SUBJECT: Consideration of Approving the Second Amendment to the Personal
Services Agreement with Management Partners to Perform Professional
Public Works Consulting Services.
RECOMMENDATION:
By motion, approve the Second Amendment to the Personal Services Agreement with
Management Partners to Perform Professional Public Works Consulting Services.
EXECUTIVE SUMMARY:
The City contracts with Management Partners for an Interim Public Works Director.
Staff recommends that the City Council approve an amendment to the Personal
Services Agreement by increasing the contract amount by $100,000, for a total cost not
to exceed $200,000, through April 30, 2013. This will allow the City to continue to
procure professional public works consulting services to continue to work on
transportation projects and advise the City on public works activities.
DIS CUSS I ON/ANALYSIS:
The Public Works Director position is vacant and the Assistant Public Works Director is
on a leave of absence, therefore, the City of San Juan Capistrano is contracting with
Management Partners to provide the City with an Interim Public Works Director. On
May 1, 2012, the City and Management Partners entered into a Personal Services
Agreement, for a cost not to exceed $25,000. Jim Ross, who has over 40 years of local
government experience in the field of Public Works, has been providing this service
since May 9, 2012. Mr. Ross is representing the City on key transportation projects and
advising the City regarding the operations of the Public Works department.
With the extension of the Assistant Public Works Director's leave of absence, the City
increased the contract amount on June 19, 2012, by $75,000, for a total amount not to

exceed $100,000. The Assistant Public Works Director's leave has been extended
again and he is not expected to return prior to December 31, 2012. Staff recommends
that the City Council amend the Personal Services Agreement with Management
Partners by increasing the contract amount by $100,000, for a total cost not to exceed
$200,000. Mr. Ross' leadership and expertise are needed to ensure critical projects are
completed and to perform professional public works consulting services.
FISCAL IMPACT:
Through October 18, 2012, the City has paid $70,444 towards the amount not to exceed
$100,000. The recommended Second Amendment will increase the Personal Services
Agreement contract amount by $100,000, for a total cost not to exceed $200,000,
through April 30, 2013, incurred at a rate of $140.00 per hour. This increased contract
amount is offset by $235,370 in salary and benefit savings in the Public Works Adopted
Fiscal Year 2012/2013 Budget.
