(City Council Fiscal Years 2012-2013 and 2013-2014 Additional Priorities) ·RECOMMENDATION: Receive and file. EXECUTIVE SUMMARY: On August 7, 2012, the City awarded a construction contract for the Sun Ranch. Drainage Improvement Project to Spiess Construction Co. Inc., in the amount of $2,094,645.25. Work commenced, after mobilization of equipment and materials, on September 17, 2012. The 150 calendar day contract completion requires that work be finished by February 2013. To date the City has approved 5 additional days to the contract due to additional work and rain delays. The current scheduled completion date is therefore March 5, 2013. Any unapproved extra days will be assessed as liquidated damages in the amount of $500/day. The project is currently on schedule and within budget. DISCUSSION/ANALYSIS: Spiess Construction has moved forward steadily on performance of the contract. See Schedule, Enclosure 1. To date they have completed the following tasks: • Construction of the box culvert which ties to the existing storm drain in Del Obispo Street. • Construction of the junction structures and catch basin which tie to the box culvert. • Removal of vegetation and trees within the City storm drain easement. • Over-excavation and removals of. poor soils within the project limits. • Installation of the canyon sub-drain. City Council Agenda Report December 11, 2012 Pa e 2 of 4 • Import and backfilling in the over-excavated area. • Installation of 1,000 feet, of the proposed 1 ,500 feet, of 48 inch storm drain line. • Construction of two manholes and two junction structures in the lower reach. During the over-excavation for the middle reach of the project, the contractor uncovered a 300 foot long area of very wet and heavy clay soil material. Consultations with the project geotechnical engineer and the City's geotechnical representative recommended the removal of this material to native bed rock (Capistrano Formation) or terrace deposits and installation of a sub-drain to remove the subterranean water. The over-excavation, being a bid schedule item, will be computed with the removals for the rest of the project. We expect that there will be savings in some areas that may compensate for the additional soil removals in the middle reach. The installation of the sub-drain represents a change in the scope of work and the contractor has requested a change order in the amount of $6,578 to perform this work. The additional removals and backfilling will require further improvements within effected properties in the middle reach. Staff is currently working out the details of the replacement of existing landscaping and hardscape with the owners of these properties. These changes to the project will fall within the approved contingency amount. Completion of the pipeline installation is scheduled for mid-December. Installation of the retaining wall and grading for the access road and streambed will be starting shortly thereafter. The project is on schedule to meet the early March completion. FISCAL IMPACT: The anticipated total cost for the project based upon the construction contract and required other services is: Construction (Spiess Construction) Construction Contingency (10%) Construction Engineering Support (Hall & Foreman) Biological Monitoring and Mitigation Oversight (5 Years) (GLA) Cultural, Archeological Resource Monitoring (Cogstone) Habitat Area Maintenance (4 years) (Pacific BioScience) 10% Contingency on Support Agreements Staff Costs (Project Management, Inspection, Admin. Services) Total Project Cost $2,094,645.25 209,464.00 35,150.00 57,270.00 32,234.00 25,920.00 15,000.00 60,000.00 $2,529,683.25 The contractor has submitted, and staff has approved two progress payments to date totaling $509,948. The project costs are currently within the budgeted amount. ENVIRONMENTAL IMPACT: This project has been evaluated by the City's Environmental Administrator in accordance with Section 21080(c) of the California Environmental Quality Act (CEQA). City Council Agenda Report December 11, 2012 Pa e 3 of4 At its June 19, 2012, meeting, City Council adopted a resolution approving a Mitigated Negative Declaration for the project. Due to the fact the project is located within an existing natural drainage; the City was required to acquire the following agency approvals: • Approval of a Section 1600 Streambed Alteration Agreement by the California Department of Fish and Game (CDFG). • Approval of a Section 404 Permit by the United States Army Corps of Engineers (USACOE). • Approval of a Section 401 Water Quality Certification by the California Regional Water Quality Control Board (CRWQCB). Staff received the CDFG approval on March 21, 2012. USACOE and CRWQCB permits and certifications were received on October 2, 2012. Some of the grading work must extend past the limits of the City's storm drain easement requiring the City to secure temporary construction license agreements to allow access and work within the surrounding private properties. Staff has secured agreements with each of the 16 property owners that border the project. PRIOR CITY COUNCIL REVIEW: • On May 17, 2011, the City Council approved the design contract with Hall & Foreman, Inc. for the design of the project. • On June 19, 2012, the City Council approved the plans, specifications and estimates for the project and adopted a resolution approving a Mitigated Negative Declaration. • On August 7, 2012, the City Council awarded the construction contract for the project to Spiess Construction in the amount of $2,094,645.25. • On September 4, 2012, the City Council City entered into Personal Services Agreements for Construction and Bid Support Engineering, Archeological, Paleontological and Native American Monitoring, Biological Oversight and Monitoring, and Habitat Restoration Maintenance prior to commencement of construction. COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS: • Staff held a Stakeholder Scoping Meeting for this project on March 13, 2012. The meeting was noticed to all residents within 500 feet of the project. Staff presented the project and took comments and questions from the 10 residents that attended. The Planning Commission recommended that the City Council adopt a Mitigated Negative Declaration for the project. • Staff presented this project to the Utilities Commission at its July 17, 2012, meeting. There were no comments by the Commission. NOTIFICATION: A public meeting notice has been mailed to all property owners (as listed on the Orange County Real Property Tax Assessment rolls) which lie adjacent to the project.
