San Juan Capistrano Classified Employees Association
THIS AMENDMENT to the Memorandum of Understanding between the City of
San Juan Capistrano ("City") and the San Juan Capistrano Classified Employees
Association ("Association") is made and entered into, to be effective the 17th day of
September, 2013, as follows:
AMENDMENT
The City and Association agree to amend the Memorandum of Understanding
between the City and Association as follows:
Section XXIII. HOLIDAYS
Christmas to New Year's City Hall Closure:
City Hall will be closed from the Christmas Eve holiday through the New
Year's Day holiday beginning with the Christmas Eve holiday in 2012 and
beginning December 23, 2013, through the 2014 New Year's Day holiday.
Employees shall use appropriate accrued paid leave (not sick leave), or
leave without pay to cover the closed days that would otherwise be work
days. The closure during these periods may be rescinded by the City
Council if, in their collective judgment, significant community feedback is
received. in opposition to the closure. The City Council shall provide the
Association with eleven months advance notice of their decision to rescind
the closure of City offices.
Certain employees will be required to work to provide essential services.
Essential services required to be provided during the closure will be
determined by the City no later than July 1 of each year and notification
will be provided to the employees required to work during the closure.
Employees required to work during the closure would not be required to
use paid leave during the closure and would be compensated at time and
one-half for those hours worked on regular work days.
All other provisions of the Memorandum of Understanding not amended
hereunder shall remain in full force and effect.

Consideration of an Amendment to the Memoranda of Understanding -
San Juan Capistrano Classified Employees Association (CEA) and San
Juan Capistrano Management and Professional Employees Association
(MPEA) to Close City Hall for an Additional Day on December 23, 2013,
During the Holiday Closure.
RECOMMENDATION:
By motion,
1. Approve an Amendment to the Memorandum of Understanding with the San
Juan Capistrano Classified Employees Association; and,
2. Approve an Amendment to the Memorandum of Understanding with the San
Juan Capistrano Management and Professional Employees Association.
EXECUTIVE SUMMARY:
Per the terms of the current Memoranda of Understanding with the Classified
Employees Association (CEA) and the Management and Professional Employees
Association (MPEA), City Hall will be closed from Tuesday, December 24, 2013,
through Wednesday, January 1, 2014. The City has reached an agreement with CEA
and MPEA to close City Hall an additional day, Monday, December 23, 2013.
Employees will use accrued paid leave or leave without pay, so there is no additional
cost impact to the City.
DISCUSSION/ANALYSIS:
The Memoranda of Understanding with CEA and MPEA state that City Hall will be
closed from the Christmas Eve holiday through the New Year's Day holiday. Certain
employees will be required to work to provide essential services in the same manner as
was done with Furloughs and closures in previous years. Employees shall use

appropriate accrued paid leave (not sick leave), or take leave without pay to cover the
closed days that would otherwise be work days. This year, City Hall is scheduled to be
closed from Tuesday, December 24, 2013, through Wednesday, January 1, 2014. The
City has reached an agreement with CEA and MPEA that City Hall will be closed an
additional day, beginning Monday, December 23, 2013. Employees shall use
appropriate accrued paid leave (not sick leave), or leave without pay to cover the
additional closed day that would otherwise be worked.
FISCAL IMPACT:
Because the leave is unpaid, there is no fiscal impact to the City. Employees shall use
accrued leave, which has already been earned by the employee, or leave without pay.
ENVIRONMENTAL IMPACT:
Not applicable.
PRIOR CITY COUNCIL REVIEW:
• On February 7, 2012, the City Council approved the Memorandum of Understanding
with the San Juan Capistrano Classified Employees Association.
• On February 7, 2012, the City Council approved the Memorandum of Understanding
with the San Juan Capistrano Management and Professional Employees
Association.
