration and Mediation Service ("JAMS"). Section 19. Entire Agreement. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. ING, APPROACH AND SCOPE OF WORK PROJECT UNDERSTANDING We understand that the City of San Juan Capistrano (City) is seeking a professional consultant to design the San Juan Creek Recycled Water Pipeline. We have reviewed the Request for Proposal (RFP) and its attached exhibits and understand that the City desires to extend its recently built 8 -inch recycled water pipeline on San Juan Creek Road with a new 12 -inch PVC C900 purple pipeline to connect to the Santa Margarita Water District (SMWD) recycled water line at the corner of Ortega Highway and Antonio Parkway. The proposed 3,300 feet of 12 -inch PVC recycled water pipeline will begin at the north easterly end of San Juan Creek Road at the termination point of the existing recycled water line. The existing temporary blow off will be removed, a connection made, and the pipeline will follow through the Rancho Mission Viejo Riding Park (Riding Park) to connect to the SMWD recycled water main at the corner of Ortega Highway and Antonio Parkway. Project components include piping, valves, above ground Pressure Reducing Valve Station (PRV, to be designed per the City's standard for above ground PRV's) and flow meter (designed to SMWD standards for above ground meters at the connection point with SMWD). Our professional services will include but not be limited to field investigation and evaluation of existing conditions at the Riding Park; preparation of a preliminary design report (PDR) addressing our recommendations and providing our findings; preparation of 50% plans and specifications; preparation of final plans and specifications, bid documents, and construction estimate; bid phase services; construction support services; and preparation of record drawings. Specific Considerations Based on our knowledge of recycled water pipeline design, construction principals, our previous similar projects, and operational requirements, we have developed a summary of considerations that will need to be addressed specifically for this project. The following information serves to address these critical issues and provides a basis for MBF's approach to designing the improvements for the City's San Juan Creek Recycled Water Pipeline Project. Noise Impact. The Riding Park is a horse park with riding enclosures, open fields, parking, and other horse riding facilities. We understand and have experience with the types of issues associated with construction occurring in the vicinity of horse riding facilities. Live animals such as horses are particularly sensitive to excessive and unfamiliar noise and movements. This can create adverse effects on animals and should be avoided. Our experience includes the design and construction of a fire line and fire department connection for an Equestrian Center in the City of Laguna Woods. We will provide requirements in the technical specifications to reduce any construction impact including requiring noise mufflers for equipment or temporary screens during construction. • Schedule. We understand that due to funding requirements, the design and construction of this project require a very strict schedule. MBF understands the importance of meeting project milestones. We propose an aggressive non-linear schedule that enables different design team members to work simultaneously on different aspects of project. We also propose strong communication with City and other involved agencies to reduce review and modification times. We have identified the following tasks to keep the project on schedule: ' Page 1 R= San Juan Creek Recycled Water Pipeline Project ➢ We will maintain positive and constant communication with City staff as well as SMWD and Blenheim Facility staff to resolve any issues and questions during the design. This will significantly reduce review and correction times and will keep the design team up to date with City requirements and desires. ➢ At the same time that the surveyor is completing their task, we will begin developing preliminary plans based on existing property and street improvement plans. We will then transfer the approved preliminary design to survey base maps and continue to finalize the construction drawings. This will save a minimum of two weeks during the design phase. We will also separate the pipeline design from facility (PRV and Metedng Station) design and will assign adequate resources to each task. We are committed to completing this project by June 24, 2013. ➢ The assigned project manager (PM) will be the sole point of contact for the City. He will ensure proper coordination and communication between design team members. During the construction phase, we will assign the same PM who will be familiar with all aspects of project, is a hands-on California Registered Civil Engineer, and who will assist the City with bidding and construction engineering tasks. This will reduce the shop drawing and RFI review times and will assist in expediting construction of the pipeline. SCADA System. PRV and Metering Stations are typically connected to an agency's SCADA system for the purpose of recording and control of operation. We understand that the design of electrical services and SCADA integration is not included in the RFP; however, as an optional service and at the City's request, we can provide these services. Based on our preliminary review of available data, we anticipate that a minimum of a 40 -amp service will be needed. Even if electrical design services are not requested at this time, we will make sure to include provisions in the design to make it capable for future integration into the City's SCADA system. These provisions will include specifying Pressure Reducing Valves with position indicators capable of connecting to SCADA, specifying flow meters with remote reading capabilities. providing adequate and secure space for possible future electrical service, etc. Environmental Coordination. We understand that City will retain the services of a separate consultant to prepare environmental documents for this project. We also understand that environmental studies can become time consuming and potentially impact design and construction schedules. We will start coordination with City's environmental consultant immediately and will provide them with preliminary information to accomplish their task. We will also stay in constant contact with them and implement their recommendations into the design at early stages. This will assure that while the design drawings comply with environmental requirements, they will not be delayed by final approval of environmental documents. Safety. MBF considers safety the most important issue on any construction project. We will consider construction safety concerns during the design to assure that developed plans can be safely constructed and ensure a safe parkway environment at all times. The pipeline is being partly constructed in a public area (the Riding Park). We will consider locating the pipeline in a manner to create safe passage during construction. Public Impact. Construction of new pipelines can significantly impact public convenience and safety. It is incumbent upon the design team to work with the City to minimize public impacts in terns of the proposed improvements, the schedule, phasing and anticipated noise levels. Due to proximity of construction to a horse riding park, it is important to include provisions in the general specifications to minimize adverse effect of construction activities and noise. Additionally we will consider locating the pipeline as such that minimizes public inconvenience. San Juan Creek Recycled Water Pipeline Project Industry Standards. MBF has a broad knowledgeof industry standards and federal and local government requirements and will implement these requirements and recommendations, as well as the City and SMWD's Standard Plans, Procedures, and Approved Vendors into the design of water systems. These agencies include, but are not limited to, the Environmental Protection Agency (EPA), California Department of Public Health (CDPH, formerly known as DHS), American Water Work Association (AW WA), and California Water Environment Association (CWEA). Design criterions such as separation requirements between new water lines and sewer pipes and other pipelines will be considered and plans will be developed accordingly. We will coordinate design considerations with the City to assure compliance with City requirements. Utility Coordination. MBF will conduct a thorough utility investigation and will coordinate the work with affected utility agencies based on provided information to avoid any major conflicts during the design. Any upfront information gathering will result in ease of construction and avoid impacting the schedule or budget with unnecessary change orders or stand-by time. We will also coordinate the work closely with Blenheim Facility personnel and will consider impacts to their existing utilities and irrigation system during the design phase. it appears that the proposed pipeline will transverse through an existing SCE easement. We will coordinate this work with SCE early on and will obtain their approval during the preliminary design phase to avoid any delays during construction. Pipe Installation. The MBF design team has previous experience in installing different pipelines in several locations in Southern California. We understand the importance of installing pipes in conformance with manufacturer requirements and limiting joint deflections on PVC pipes. We will ascertain that the design will follow the City's general requirements and approved list of materials and vendors. PRV/Flow Monitoring Stations We have designed numerous physical system gaps, PRV and Flow Monitoring stations for different agencies. We will ascertain that design will follow the City's general requirements and approved list of materials and vendors. These stations are proposed to be designed above ground. Therefore our design will consider provisions to make these stations vandal proof and secure. Typical Cla-Valve PRV and magnetic flow meters (such as Spalding Meter) will be specified, Potholing. We will prepare preliminary plans which will include all utility information for City review and comments. When the preliminary alignment is approved, we will identify potential conflicts with existing utilities. We will perform potholing as necessary to determine the extent of conflict. Based on the pothole findings, we will then modify plans and/or coordinate with the utility agency to avoid any future conflicts during construction. The goal is to prevent future adjustments and unnecessary delays to the contractor which can be much more costly than preventing them during the design phase. A total number of 20 potholes are assumed for cost purposes. Existing Improvements. After a site review we will give recommendations for the final design to ft seamlessly with existing and future -planned improvements in an effort to reduce or eliminate the potential removal and replacement of previously constructed capital improvements. Existing improvements, such as catch basins, drain inlets, street light poles, will be protected -in-place. Stakeholder Coordination. MBF will conduct periodic meetings as necessary with all stakeholders in early stages of design to make sure all their needs are met in the design package. Early coordination will prevent delays in review of plans and implementing their design recommendations. San Juan Creek Recycled Water Pipeline Project APPROACH For the successful completion of your project, we have outlined our methods and approach. They offer an overview of how MBF will provide a high quality project, on a fast-track schedule and under budget. Our primary approach is to serve as a direct extension (i.e. surrogate staff) of the City staff. Our approach is based on strong commitment to total quality assurance and follows a proven path of work elements and tasks to ensure a successful project. Working together with the City's Project Manager, MBF's Project Manager will lead the project team. At the onset of this project, the Project Manager Eanycouawratlon man Dewemmaa N,,,W oocamanwvon will meet with team members to review the requirements, prepare a Work Breakdown Structure (WBS), and make team assignments for maximum efficiency of resources. The detailed Quality aefiverables Produced On Budget i WBS will communicate the scope of work, constraints, and technical requirements to all project participants. The WBS shall identify the procedures and technical requirements that are to be followed in developing the design documents and deliverables. The WBS also describes the responsibilities of each participant in the project. A Master Project Schedule will be prepared following the WBS showing the relationship between tasks and the expected start date and duration for each item. This schedule will serve as the guide to conducting and monitoring the progress of the work, and to ensure projects are completed on time and within budget. To ensure accurate monitoring and tracking of documents, revisions and progress, a document tracking and control system will be developed. To facilitate the review and approval process, we will work closely with the key individuals at the City who are responsible for the review of specific elements of the project and will submit draft copies of significant work items before the milestone submittal dates. This will give us a clear understanding of what the reviewers expect, and they will have a preview of what will be submitted before the actual submittal is made. Our past experience working on projects with cities has taught us the importance of maintaining accurate and detailed meeting minutes, decision logs, and action item lists during the project development process. Quality Management Quality Assurance and Quality Control (QA/QC) is a top priority for MBF. To ensure the highest quality of design, we will implement a comprehensive QA/QC program. As part of the MBF team, Thom Coughran, P.E. will monitor the QA/QC program. He has extensive experience in providing and overseeing the implementation of several QA/QC programs. 771117.7INC. The QA/QC program will be developed specifically for this project. It will be documented and issued to each project team member. The QA/QC program will emphasize the need to clearly define requirements and design standards for the design efforts, and the need to independently check all work before it is issued to the City or other reviewing agencies. The qualitycontrol program will ensure that the project documents: ✓ Conform with the contract documents; ✓ Are neat, well organized, clear, concise, and complete; ✓ Are technically and grammatically correct; ✓ Comply with generally accepted standards of engineering and applicable laws; ✓ Are signed, dated, and stamped as required; and ✓ Are consistent with other related plans and are constructible. The QA/QC Manager will review the engineering evaluations, repair recommendations, design drawings, estimates, specifications, reports and any other document being delivered to the City for accuracy and completeness. He will personally field walk the project sites before finalizing the plans for 100% submittal, to correct any plan mistakes while in the field. He will ensure constructability, claim avoidance and compliance with the City and other agency requirements. In addition, he will provide daily supervision and guidance to the project team and will maintain continuous involvement with the day-to-day activities of the plan preparation team. Cost Control We are able to continually evaluate a project's program/cost coordination through all project phases to enable informed and timely decision-making by our clients and the entire project team. Cost control techniques include program budget analysis, value engineering, life -cycle cost analysis and quantity -based estimating, We rely on an open -book, inclusive process that demonstrates the costs and benefits of varying design options. This budget confirmation process starts in the earliest stages of the project, when design and engineering alternatives have the greatest potential impact on costs. Our design teams analyze client goals, technical requirements, alternative building concepts, construction costs and long-term operational costs to define the optimum scope within the budget, ensuring long-term flexibility and value. Schedule Control The key to effective schedule control is to measure actual progress and compare it to planned progress on a timely and regular basis and to take necessary corrective action immediately. We propose to supplement each major task as identified in the Master Project Schedule with a supplemental schedule to keep careful track of where each individual component stands. This will improve your project managers reporting, help identify problems that may result from delays, and readily afford the opportunity for modifying the schedule, when deemed necessary. As a result, your projects are completed on schedule. Pat], , �t♦ GONSIILTING�4NG: San Juan Creek Recycled Water Pipeline Project SCOPE OF WORK MBF takes no exception to the Scope of Work outlined in the RFP as well as addendum No.l. Following describes the Scope of Work as identified in the RFP with additional clarifications, if needed, for each task: 1. GENERAL ADMINISTRATION, MEETINGS AND PRESENTATIONS 1.1. Kick-off Meeting: Following the notice to proceed, the MBF team will schedule and attend a Kick -Off Meeting with City staff to initiate the project; establish lines of communication; review and refine, if needed, the project scope of work and schedule; establish design guidelines; discuss project parameters and constraints; and obtain background information. 1.2. Project Schedule: Internally, MBF conducts weekly staff meetings every Monday. In these meetings, project managers review the progress of a project with each team member. This will assure total compliance with the approved project schedule since any shortfall is detected at early stages and additional resources will be assigned to the project. Also Project Managers review the project status with Directors to guarantee that enough resources have been assigned to each project. If needed, additional resources will be assigned in these weekly evaluations. MBF has a track record of delivering projects on or before schedule due to its internal QA/QC program. 1.3. Progress Meetings/Project Review Meetings: At project review meetings, we will review project status including progress and schedule. The initial field walk will be scheduled with City staff to ensure detailed depiction of existing conditions and work requirements on the plans. The limits of the work will be determined during the initial field walk in accordance with City standards and direction. We will coordinate with City staff to establish design criteria, pipeline alignment, material and sizes. MBF will also conduct a field walk to determine potential design and construction conflicts and verify field topography data. We believe that clear and concise plans are arrived at from a total understanding of the existing conditions, properties, and environment of the project. Consequently, having as many field walks as are required to ensure a proper design is strongly encouraged. 1.4. Blenheim Facility and SMWD Coordination Meetings: We will assume two (2) two-hour meetings each with Blenheim Facility and SMWD staff regarding the proposed improvements, project limits, and other project coordination items. City staff will also be involved with these meetings. 2. SITE INVESTIGATION AND EVALUATION 2.1. As -Built Research, Investigation and Review. MBF will obtain background information, as -built drawings, and any existing information pertaining to the project. We anticipate the City will provide for our use on this project the background information as summarized in Table 1. We will ensure incorporation of city staff suggestions, recommendations, directions and other City requirements into the project design drawings. MBF will review City's record drawings and will use the pertinent information in developing plans. Utility Research and Notification. MBF will research available utility records and will identify utilities within the project limits. The information obtained will be summarized on the project base map. Concurrent with preliminary design, utility information requests will be sent to each utility companies requesting verification of location, size, and depth of facilities within the project limits. Tasks will consist of: ✓ Access the Underground Service Alert's website and compile a list of member agencies that own facilities within the project limits. ✓ Notify each utility purveyor, in writing, and request copies of record drawings or atlas maps of existing and proposed facilities within the project boundary. ✓ Utilities shown on the record drawings will be surface verified, and added to the base map, along with the most recent easement lines shown for each facility. ✓ Identify interfaces between existing facilities and future project construction. ✓ Consult with the service planners and others as necessary within each utility company to resolve any conflicts. ✓ Keep City staff informed on all discussions with utility companies via written meeting minutes or records of telephone conversation. ✓ Prepare a Utility Notification Log to track utility company contacts and responses including contact information and dates of all outgoing and incoming correspondence. ✓ With prior approval from City, MBF will provide copies of the approved plans to the utility purveyors to facilitate planning future modifications. ✓ If applicable, send final notice to each affected utility company to complete relocations prior to the anticipated construction start date. Agencies and utilities will include but will not be limited to: • City of San Juan Capistrano Southern California Gas Company • Blenheim Facility Southern California Edison • Santa Margarita Water District San Diego Gas and Electric • Orange County Cable Television • The Telephone Company 2.3. Survey. As a sub -consultant to MBF, Hunsaker Land Surveying Inc. will perform topographic survey and will develop base maps for this project. The general scope of work follows: 2.4.1. The recycled water pipeline runs through predominantly vacant land with ongoing equestrian activity. A large amount of the alignment can be mapped by photogrammetric methods and provide accurate controls, thereby saving time and costs. We will acquire field survey locations at thejoins and at locations along the alignment to supplement the aerial mapping. 2.4.2. In performing all surveys necessary for the design of the project we will establish control based on the following: Page 7 OONuVITING, INC, San Juan Creek Recycled Water Pipeline Project Horizontal - NAD83 California Coordinate System Zone VI, OCS Adjustment with ground values, 2007.00 Epoch OCS GPS Adjustment based on nearby OCS Horizontal Control Points (Several exist in the area and along the alignment). Vertical - NAVD88 Benchmarks based on OCS Adjustment in the area of the project. 2.4.3. We will perform records research through the County of Orange and City of San Juan Capistrano for existing land boundaries and centerline monumentation and compile a record boundary map for the site. 2.4.4. Locations will be made to centerline monumentation and/or boundary corners in the area. This will create ties to constrain any record boundary and utility information as well as create a hard tie to tangible monumentation for construction. Control Points will be established in areas that will survive the construction process and will be durable in nature, suitable for usage when construction begins. If this is not possible due to the ongoing equine activity and line -of -sight issues control will be established outside the limits of construction to ensure that continuity in the control can be maintained throughout the construction process. 2.4.5. We will provide locations as directed by City based on a review of the site. All utility research and markouts should be completed prior to field survey. Where underground markings are provided they also will be acquired for inclusion in the project data base. We will locate above ground appurtenant devices, manholes and hand holes that will be affected by the project. 2.4.6. We will be available on short notice to tie in potholing locations or be on site during the potholing activity to locate items as they are uncovered. We have accounted for twenty locations for potholes as defined in the RFP. 2.4. Pothole. 2.4.1. As part of our contract and through our sub -consultant, we will provide all equipment and personnel needed to vacuum excavate up to twenty (20) potholes (up to 12"X12-), to determine the exact horizontal and vertical location of the existing utilities. Additional potholes will be provided at the unit price. A minimum quantity of 5 potholes must be ordered for this price to be valid. We will secure an inquiry identification number from Underground Service Alert at least 48 hours prior to excavation. Vacuum excavated potholes will be backfilled using native material or SE30+ fill sand. 3. PRELIMINARY DESIGN REPORT AND INVESTIGATION 3.1 MBF will coordinate with City staff to establish design criteria, verify pipeline alignments and sizes. MBF will conduct field walk to determine potential design and construction conflicts and verify field topography data. We will review design criteria, key issues and recommend alignments for the project and obtain the City approval of the proposed alignment. The PDR will include at a minimum: ✓ Conflicts with utilities and structures ✓ Proposed location for PRV Station ✓ Proposed location of Metering Facility Pd�r� A till gotisu,,owc. i - ✓ Preliminary tie-in details ✓ Construction schedule and phasing requirements to meet Prop 50 deadlines, bird nesting season, the City's bid approval and award process, and Blenheim Facility activities. ✓ Identify environmental issues and requirements. ✓ Engineer's estimate of construction cost. 3.2 We will meet with the City to review comments on the draft preliminary design report and preliminary drawings. We will respond to comments, revise the draft as necessary, and submit two hard copies and electronic format copy of the final preliminary design report to the City. The final preliminary design report will be used as the basis for final design of the project. 4. ENVIRONMENTAL TASKS We understand that the City is obtaining the services of an environmental consultant to complete this scope of work. We will work with the City's environmental consultant as required for the project's successful and timely completion. We will also incorporate the results of the initial environmental study into the final alignment and design of the pipeline. 5. FINAL DESIGN AND CONSTRUCTION DOCUMENTS 5.1 Preliminary Design Drawings 5.1.1. Preliminary design drawings shall identify all existing improvements including but not limited to drainage structures, fire hydrants, utility facilities, landscaping, signs, street lights, fences, walls, etc, and other appurtenant improvements in the project areas. 5.1.2. The preliminary design drawing will contain all existing utilities and facilities and will be based on all data provided by the City, utility agencies, and our preliminary field review to verify existing conditions. Utility conflicts and construction constraints will be identified. 5.1.3. Design considerations will be to avoid public and utility impacts, provide adequate and easy future maintenance access, and construction considerations such as traffic control, staging area, and public access during construction. Preliminary pipeline plans will be developed and discussed with the City. 5.1.4. Restrain lengths will be calculated and if necessary, restrained joints and/or thrust blocks will be identified on the plans. 5.1.5. Tie -In connection details as well as plans and section of PRV Station and Flow Metering Station will be developed. 5.1.6. We will also notify utility owners by submitting preliminary construction drawings for review, comment and to coordinate the resolution of identified conflicts. 5.2 Final Engineering Design 5.2.1 MBF will prepare drawing package consisting of plan (1"=40' Scale) and profile (1"=40':H; 1"=8':V Scale) drawings for the construction of recycled water pipeline project. The package of drawings will include a Title Sheet, General Notes, Plan and Profile sheets of the proposed pipeline and construction details such as connection details, mechanical plan and section of PRV/flow monitoring stations, utility crossing details, trench detail, and service or fire hydrant details, as necessary for a complete and constructible package. We will submit the plans (4 sets) to the City p,,0, 9 G�9lTING. INC. San Juan Creek Recycled Water Pipeline Project for their review at 50%, and 90% design stages. Final (100%) design drawings will be complete and bid -ready plan and profile drawings. 5.2.2 City comments from the preliminary submittal will be addressed in the final design drawing submittals. The Final Engineering Design submittals will also include technical specifications and a bid schedule, quantities and cost estimate. These will be provided to the City in electronic (PDF) format for review. We will review with City staff all their comments and will revise plans as necessary to comply with City requests. We will provide required engineering calculations to support design drawings. MBF also specializes in Construction Management of various public works projects. Our Construction Management Department will provide constructability review of the plans. This will ensure the constructability of design drawings with very valuable input from the field crew. 5.2.3 We will incorporate comments from City in the 100% design plans. Final plans shall be stamped and signed by a Registered Civil Engineer. MBF will provide final plans, specifications, and engineer's quantity and cost estimate to City in electronic format (PDF format as well as AutoCAD 2010 -.dwg format) per the City's Digital Submission Standards. 5.2.4 As part of this the final design, we will provide all affected utilities with a hard and electronic copy of the final plans and notices to perform any necessary adjustments. 5.2.5 We will prepare an Engineers Quantity and Cost Estimate that will be submitted as part of each of the 50%, 90% and 100% Submittals, and will include all items of construction work. 5.2.6 We will prepare the technical section of the construction specifications for the project. The specifications will conform to the Standard Specifications for Public Works Construction (Green Book), Standard Plans for Public Works Construction, City of San Juan Capistrano Standards Plans and Caltrans Standards Plans and Specifications, as applicable and necessary for a complete design package. All items of work will be covered under these specifications. MBF will compile these specifications and proposal documents with City of San Juan Capistrano "boiler plate" front- end documents as well as City's Standard Specifications. 5.2.7 MBF will provide a proposed construction schedule based on final plans and specifications. With help of our construction management division, we will develop construction phasing into the proposed schedule to help contractor meeting City's deadline of completion prior to December 31, 2013. 5.2.8 We will provide a full set of final contract documents ready for reproduction in hardcopy and electronic copy formats. 5.2.9 We will prepare a construction schedule for the proposed work based on the final plans and specifications. 6. CONSTRUCTION BIDDING THROUGH CONTRACT AWARD 6.1. We will attend a pre-bid conference at a date, time and place set by the City. 6.2. We will provide construction plan interpretation and consultation during the bidding phase of the project. We will assist the City in preparing bid addenda as required to provide clarification to drawings and response to Request for Information (RFI). We will also provide recommendations regarding contract award. Page 711 7. CONSTRUCTION ENGINEERING SUPPORT 7.1. We will provide an Office Engineer (same Project Manager assigned to the project) to support the City during project bidding and construction and to: 7.1.1. Attend meetings with the City and the contractor regarding interpretation of the contract documents, 7.1.2. Respond in writing to requests for information/clarification (RFI/RFC), 7.1.3. Provide amended drawings to as needed, 7.1.4. Assist in quality assurance, and in achieving conformance with the contract plans and specifications. 7.1.5. Provide office engineering and consultation, as required and coordinate with the City in management of the construction contract. 7.1.6. Prepare supplementary sketches and details as required to resolve field construction problems that may be encountered. 7.1.7. Review and provide advice to the City on change order(s) and/or extra work order(s) as needed. 7.1.8. Consult with the Project Manager's inspector. 7.1.9. Create a punch list with the Project Manager's construction inspection staff at the completion generator installation for each facility. 7.2 Submittal Review 7.2.1 We will review submittals for complete and strict conformance with the contract plans, specifications and documents. We will assure that any deviations or substitutions submitted by the contractor shall be equal to or of better quality than specified in the contract documents for. ✓ Pipe ✓ Valves ✓ Pressure reducing valve ✓ Flow meter ✓ Any other submittals required by the Contract Documents. 7.2.2 We will return submittals to the City Project Manager, and keep (2) copies of all preliminary and final shop drawings that have been reviewed for conformance. At the end of the job We will make available to City the second copy of the reviewed submittals. 7.3 Record Drawings: We will prepare construction "record" drawings based on marked -up documents and drawings received from the City's Project Manager and inspection staff. We will submit one (1) full-size original mylar reproducible set of construction "record" drawings and an electronic copy of the AutoCAD file to the City in accordance with the City's Digital Submission Standards. Relevant projects include: Commercentre Drive Reclaimed Water Upsizing MBF prepared plans, specifications and estimates for the replacement and upsizing of approximately 2,000 lineal feet of an 8 -inch ACP reclaimed water line with 12 -inch PVC pipe in Commercentre Drive in the City of Lake Forest. Design and construction of this project required extensive coordination with the County of Orange and the City of Lake Forest due to the Alton Parkway Extension Project and the City's pavement rehabilitation project that were under way at the same time. A highline was designed and installed to provide temporary irrigation service during construction. Traffic control plan preparation, city encroachments permit acquisition, and construction support services were also provided. IRWD Zone 6/LAWD Zone 3 Potable Water Interconnect Facilities MBF prepared a preliminary design report (PDR) and the final construction plans and specifications for the interconnection facilities connection for the Irvine Ranch Water District's (IRWD) Zone 6 systems to the Los Alisos Water District (LAWD) Zone 3 system. The project consisted of 2,700 lineal feet of 16 -inch pipes, 200 lineal feet of 12 -inch pipes, two pressure reducing stations, and one motor -operated valve to be constructed in the Cities of Lake Forest and Irvine. The pipeline in Rancho Santa Margarita Parkway crossed under the 240 Toll Road within the Caltrans right-of-way. As part of this project, encroachment permits from the City of Lake Forest, City of Irvine, and Caltrans were obtained. 4" and 6" ACP Reclaimed Water Pipeline Replacement MBF prepared construction documents (PS&E) for the replacement of approximately 6,000 lineal feet of 4 and 6 -inch ACP reclaimed water line with PVC pipe in Woodbridge, South West Loop in the City of Irvine. The project was on a fast track that required coordination with the City of Irvine and The Woodbridge Village Association. Over 25 existing and or new service had to be reconnected to the new PVC pipe while minimizing any water service instructions. MBF prepared traffic detour plans per city of Irvine standards to secure the encroachment permit. The goal of this project was to replace existing 4 -inch and the 6 -inch reclaimed water pipelines that had experienced repeated failure in past few years. Lake Forest Pressure Improvement Project MBF prepared a preliminary design report (PDR) and has completed the final construction plans and specifications for construction of five (5) pressure reducing stations, and over 2000 If of an 8 -inch water line in the City of Lake Forest. Locating the pressure reducing stations behind the curb and outside of traffic lanes in developed areas of the city was challenging and required extensive potholing and coordination with utility companies. The project goal was to improve the water system pressure and reliability for areas within the City that were deficient. As part of this project, MBF also obtained encroachment permits from the City of Lake Forest. Pan, 11 _ vrurnrvo, uu-. San Juan Creek Recycled Water Pipeline Project • Water and Recycled Water Pipeline Upsizing In Trabuco Road Bridge Crossing CA 133 MBF designed and prepared construction plans and specifications to upsize an existing 8 -inch water and a 10 -inch recycled water pipes passing through the existing Trabuco Road Bridge. The design also included the addition of flex ball connections at each ends of the Bridge and four (4) permanent openings on the existing bridge deck for future access and pipe maintenance. Extensive coordination with Caltrans District 12 and District 7 (bridge structures) and the City of Irvine was required to obtain their approval for project construction in their right-of-way. • IRWD Zone 4/LAWD Zone 1 Potable Water Interconnect Facilities MBF prepared the final construction plans and specifications for the interconnection facilities between the Irvine Ranch Water District's Zone 4 and former Los Alisos Water District (LAWD) Zone 1 water transmission mains. The project consisted of 650 lineal feet of 12 -inch PVC and Ductile Iron pipes. A portion of the pipe had to be constructed by lack and bore with a 20" steel casing as it crosses deep under a county drainage facility. The project also includes a motor operated valve vault. The motor - operated valve vault facility to be constructed in the Cities of Irvine while the connecting pipelines are located both in the Cities of Lake Forest and Irvine. As part of this project, encroachment permits from the City of Lake Forest, City of Irvine and County of Orange was obtained. Sand Canyon Zone 3 Pipe Replacement Project (Under 1-405) Subsequent to the Irvine Ranch Water District's (IRWD) investigation into the causes for the partial filling of the Quail Hill Zone 3 Reservoir, it was discovered that the 36 -inch Zone 3 transmission main in the Sand Canyon Avenue right-of-way had collapsed at two locations inside the 48 -inch steel casing crossing I-405. MBF developed and prepared four (4) alignment alternatives for construction of a new 36 -inch CML steel pipe in a 48 -inch casing across I-405 at Sand Canyon Avenue. Conventional lack& Bore, Horizontal Directional Drilling (HDD), and Microtunneling methods of trenchless construction were investigated. MBF obtained an encroachment permit from Caltrans for placing the lacking pit inside the Caltrans right-of- way. This allowed the pipe to be jacked in two opposite directions and will reduce the length of the jacking pipe to 350' from the original 700 -feet length. Newport Boulevard Water Main Replacement Feasibility Study MBF prepared a feasibility study for relocation/replacement of a domestic water pipeline network in Santa Ana Heights for the Irvine Ranch water District. Project consisted of approximately 4,500 -feet of the water mains located within right-of-way on private properties varying in size from 4" to 12" in diameter. The main pipeline runs parallel to the Newport Boulevard and provides drinking water, irrigation, fire services, and fire hydrants to approximately 73 customers. Any access to this water main for routine maintenance and repairs is extremely limited if not impossible. The Feasibility Study investigated various alternatives, including water main relocation, to provide easier access to service meters for meter reading and to maintain and repair the pipeline in case of pipe failure. The study investigated and identified critical elements that could potentially impact the water main relocation including but not limited to utility conflicts, agency permit requirements, right-of-way, and construction cost comparison for various construction alternatives. The report included a Life Cycle Cost Analysis for each alternative and a made a final recommendation for the water main to be relocated to the Newport Boulevard. pago I> CONSI,I IINfi, 1 San Juan Creek Recycled Water Pipeline Project LAGUNA BEACH COUNTY WATER DISTRICT I Various Pipeline Improvement Projects Contact lames Nestor (949) 494 1041 Over the course of several years, MBF has provided design engineering services for the Laguna Beach County Water District. Relevant projects include: Laguna Canyon Road Pipeline Replacement MBF provided engineering design and construction support services for replacement of an existing 6 -inch cast iron pipeline in Laguna Canyon Road. Several pipe alignment alternatives and methods of construction were considered to keep the construction costs to a minimum and still meet all the Districts expectations. Conventional open trench construction as well as pipe bursting approach using HDPE pipe was utilized for this project The project consisted of approximately 2,700 lineal feet of an 8 -inch PVC pipeline that was constructed in Laguna Canyon Road within Caltrans right-of-way. Details for connections to the existing pipes as well as details for fire hydrant connections and service laterals were all developed per District standards. Extensive traffic detour plans and coordination with Caltrans regarding pipe alignment, was necessary to obtain the encroachment permit during the design phase. The proposed pipe alignment by MBF Consulting resulted in the successful and timely acquisition of the Caltrans permit allowing the construction to proceed with no delays or cost overrun. 2006-2007 Capital Improvement Projects MBF provided engineering design services for the Laguna Beach County Water District's 2006-2007 CIP Projects, The CIP consisted of Cast Iron Pipe Replacement and System Enhancement projects throughout the District. Cast Iron Pipe Replacement portion of the work included: ➢ Replacing 300 lineal feet of 6 -inch cast iron pipe and appurtenances with 6 -inch PVC pipe in Wilson Street at EI Bosque. ➢ Replacing 150 lineal feet of 8 -inch cast iron pipe and appurtenances with 8 -inch PVC pipe in an easement between Canyon View and Bay View. ➢ Replacing 100 lineal feet of 8 -inch cast iron pipe and appurtenances with 8 -inch PVC pipe in an easement between Summit Way and Summit Drive. D System Enhancements portion of the work included: D Installation of 1300 lineal feet of 8 -inch PVC pipe and appurtenances in Cerritos Drive. D Installation of pressure regulating station in Panorama Drive at Eleanor Lane, Laguna Canyon Road Pipeline Enhancement (Parallel Installation) MBF provided engineering design and construction support services for the enhancement of an existing 8 -inch cast iron water pipeline in Laguna Canyon Road. The project consists of approximately 3000 lineal feet an 8 -inch PVC pipeline to be constructed parallel to the existing cast iron pipe to improve system capacity and increase Bre flow. Connections details between the two parallel pipelines, new fire hydrant connection details as well as service connections and distribution lateral details are included in the design. Extensive traffic detour plans and coordination with Caltrans, regarding the pipe alignment, was necessary to obtain encroachment permit during the design phase. MBF also prepared the legal descriptions and exhibits for the new water line and assisted the District with the process of quiet claiming the District's existing easement. MOULTON NIGUEL WATER DISTRICT I Corner Stone Water Loop Contact: Tom Stephenson (949) 425-3553 MBF provided engineering design and construction support services for extension of Zone 650 domestic water system in Moulton Parkway. The project consists of approximately 1300' of 12 -inch Ductile Iron pipe to be constructed in the cities of Laguna Niguel and Laguna Hills. The pipe alignment crosses Caltrans right-of-way as pipeline extends under the 73 Toll Road. Extensive traffic detour plans and coordination with cities of Laguna Niguel, Laguna Hills and Caltrans, regarding the pipe alignment, was necessary to obtain encroachment permit during the design phase. The 12" and 16' pipelines are constructed in Railroad Canyon Road whereas the PRS was constructed in a gated community in the City of canyon Lake The remaining pipes are constructed in the City of Lake Elsinore and the Riverside County. The goal of the project was to improve the system pressure and reliability. The project required extensive utility research and coordination with existing facilities within the project area and continuous communication with the affected utility companies and public agencies. MBF obtained encroachment permits for construction from Riverside County, City of Canyon Lake, and City of Lake Elsinore. This project started on Newport Boulevard at The Masters Circle and extended on Bristol Street all the way to the Red Hill /Santa Ana Avenue. This pipeline was constructed to create a loop system and to remove an existing pipe and reservoir that were encumbering the old Santa Ana Heights headquarter property allowing for redevelopment of the property. Project required coordination with the businesses along Bristol Street and reconnection of all existing meters to the new pipeline. Blue Lake North Reclaimed Water Replacement, Irvine, Ca. — As Project Manager, Mike prepared construction documents (PS&E) for replacement of approximately 2,700 lineal feet of a 6 -inch ACP reclaimed water line with 6 - inch PVC pipe in Blue Lake North in the City of Irvine. This project was on a fast track and requires coordination with the City of Irvine, The Woodbridge Village Association as well as the school and the club house located along the pipe alignment. MBF prepared traffic detour plans per city of Irvine standards to secure the encroachment permit. Due to the fast track nature of this project Mike met with several pipe contractors to discuss the preliminary alignment and design of the pipeline. The need to add a pressure regulating station to this project was considered. The goal of this project was to replace portion of the 6 -inch reclaimed water pipeline that had experienced repeated failure in past few years. The pipeline in Rancho Santa Margarita Parkway crossed under the 240 Toll Road within the Caltrans right-of-way. As part of this project, encroachment permits from the City of Lake Forest, City of Irvine, and Caltrans was obtained. IRWD Zone 1/LAWD Zone 4 Domestic Water Interconnections, Irvine, Ca. - Project Manager responsible for preparation of a preliminary design report (PDR) and the final construction plans and specifications for the interconnection facilities between the Irvine Ranch Water District's Zone 4 and former Los Alisos Water District (LAWD) Zone 1 water transmission mains. The project consisted of 650 lineal feet of 12 -inch PVC and Ductile Iron pipes. A portion of the pipe is to be constructed by Jack and bore with a 20` steel casing as it crosses deep under a county drainage facility. The project also includes a motor operated valve vault. The motor -operated valve vault facility is to be constructed in the Cities of Irvine while the connecting pipelines are located both in the Cities of Lake Forest and Irvine. As part of this project, encroachment permits from the City of Lake Forest, City of Irvine and County of Orange will be obtained. Lateral (Wb -3) Segment of The West Basin Recycled Water Project - Hydraulic network analysis was performed to determine the pipe diameters. A cost/benefit analysis was performed to select the potential users. The scope of work for each task was simile; i e., records research, boundary survey, aerial control survey, topogaphic mapping, boundary and encroachment determination, and final monumentation which aminate in Records of Surveys to be filed in San Bernardino, Riverside, Orange and Los Angeles Counties. University of California at Irvine Student Housing Expansion, Irvine, CA: Mr. Hunseker was the Project Manager supervising base mapping, es -built surveys, and construction staking for American Campus Communities and Benchmark Contractors. All preliminary mapping for the East Campus Housing, which has just recently begun construction, and preliminary mapping and construction staking for the Vista del Campo Norte Student Apartments, completed in 2006, was peromad under his close direction. Sites ranged from new land to existing parking lots which will be reused. All utility locations and drainage devices were located throughout the course of the survey, for some no records existed. Existing records on varying datums were combined, corrected and translated to fit in to the base maps. Newport Coast—Newport Ridge, Newport Beach, CA: Mr. Hunseker supervised topographic surveys and serial consul surveys, and organized photogrammehic efforts through a consultant for both the Newport Coast and Newport Ridge developments for the Wine Company. The site encompasses nearly 1,500 axes of natal, perk site and luxury homes. Monthly tights were arranged to document the construction progress. Because the photography was occurring on a once -a -month interval, care was taken b minimize the amount of field time required to central the photography. North Orange County Community College District, CA: Mr. Hunseker served as Project Manager and supervised topographic surveys and as -built surveys for both Fullerton College and Cypress College prior to redevelopment activity. This included surveys of utility tunnels, many of which had never been mapped previously (Fullerton College). Surveys were b support Loth enfpneering and architectural design. EXECUTIVE SUMMARY As part of the Proposition 50 grant funded projects, the City included the installation of the San Juan Creek Recycled Water Pipeline. The project consists of the design, permitting, and construction of approximately 3,300 lineal feet of 12 -inch recycled water pipeline. The recycled water pipeline will connect with an existing recycled water line at the end of San Juan Creek Road and go through the Rancho Mission Viejo Riding Park at San Juan Capistrano to connect to Santa Margarita Water District's (SMWD) recycled water pipeline at the corner of Ortega Highway and Antonio Parkway. Staff solicited bids from nine (9) engineering firms for the preparation of plans and specifications (Attachment 1). The City received five (5) responses to the solicitation request. Staff recommends the award of a Personal Services Agreement with MBF Consulting, Inc. for the preparation of plans and specifications for the San Juan Creek Recycled Water Pipeline in the amount not to exceed $54,693. DISCUSSION/ANALYSIS: The existing sources of recycled and non -potable water are the City's Mission Well (non -potable) and Moulton Niguel Water District (recycled). Due to deficiencies in the recycled water supply, potable water is used to augment the system. The connection to SMWD will provide additional supply and ensure supply reliability to all customers and City Council Agenda Report April 23, 2013 Page 2 of 3 eliminate the augmentation of the recycled system with potable water. With the installation of this pipeline along with the other Proposition 50 grant funded projects to expand the City's recycled/non-potable water system, the City will reduce the use of domestic imported water by 1,011 acre feet (AF) per year. The City received five responses to its request for proposals as follows: Engineering Firm Cost MBF $54,693 Dexter Wilson $97,010 Hunsaker and Associates $106,915 Hall and Foreman 1$113,268 URS 1$115,950 Staff reviewed the proposals and interviewed MBF Consulting, Inc. MBF's proposal was responsive to all the elements of the project and provides adequate resources for the design of the recycled water pipeline and engineering support. The Agreement with MBF Consulting, Inc. includes: • Preparation of plans and specifications of a recycled water pipeline and pressure reducing station at the north east end of San Juan Creek Road and a flow meter at a connection point to Santa Margarita Water District's pipeline • Engineering support services during the bidding process • Construction engineering support during the construction phase of the project FISCAL IMPACT: CIP 13603 has $844,700 budgeted for Fiscal Year 2012-2013. These funds are included in Grant Agreement No. 07-542-550 Amendment No. 3, from the State of California. The cost of the work by MBF Consulting, Inc. is $54,693; therefore, no additional budget appropriations are necessary at this time. ENVIRONMENTAL IMPACT: Not applicable. RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to prepare plans and specifications for the San Juan Creek Road Recycled Water Pipeline Project; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by the Consultant shall consist of those tasks as set forth in Exhibit A, attached and incorporated herin by reference. To the extent that there are any conflicts between the provisions described in Exhibit "A" and those provisions contained within this Agreement, the provisions in this Agreement shall control. Section 2. Term. This Agreement shall commence on the effective date and shall terminate, and all services required hereunder shall be completed, no later than 8 months after the notice to proceed. Section 3. Compensation. 3.1 Amount. Total compensation for the services shall not exceed $54,693, asset forth in Exhibit B, attached and incorporated herein by reference. 3.2 Method of Payment. Subject to Section 3.1, Consultant shall submit monthly invoices based on total services which have been satisfactorily completed for such monthly period: The City will pay monthly progress payments based on approved invoices in accordance with this Section. Attachment 2 3.3 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to the City. Invoices shall be addressed as provided for in Section 16 below. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of the City, and shall obtain no rights to any benefits which accrue to Agency's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for the City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to the City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. Section 6. Changes to Scope of Work. For extra work not part of this Agreement, a written authorization from City is required prior to Consultant undertaking any extra work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and/or Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) if applicable, it has investigated the work site(s), and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work to be performed under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform the City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. F Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the work, Consultant shall have delivered to City at least one (1) copy of any final reports and/or notes or drawings containing Consultant's findings, conclusions, and recommendations with any supporting documentation. All reports Submitted to the City shall be in reproducible format, or in the format otherwise approved by the City in writing. Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemni . To the fullest extent permitted by law, Consultant agrees to protect, defend, and hold harmless the City and its elective and appointive boards, officers, agents, and employees from any and all claims, liabilities, expenses, or damages of any nature, including attorneys' fees, for injury or death of any person, or damages of any nature, including interference with use of property, arising out of, or in any way connected with the negligence, recklessness and/or intentional wrongful conduct of Consultant, Consultant's agents, officers, employees, subcontractors, or independent contractors hired by Consultant in the performance of the Agreement. The only exception to Consultant's responsibility to protect, defend, and hold harmless the City, is due to the negligence, recklessness and/or wrongful conduct of the City, or any of its elective or appointive 3 boards, officers, agents, or employees. This hold harmless agreement shall apply to all liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Consultant. Section 14. Insurance. On or before beginning any of the services or work called for by any term of this Agreement, Consultant, at its own cost and expense, shall carry, maintain for the duration of the agreement, and provide proof thereof that is acceptable to the City, the insurance specified below with insurers and under forms of insurance satisfactory in all respects to the City. Consultant shall not allow any subcontractor to commence work on any subcontract until all insurance required of the Consultant has also been obtained for the subcontractor. Insurance required herein shall be provided by Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or better. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in an amount not less than one million dollars per occurrence ($1,000,000.00), combined single limit coverage for risks associated with the work contemplated by this agreement. If a Commercial General Liability Insurance form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this agreement or the general aggregate limit shall be at least twice the required occurrence limit. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non - owned vehicles in an amount not less than one million dollars per occurrence ($1,000,000.00). 14.3 Workers' Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Workers' Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit 4 the insurance certificates, including the deductible or self -retention amount, and an additional insured endorsement naming City, its officers, employees, agents, and volunteers as additional insured as respects each of the following: Liability arising out of activities performed by or on behalf of Consultant, including the insured's general supervision of Consultant; products and completed operations of Consultant; premises owned, occupied or used by Consultant; or automobiles owned, leased, hired, or borrowed by Consultant. The coverage shall contain no special limitations on the scope of protection afforded City, its officers, employees, agents, or volunteers. 14.5 Errors and Omissions Coverage Throughout the term of this Agreement, Consultant shall maintain Errors and Omissions Coverage (professional liability coverage) in an amount of not less than One Million Dollars ($1,000,000). Prior to beginning any work under this Agreement, Consultant shall submit an insurance certificate to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.6 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.7 Terms of Compensation. Consultant shall not receive any compensation until all insurance provisions have been satisfied. 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written "Notice to Proceed" verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to Consultant. In addition, this Agreement may be terminated by any party for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. 5 Section 16. Notice. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. San Juan Creek Recycled Water Pipeline Project APPROACH AND SCOPE OF WORK PROJECT UNDERSTANDING We understand that the City of San Juan Capistrano (City) is seeking a professional consultant to design the San Juan Creek Recycled Water Pipeline. We have reviewed the Request for Proposal (RFP) and its attached exhibits and understand that the City desires to extend its recently built 8 -inch recycled water pipeline on San Juan Creek Road with a new 12 -inch PVC C900 purple pipeline to connect to the Santa Margarita Water District (SMWD) recycled water line at the comer of Ortega Highway and Antonio Parkway. The proposed 3,300 feet of 12 -inch PVC recycled water pipeline will begin at the north easterly end of San Juan Creek Road at the termination point of the existing recycled water line. The existing temporary blow off will be removed, a connection made, and the pipeline will follow through the Rancho Mission Viejo Riding Park (Riding Park) to connect to the SMWD recycled water main at the comer of Ortega Highway and Antonio Parkway. Project components include piping, valves, above ground Pressure Reducing Valve Station (PRV, to be designed per the City's standard for above ground PRV's) and flow meter (designed to SMWD standards for above ground meters at the connection point with SMWD). Our professional services will include but not be limited to field investigation and evaluation of existing conditions at the Riding Park; preparation of a preliminary design report (PDR) addressing our recommendations and providing our findings; preparation of 50% plans and specifications; preparation of final plans and specifications, bid documents, and construction estimate; bid phase services; construction support services; and preparation of record drawings. Specific Considerations Based on our knowledge of recycled water pipeline design, construction principals, our previous similar projects, and operational requirements, we have developed a summary of considerations that will need to be addressed specifically for this project. The following information serves to address these critical issues and provides a basis for MBEs approach to designing the improvements for the City's San Juan Creek Recycled Water Pipeline Project. Noise Impact. The Riding Park is a horse park with riding enclosures, open fields, parking, and other horse riding facilities. We understand and have experience with the types of issues associated with construction occurring in the vicinity of horse riding facilities. Live animals such as horses are particularly sensitive to excessive and unfamiliar noise and movements. This can create adverse effects on animals and should be avoided. Our experience includes the design and construction of a fire line and fire department connection for an Equestrian Center in the City of Laguna Woods. We will provide requirements in the technical specifications to reduce any construction impact including requiring noise mufflers for equipment or temporary screens during construction. Schedule. We understand that due to funding requirements, the design and construction of this project require a very strict schedule. MBF understands the importance of meeting project milestones. We propose an aggressive non-linear schedule that enables different design team members to work simultaneously on different aspects of project. We also propose strong communication with City and other involved agencies to reduce review and modification times. We have identified the following tasks to keep the project on schedule: P,,qc 1 R. c�+u unrvc, �rvc. > We will maintain positive and constant communication with City staff as well as SMWD and Blenheim Facility staff to resolve any issues and questions during the design. This will significantly reduce review and correction times and will keep the design team up to date with City requirements and desires. D At the same time that the surveyor is completing their task, we will begin developing preliminary plans based on existing property and street improvement plans. We will then transfer the approved preliminary design to survey base maps and continue to finalize the construction drawings. This will save a minimum of two weeks during the design phase. We will also separate the pipeline design from facility (PRV and Metering Station) design and will assign adequate resources to each task. We are committed to completing this project by June 24, 2013. > The assigned project manager (PM) will be the sole point of contact for the City. He will ensure proper coordination and communication between design team members. During the construction phase, we will assign the same PM who will be familiar with all aspects of project, is a hands-on California Registered Civil Engineer, and who will assist the City with bidding and construction engineering tasks. This will reduce the shop drawing and RFI review times and will assist in expediting construction of the pipeline. • SCADA System. PRV and Metering Stations are typically connected to an agency's SCADA system for the purpose of recording and control of operation. We understand that the design of electrical services and SCADA integration is not included in the RFP; however, as an optional service and at the Citys request, we can provide these services. Based on our preliminary review of available data, we anticipate that a minimum of a 40 -amp service will be needed. Even if electrical design services are not requested at this time, we will make sure to include provisions in the design to make it capable for future integration into the City's SCADA system. These provisions will include specifying Pressure Reducing Valves with position indicators capable of connecting to SCADA, specifying flow meters with remote reading capabilities, providing adequate and secure space for possible future electrical service, etc. • Environmental Coordination. We understand that City will retain the services of a separate consultant to prepare environmental documents for this project. We also understand that environmental studies can become time consuming and potentially impact design and construction schedules. We will start coordination with City's environmental consultant immediately and will provide them with preliminary information to accomplish their task. We will also stay in constant contact with them and implement their recommendations into the design at early stages. This will assure that while the design drawings comply with environmental requirements, they will not be delayed by final approval of environmental documents. • Safety. MBF considers safety the most important issue on any construction project. We will consider construction safety concerns during the design to assure that developed plans can be safely constructed and ensure a safe parkway environment at all times. The pipeline is being partly constructed in a public area (the Riding Park). We will consider locating the pipeline in a manner to create safe passage during construction. • Public Impact. Construction of new pipelines can significantly impact public convenience and safety. It is incumbent upon the design team to work with the City to minimize public impacts in terms of the proposed improvements, the schedule, phasing and anticipated noise levels. Due to proximity of construction to a horse riding park, it is important to include provisions in the general specifications to minimize adverse effect of construction activities and noise. Additionally we will consider locating the pipeline as such that minimizes public inconvenience. L. San Juan Creek Recycled Water Pipeline Project Industry Standards. MBF has a broad knowledge of industry standards and federal and local government requirements and will implement these requirements and recommendations, as well as the City and SMWD's Standard Plans, Procedures, and Approved Vendors into the design of water systems. These agencies include, but are not limited to, the Environmental Protection Agency (EPA), California Department of Public Health (CDPH, formerly known as DHS), American Water Work Association (AW WA), and California Water Environment Association (CWEA). Design criterions such as separation requirements between new water lines and sewer pipes and other pipelines will be considered and plans will be developed accordingly. We will coordinate design considerations with the City to assure compliance with City requirements. Utility Coordination. MBF will conduct a thorough utility investigation and will coordinate the work with affected utility agencies based on provided information to avoid any major conflicts during the design. Any upfront information gathering will result in ease of construction and avoid impacting the schedule or budget with unnecessary change orders or stand-by time. We will also coordinate the work closely with Blenheim Facility personnel and will consider impacts to their existing utilities and irrigation system during the design phase. It appears that the proposed pipeline will transverse through an existing SCE easement. We will coordinate this work with SCE early on and will obtain their approval during the preliminary design phase to avoid any delays during construction. Pipe Installation. The MBF design team has previous experience in installing different pipelines in several locations in Southern California. We understand the importance of installing pipes in conformance with manufacturer requirements and limiting joint deflections on PVC pipes. We will ascertain that the design will follow the City's general requirements and approved list of materials and vendors. PRV/Flow Monitoring Stations We have designed numerous physical system gaps, PRV and Flow Monitoring stations for different agencies. We will ascertain that design will follow the City's general requirements and approved list of materials and vendors. These stations are proposed to be designed above ground. Therefore our design will consider provisions to make these stations vandal proof and secure. Typical Cla-Valve PRV and magnetic flow meters (such as Spalding Meter) will be specified. Potholing. We will prepare preliminary plans which will include all utility information for City review and comments. When the preliminary alignment is approved, we will identify potential conflicts with existing utilities. We will perform potholing as necessary to determine the extent of conflict. Based on the pothole findings, we will then modify plans and/or coordinate with the utility agency to avoid any future conflicts during construction. The goal is to prevent future adjustments and unnecessary delays to the contractor which can be much more costly than preventing them during the design phase. A total number of 20 potholes are assumed for cost purposes. Existing Improvements. After a site review we will give recommendations for the final design to fit seamlessly with existing and future -planned improvements in an effort to reduce or eliminate the potential removal and replacement of previously constructed capital improvements. Existing improvements, such as catch basins, drain inlets, street light poles, will be protected -in-place. Stakeholder Coordination. MBF will conduct periodic meetings as necessary with all stakeholders in early stages of design to make sure all their needs are met in the design package. Early coordination will prevent delays in review of plans and implementing their design recommendations. Page 3 CONSULTING, INC. They offer an overview of how MBF will provide a high qualityproject, on a fast-track schedule and under budget. The WBS shall identify the procedures and technical requirements that are to be followed in developing the design documents and deliverables. The WBS also describes the responsibilities of each participant in the project. A Master Project Schedule will be prepared following the WBS showing the relationship between tasks and the expected start date and duration for each item. This schedule will serve as the guide to conducting and monitoring the progress of the work, and to ensure projects are completed on time and within budget. To ensure accurate monitoring and tracking of documents, revisions and progress, a document tracking and control system will be developed. To facilitate the review and approval process, we will work closely with the keyindividuals at the City who are responsible for the review of specific elements of the project and will submit draft copies of significant work items before the milestone submittal dates. This will give us a clear understanding of what the reviewers expect, and they will have a preview of what will be submitted before the actual submittal is made. Our past experience working on projects with cities has taught us the importance of maintaining accurate and detailed meeting minutes, decision logs, and action item lists during the project development process. Quality Management Quality Assurance and Quality Control (QA/QQ is a top priority for MBF. To ensure the highest quality of design, we will implement a comprehensive QA/QC program. As part of the MBF team, Thom Coughran, P.E. will monitor the QA/QC program. He has extensive experience in providing and overseeing the implementation of several QA/QC programs. Page 4 HEM AI .INC. San Juan Creek Recycled Water Pipeline Project The QA/QC program will be developed specifically for this project. It will be documented and issued to each project team member. The QA/QC program will emphasize the need to clearly define requirements and design standards for the design efforts, and the need to independently check all work before it is issued to the City or other reviewing agencies. The quality control program will ensure that the project documents: ✓ Conform with the contract documents; ✓ Are neat, well organized, clear, concise, and complete; ✓ Are technically and grammatically correct ✓ Comply with generally accepted standards of engineering and applicable laws; ✓ Are signed, dated, and stamped as required; and ✓ Are consistent with other related plans and are constructible. The QA/QC Manager will review the engineering evaluations, repair recommendations, design drawings, estimates, specifications, reports and any other document being delivered to the City for accuracy and completeness. He will personally field walk the project sites before finalizing the plans for 100% submittal, to correct any plan mistakes while in the field. He will ensure constructability, claim avoidance and compliance with the City and other agency requirements. In addition, he will provide daily supervision and guidance to the project team and will maintain continuous involvement with the day-to-day activities of the plan preparation team. Cost Control We are able to continually evaluate a project's program/cost coordination through all project phases to enable informed and timely decision-making by our clients and the entire project team. Cost control techniques include program budget analysis, value engineering, life -cycle cost analysis and quantity -based estimating. We rely on an open -book, inclusive process that demonstrates the costs and benefits of varying design options. This budget confirmation process starts in the earliest stages of the project, when design and engineering alternatives have the greatest potential impact on costs. Our design teams analyze client goals, technical requirements, alternative building concepts, construction costs and long-term operational costs to define the optimum scope within the budget, ensuring long-term flexibility and value. Schedule Control The key to effective schedule control is to measure actual progress and compare it to planned progress on a timely and regular basis and to take necessary corrective action immediately. We propose to supplement each major task as identified in the Master Project Schedule with a supplemental schedule to keep careful track of where each individual component stands. This will improve your project manager's reporting, help identify problems that may result from delays, and readily afford the opportunity for modifying the schedule, when deemed necessary. As a result, your projects are completed on schedule. Page 5 �� r� CONSULTING. INC. San Juan Creek Recycled Water Pipeline Project SCOPE OF WORK MBF takes no exception to the Scope of Work outlined in the RFP as well as addendum No.l. Following describes the Scope of Work as identified in the RFP with additional clarifications, if needed, for each task: 1. GENERAL ADMINISTRATION, MEETINGS AND PRESENTATIONS 1.1. Kick-off Meeting: Following the notice to proceed, the MBF team will schedule and attend a Kick -Off Meeting with City staff to initiate the project; establish lines of communication; review and refine, if needed, the project scope of work and schedule; establish design guidelines; discuss project parameters and constraints; and obtain background information. 1.2. Project Schedule: Internally, MBF conducts weekly staff meetings every Monday. In these meetings, project managers review the progress of a project with each team member. This will assure total compliance with the approved project schedule since any shortfall is detected at early stages and additional resources will be assigned to the project. Also Project Managers review the project status with Directors to guarantee that enough resources have been assigned to each project. If needed, additional resources will be assigned in these weekly evaluations. MBF has a track record of delivering projects on or before schedule due to its internal QA/QC program. 1.3. Progress Meetings/Project Review Meetings: At project review meetings, we will review project status including progress and schedule. The initial field walk will be scheduled with City staff to ensure detailed depiction of existing conditions and work requirements on the plans. The limits of the work will be determined during the initial field walk in accordance with City standards and direction. We will coordinate with City staff to establish design criteria, pipeline alignment, material and sizes. MBF will also conduct a field walk to determine potential design and construction conflicts and verify field topography data. We believe that clear and concise plans are arrived at from a total understanding of the existing conditions, properties, and environment of the project. Consequently, having as many field walks as are required to ensure a proper design is strongly encouraged. 1.4. Blenheim Facility and SMWD Coordination Meetings: We will assume two (2) two-hour meetings each with Blenheim Facility and SMWD staff regarding the proposed improvements, project limits, and other project coordination items. City staff will also be involved with these meetings. 2. SITE INVESTIGATION AND EVALUATION 2.1. As -Built Research, Investigation and Review. MBF will obtain background information, as -built drawings, and any existing information pertaining to the project. We anticipate the City will provide for our use on this project the background information as summarized in Table 1. We will ensure incorporation of city staff suggestions, recommendations, directions and other City requirements into the project design drawings. MBF will review City's record drawings and will use the pertinent information in developing plans. Utility Research and Notification. MBF will research available utility records and will identify utilities within the project limits. The information obtained will be summarized on the project base map. Concurrent with preliminary design, utility information requests will be sent to each utility companies requesting verification of location, size, and depth of facilities within the project limits. Tasks will consist of: ✓ Access the Underground Service Alert's website and compile a list of member agencies that own facilities within the project limits. ✓ Notify each utility purveyor, in writing, and request copies of record drawings or atlas maps of existing and proposed facilities within the project boundary. ✓ Utilities shown on the record drawings will be surface verified, and added to the base map, along with the most recent easement lines shown for each facility. ✓ Identify interfaces between existing facilities and future project construction. ✓ Consult with the service planners and others as necessary within each utility company to resolve any conflicts. ✓ Keep City staff informed on all discussions with utility companies via written meeting minutes or records of telephone conversation. ✓ Prepare a Utility Notification Log to track utility company contacts and responses including contact information and dates of all outgoing and incoming correspondence. ✓ With prior approval from City, MBF will provide copies of the approved plans to the utility purveyors to facilitate planning future modifications. ✓ If applicable, send final notice to each affected utility company to complete relocations prior to the anticipated construction start date. Agencies and utilities will include but will not be limited to: • City of San Juan Capistrano Southern California Gas Company • Blenheim Facility Southern California Edison • Santa Margarita Water District San Diego Gas and Electric • Orange County Cable Television • The Telephone Company 2.3. Survey. As a sub -consultant to MBF, Hunsaker Land Surveying Inc. will perform topographic survey and will develop base maps for this project. The general scope of work follows: 2.4.1. The recycled water pipeline runs through predominantly vacant land with ongoing equestrian activity. A large amount of the alignment can be mapped by photogrammetric methods and provide accurate controls, thereby saving time and costs. We will acquire field survey locations at thejoins and at locations along the alignment to supplement the aerial mapping. 2.4.2. In performing all surveys necessary for the design of the project we will establish control based on the following: Page 7 WA AILM coesu LTwc, INC. San Juan Creek Recycled Water Pipeline Project Horizontal – NAD83 California Coordinate System Zone VI, OCS Adjustment with ground values, 2007.00 Epoch OCS GPS Adjustment based on nearby OCS Horizontal Control Points (Several exist in the area and along the alignment). Vertical – NAVD88 Benchmarks based on OCS Adjustment in the area of the project. 2.4.3. We will perform records research through the County of Orange and City of San Juan Capistrano for existing land boundaries and centedine monumentation and compile a record boundary map for the site. 2.4.4. Locations will be made to centerline monumentation and/or boundary corners in the area. This will create ties to constrain any record boundary and utility information as well as create a hard tie to tangible monumentation for construction. Control Points will be established in areas that will survive the construction process and will be durable in nature, suitable for usage when construction begins. If this is not possible due to the ongoing equine activity and line -of -sight issues control will be established outside the limits of construction to ensure that continuity in the control can be maintained throughout the construction process. 2.4.5. We will provide locations as directed by City based on a review of the site. All utility research and markouts should be completed prior to field survey. Where underground markings are provided they also will be acquired for inclusion in the project data base. We will locate above ground appurtenant devices, manholes and hand holes that will be affected by the project. 2.4.6. We will be available on short notice to tie in potholing locations or be on site during the potholing activity to locate items as they are uncovered. We have accounted for twenty locations for potholes as defined in the RFP. 2.4. Pothole. 2.4.1. As part of our contract and through our sub -consultant, we will provide all equipment and personnel needed to vacuum excavate up to twenty (20) potholes (up to 12"X12"), to determine the exact horizontal and vertical location of the existing utilities. Additional potholes will be provided at the unit price. A minimum quantity of 5 potholes must be ordered for this price to be valid. We will secure an inquiry identification number from Underground Service Alert at least 48 hours prior to excavation. Vacuum excavated potholes will be backfilled using native material or SE30+ fill sand. 3. PRELIMINARY DESIGN REPORT AND INVESTIGATION 3.1 MBF will coordinate with City staff to establish design criteria, verify pipeline alignments and sizes. MBF will conduct field walk to determine potential design and construction conflicts and verify field topography data. We will review design criteria, key issues and recommend alignments for the project and obtain the City approval of the proposed alignment. The PDR will include at a minimum: ✓ Conflicts with utilities and structures ✓ Proposed location for PRV Station ✓ Proposed location of Metering Facility Page 8 ,,-,,r. CONSULTING, INC. San Juan Creek Recycled Water Pipeline Project ✓ Preliminary tie-in details ✓ Construction schedule and phasing requirements to meet Prop 50 deadlines, bird nesting season, the City's bid approval and award process, and Blenheim Facility activities. ✓ Identify environmental issues and requirements. ✓ Engineer's estimate of construction cost. 3.2 We will meet with the City to review comments on the draft preliminary design report and preliminary drawings. We will respond to comments, revise the draft as necessary, and submit two hard copies and electronic format copy of the final preliminary design report to the City. The final preliminary design report will be used as the basis for final design of the project. 4. ENVIRONMENTAL TASKS We understand that the City is obtaining the services of an environmental consultant to complete this scope of work. We will work with the City's environmental consultant as required for the project's successful and timely completion. We will also incorporate the results of the initial environmental study into the final alignment and design of the pipeline. 5. FINAL DESIGN AND CONSTRUCTION DOCUMENTS 5.1 Preliminary Design Drawings 5.1.1. Preliminary design drawings shall identify all existing improvements including but not limited to drainage structures, fire hydrants, utility facilities, landscaping, signs, street lights, fences, walls, etc., and other appurtenant improvements in the project areas. 5.1.2. The preliminary design drawing will contain all existing utilities and facilities and will be based on all data provided by the City, utility agencies, and our preliminary field review to verify existing conditions. Utility conflicts and construction constraints will be identified. 5.1.3. Design considerations will be to avoid public and utility impacts, provide adequate and easy future maintenance access, and construction considerations such as traffic control, staging area, and public access during construction. Preliminary pipeline plans will be developed and discussed with the City. 5.1.4. Restrain lengths will be calculated and if necessary, restrained joints and/or thrust blocks will be identified on the plans. 5.1.5. Tie -In connection details as well as plans and section of PRV Station and Flow Metering Station will be developed. 5.1.6. We will also notify utility owners by submitting preliminary construction drawings for review, comment and to coordinate the resolution of identified conflicts. 5.2 Final Engineering Design 5.2.1 MBF will prepare drawing package consisting of plan (1"=40' Scale) and profile (1"=40':H; 1"=8':V Scale) drawings for the construction of recycled water pipeline project. The package of drawings will include a Title Sheet, General Notes, Plan and Profile sheets of the proposed pipeline and construction details such as connection details, mechanical plan and section of PRV/flow monitoring stations, utility crossing details, trench detail, and service or fire hydrant details, as necessary for a complete and constructible package. We will submit the plans (4 sets) to the City Page 9 �= �ULTING. INC. for their review at 50%, and 90% design stages. Final (100%) design drawings will be complete and bid -ready plan and profile drawings. 5.2.2 City comments from the preliminary submittal will be addressed in the final design drawing submittals. The Final Engineering Design submittals will also include technical specifications and a bid schedule, quantities and cost estimate. These will be provided to the City in electronic (PDF) format for review. We will review with City staff all their comments and will revise plans as necessary to comply with City requests. We will provide required engineering calculations to support design drawings. MBF also specializes in Construction Management of various public works projects. Our Construction Management Department will provide constructability, review of the plans. This will ensure the constructability, of design drawings with very valuable input from the field crew. 5.2.3 We will incorporate comments from City in the 100% design plans. Final plans shall be stamped and signed by a Registered Civil Engineer. MBF will provide final plans, specifications, and engineer's quantity and cost estimate to City in electronic format (PDF format as well as AutoCAD 2010 •.dwg format) per the City's Digital Submission Standards. 5.2.4 As part of this the final design, we will provide all affected utilities with a hard and electronic copy of the final plans and notices to perform any necessary adjustments. 5.2.5 We will prepare an Engineers Quantity and Cost Estimate that will be submitted as part of each of the 50%, 90% and 100% Submittals, and will include all items of construction work. 5.2.6 We will prepare the technical section of the construction specifications for the project. The specifications will conform to the Standard Specifications for Public Works Construction (Green Book), Standard Plans for Public Works Construction, City of San Juan Capistrano Standards Plans and Caltrans Standards Plans and Specifications, as applicable and necessary for a complete design package. All items of work will be covered under these specifications. MBF will compile these specifications and proposal documents with City of San Juan Capistrano "boiler plate" front- end documents as well as City's Standard Specifications. 5.2.7 MBF will provide a proposed construction schedule based on final plans and specifications. With help of our construction management division, we will develop construction phasing into the proposed schedule to help contractor meeting City's deadline of completion prior to December 31, 2013. 5.2.8 We will provide a full set of final contract documents ready for reproduction in hardcopy and electronic copy formats. 5.2.9 We will prepare a construction schedule for the proposed work based on the final plans and specifications. 6. CONSTRUCTION BIDDING THROUGH CONTRACT AWARD 6.1. We will attend a pre-bid conference at a date, time and place set by the City. 6.2. We will provide construction plan interpretation and consultation during the bidding phase of the project. Relevant projects include: Commercentre Drive Reclaimed Water Upsizing MBF prepared plans, specifications and estimates for the replacement and upsizing of approximately 2,000 lineal feet of an 8 -inch ACP reclaimed water line with 12 -inch PVC pipe in Commercentre Drive in the City of Lake Forest. Design and construction of this project required extensive coordination with the County of Orange and the City of Lake Forest due to the Alton Parkway Extension Project and the City's pavement rehabilitation project that were under way at the same time. A highline was designed and installed to provide temporary irrigation service during construction. Traffic control plan preparation, city encroachments permit acquisition, and construction support services were also provided. IRWD Zone 6/LAWD Zone 3 Potable Water Interconnect Facilities MBF prepared a preliminary design report (PDR) and the final construction plans and specifications for the interconnection facilities connection for the Irvine Ranch Water District's (IRWD) Zone 6 systems to the Los Alisos Water District (LAWD) Zone 3 system. The project consisted of 2,700 lineal feet of 16 -inch pipes, 200 lineal feet of 12 -inch pipes, two pressure reducing stations, and one motor -operated valve to be constructed in the Cities of Lake Forest and Irvine. The pipeline in Rancho Santa Margarita Parkway crossed under the 240 Toll Road within the Caltrans right-of-way. As part of this project, encroachment permits from the City of Lake Forest. City of Irvine, and Caltrans were obtained. 4" and 6" ACP Reclaimed Water Pipeline Replacement MBF prepared construction documents (PS&E) for the replacement of approximately 6,000 lineal feet of 4 and 6 -inch ACP reclaimed water line with PVC pipe in Woodbridge, South West Loop in the City of Irvine. The project was on a fast track that required coordination with the City of Irvine and The Woodbridge Village Association. Over 25 existing and or new service had to be reconnected to the new PVC pipe while minimizing any water service instructions. MBF prepared traffic detour plans per city of Irvine standards to secure the encroachment permit. The goal of this project was to replace existing 4 -inch and the 6 -inch reclaimed water pipelines that had experienced repeated failure in past few years. Lake Forest Pressure Improvement Project MBF prepared a preliminary design report (PDR) and has completed the final construction plans and specifications for construction of five (5) pressure reducing stations, and over 2000 If of an 8 -inch water line in the City of Lake Forest. Locating the pressure reducing stations behind the curb and outside of traffic lanes in developed areas of the city was challenging and required extensive potholing and coordination with utility companies. The project goal was to improve the water system pressure and reliability for areas within the City that were deficient. San Juan Creek Recycled Water Pipeline Project Water and Recycled Water Pipeline Upsizing In Trabuco Road Bridge Crossing CA 133 MBF designed and prepared construction plans and specifications to upsize an existing 8 -inch water and a 10 -inch recycled water pipes passing through the existing Trabuco Road Bridge. The design also included the addition of flex ball connections at each ends of the Bridge and four (4) permanent openings on the existing bridge deck for future access and pipe maintenance. Extensive coordination with Caltrans District 12 and District 7 (bridge structures) and the City of Irvine was required to obtain their approval for project construction in their right-of-way. IRWD Zone 4/LAWD Zone 1 Potable Water Interconnect Facilities MBF prepared the final construction plans and specifications for the interconnection facilities between the Irvine Ranch Water District's Zone 4 and former Los Alisos Water District (LAWD) Zone 1 water transmission mains. The project consisted of 650 lineal feet of 12 -inch PVC and Ductile Iron pipes. A portion of the pipe had to be constructed by lack and bore with a 20" steel casing as it crosses deep under a county drainage facility. The project also includes a motor operated valve vault. The motor - operated valve vault facility to be constructed in the Cities of Irvine while the connecting pipelines are located both in the Cities of Lake Forest and Irvine. As part of this project, encroachment permits from the City of Lake Forest, City of Irvine and County of Orange was obtained. Sand Canyon Zone 3 Pipe Replacement Project (Under I-405) Subsequent to the Irvine Ranch Water District's (IRWD) investigation into the causes for the partial filling of the Quail Hill Zone 3 Reservoir, it was discovered that the 36 -inch Zone 3 transmission main in the Sand Canyon Avenue right-of-way had collapsed at two locations inside the 48 -inch steel casing crossing I-405. MBF developed and prepared four (4) alignment alternatives for construction of a new 36 -inch CML steel pipe in a 48 -inch casing across 1-405 at Sand Canyon Avenue. Conventional Jack& Bore, Horizontal Directional Drilling (HDD), and Microtunneling methods of trenchless construction were investigated. MBF obtained an encroachment permit from Caltrans for placing the lacking pit inside the Caltrans right-of- way. This allowed the pipe to be jacked in two opposite directions and will reduce the length of the jacking pipe to 350' from the original 700 -feet length. Newport Boulevard Water Main Replacement Feasibility Study MBF prepared a feasibility study for relocation/replacement of a domestic water pipeline network in Santa Ana Heights for the Irvine Ranch water District. Project consisted of approximately 4,500 -feet of the water mains located within right-of-way on private properties varying in size from 4" to 12" in diameter. The main pipeline runs parallel to the Newport Boulevard and provides drinking water, irrigation, fire services, and fire hydrants to approximately 73 customers. Any access to this water main for routine maintenance and repairs is extremely limited if not impossible. The Feasibility Study investigated various alternatives, including water main relocation, to provide easier access to service meters for meter reading and to maintain and repair the pipeline in case of pipe failure. The study investigated and identified critical elements that could potentially impact the water main relocation including but not limited to utility conflicts, agency permit requirements, right-of-way, and construction cost comparison for various construction alternatives. The report included a Life Cycle Cost Analysis for each alternative and a made a final recommendation for the water main to be relocated to the Newport Boulevard. Relevant projects include: Laguna Canyon Road Pipeline Replacement MBF provided engineering design and construction support services for replacement of an existing 6 -inch cast iron pipeline in Laguna Canyon Road. Several pipe alignment alternatives and methods of construction were considered to keep the construction costs to a minimum and still meet all the Districts expectations. Conventional open trench construction as well as pipe bursting approach using HDPE pipe was utilized for this project. The project consisted of approximately 2,700 lineal feet of an 8 -inch PVCpipeline that was constructed in Laguna Canyon Road within Caltrans right-of-way. Details for connections to the existing pipes as well as details for fire hydrant connections and service laterals were all developed per District standards. Extensive traffic detour plans and coordination with Caltrans regarding pipe alignment, was necessary to obtain the encroachment permit during the design phase. The proposed pipe alignment by MBF Consulting resulted in the successful and timely acquisition of the Caltrans permit allowing the construction to proceed with no delays or cost overrun. 2006-2007 Capital Improvement Projects MBF provided engineering design services for the Laguna Beach County Water District's 2006-2007 CIP Projects. The CIP consisted of Cast Iron Pipe Replacement and System Enhancement projects throughout the District. Cast Iron Pipe Replacement portion of the work included: ➢ Replacing 300 lineal feet of 6 -inch cast iron pipe and appurtenances with 6 -inch PVC pipe in Wilson Street at EI Bosque. D System Enhancements portion of the work included: D Installation of 1300 lineal feet of 8 -inch PVC pipe and appurtenances in Cerritos Drive. ➢ Installation of pressure regulating station in Panorama Drive at Eleanor Lane. Laguna Canyon Road Pipeline Enhancement (Parallel Installation) MBF provided engineering design and construction support services for the enhancement of an existing 8 -inch cast iron water pipeline in Laguna Canyon Road. The project consists of approximately 3000 lineal feet an 8 -inch PVC pipeline to be constructed parallel to the existing cast iron pipe to improve system capacity and increase fire flow. Connections details between the two parallel pipelines, new fire hydrant connection details as well as service connections and distribution lateral details are included in the design. The 12" and 16" pipelines are constructed in Railroad Canyon Road whereas the PRS was constructed in a gated community in the City of canyon Lake The remaining pipes are constructed in the City of Lake Elsinore and the Riverside County. The goal of the project was to improve the system pressure and reliability. The project required extensive utility research and coordination with existing facilities within the project area and continuous communication with the affected utility companies and public agencies. MBF obtained encroachment permits for construction from Riverside County, City of Canyon Lake, and City of Lake Elsinore. Laguna Canyon Road (SR 133) Pipeline Replacement, Laguna Beach, Ca. - Project Manager for design, construction documents preparation and construction management of approximately 5,000 If of 8 -inch pipeline project in Laguna Canyon Road (SR 133) within the Caltrans right-of-way for the Laguna Beach County Water District. This project required extensive traffic detour plan preparation and coordination with Caltrans and the City of Laguna Beach. Project was designed within budget and schedule. This project started on Newport Boulevard at The Masters Circle and extended on Bristol Street all the way to the Red Hill /Santa Ana Avenue. This pipeline was constructed to create a loop system and to remove an existing pipe and reservoir that were encumbering the old Santa Ana Heights headquarter property allowing for redevelopment of the property. Project required coordination with the businesses along Bristol Street and reconnection of all existing meters to the new pipeline. Commercentre Drive Reclaimed Water Upsizing, lake Forest, Ca. - As Designer, Dennis prepared construction documents (PS&E) for replacement and upsizing of approximately 2,000 lineal feet of an 8 -inch ACP reclaimed water line with 12 -inch PVC pipe in Commercentre Drive in the City of Lake Forest. Design and construction of this project required extensive coordination with the County of Orange and the City of Lake Forest due to the Alton Parkway Extension Project and the city's pavement rehabilitation project that were under way at the same time. A highline was designed and installed to provide temporary irrigation service during construction. Traffic control plan preparation, city encroachments permit acquisition, and construction support services were also provided by Dennis for this project. Corner Stone Water Loop Pipeline, Laguna Hills/Laguna Niguel, Ca. - As Designer, Dennis prepared construction documents (PS&E) for of approximately 1300 lineal feet of a 12 -inch diameter PVC C900 Zone 650 domestic water pipeline. This pipeline extends in Moulton Parkway (north of Avila) to Nellie Gail Road and runs easterly in Nellie Gail Road and ties to an existing pipeline in Lost Colt. The pipeline alignment crosses boundaries of both the City of Laguna Niguel and Laguna Hills as it crosses the Caltrans right-of-way while extending under the San Joaquin Toll Road in Mouton Parkway. Extensive coordination with Caltrans, City of Laguna Hills and City of Laguna Niguel to obtain encroachment permits was required. Pogo 30 R= W San Juan Creek Recycled Water Pipeline Project Sand Canyon Zone 3 Pipe Replacement Crossing I- 405 Freeway, Irvine, Ca. - Dennis, as Designer, prepared construction plans for approximately 1,100 If of a new 36 -inch CML&C welded steel pipe and 700 If of a 48 -inch steel casing across 1-405 at Sand Canyon Avenue by conventional Jack& Bore method of construction. Dennis also collected data from utility companies and investigated potential conflicts with the proposed pipe alignment. Project required detailed traffic control plans as well as extensive coordination with other utilities since the Foothill Parkway is a utility corridor for wet and dry utilities including a 108" MWD water transmission main. 20" Water Line in Chase Drive and Foothill Parkway, City of Corona - Designer responsible for preparation of construction plans for water line consisting of over 2200 feet of 20 " DIP in the city of Corona. Project required detailed traffic control plans as well as extensive coordination with other utilities since the Foothill Parkway is a utility corridor for wet and dry utilities including a 108" MWD water transmission main. Responsibilities also included traffic detour plan preparation. IRWD Zone 4/LAWD Zone 1 Domestic Water Interconnections, Irvine, Ca. - As Designer, Dennis prepared project base map and developed construction plans for final construction plans for the interconnection facilities between the Irvine Ranch Water District's Zone 4 and Los Alisos Water District (LAWD) Zone 1 water transmission mains. The project consisted of 650 lineal feet of 12 -inch PVC and Ductile Iron pipes. A portion of the pipe is to be constructed by Jack and bore with a 20- steel casing as it crosses deep under a county drainage facility. The project also includes a motor operated valve vault. The motor -operated valve vault facility was constructed in the Cities of Irvine while the connecting pipelines are located both in the Cities of Lake Forest and Irvine.
