RECOMMENDATION By motion, approve the Orange County Conservation Corps (OCCC) contract for conducting Invasive plant removal and habitat restoration work for the 2C Ranch/Trabuco Creek Habitat Restoration Plan and authorize the City Manager to execute an agreement with OCCC for $70,320 to be fully funded with Measure M, Caltrans Cooperative, and Habitat Conservation Fund Grant monies (Note: no City monies will be used and all work will be funded by grants/awards). SITUATION The City has secured a proposal from the Orange County Conservation Corps (OCCC) for the completion of invasives removal and habitat restoration work required by the 2C Ranch/Trabuco Creek Habitat Restoration Plan. That habitat restoration plan, prepared by Derek Ostensen & Associates, the City's open space and conservation consultant, has been prepared to comply with the implementation requirements of several grant/award funding sources the City has secured over the past year. Staff recommends that the City Council authorize the City Manager to execute an agreement with Orange County Conservation Corps (OCCC) for $70,320 to be fully funded with Measure M, Caltrans Cooperative, and Habitat Conservation Fund (HCF) Grant monies with no City funds to be used (see Attachment 1, Draft Agreement with Orange County Conservation Corps). BACKGROUND In 2008, the Orange County Transportation Authority (OCTA) Board allocated $243.5 million, or approximately 2% of the total anticipated "M2" funds, to mitigate the environmental impacts of freeway improvements through the Mitigation and Resource Protection Program (MRPP). These funds are to be allocated through a competitive review process intended to provide comprehensive, rather than piecemeal, mitigation for OCTAs transportation improvement impacts. In September 2010, the OCTA Board awarded the City of San Juan Capistrano a habitat restoration grant of $1.5 million for the 2C Ranch/Trabuco Creek Habitat Restoration Area. The OCTA award supplemented previous funding allocations of $100,000 from the 2009 Habitat Conservation Fund Agenda Item page 2 Febru.ary 1 2011 program and $150,000 from a Caltrans Cooperative Agreement. The multiple funding sources supporting implementation of the 2C Ranch/Trabuco Creek Habitat Restoration Plan will provide substantial open space benefits, including improvement of public trails, enhancement of open space viewsheds, removal of significant litter and debris from public wilderness areas, increased wildlife and biodiversity and improvement of water quality and sensitive natural resources. In addition to these benefits, staff notes that the 2C Ranch/Trabuco Creek Habitat Restoration Project will enhance the City's ability to obtain acquisition grants to purchase additional open space properties in the Northwest Open Space. Restoration projects increase the habitat value of the Northwest Open Space, thereby strengthening the City's ability to compete for and receive Measure M and other third-party acquisition funding. The Orange County Conservation Corps serves young, at-risk adults through employment, training and educational programs that build self-sufficiency and benefit the community through conservation-related projects. The OCCC's approach to employability teaches teamwork and cooperation by _using work projects that are beneficial to the community and the environment and by creating an atmosphere where corps members have the chance to develop on an educational, professional and personal level (see Attachment 2, OCCC Annual Report 2008-2009). The OCCC performs various conservation and environmentally related services including: • Restoration of wetlands, fish and wildlife habitat. • Beverage container recycling. • Fuel load reduction and reforestation. • Urban tree planting and environment enhancement. • Transportation enhancement and other infrastructure projects. ® Construction and maintenance of park facilities. • Energy conservation and alternative energy retrofits. • Disaster response for such events as wildland fires and floods. Because OCCC is a quasi-public, not-far-profit organization, they are exempt from the State's and County's competitive bid selection process. OCCC's non-profit status also often results in considerably reduced cost for the work they perform when compared to private contractors. FINANCIAL. CONSIDERATIONS The OCCC contract will be exclusively funded using the following grants and awards that have been made to the City and will require no City funds: • OCTA's $1,500,000 habitat restoration and enhancement award. ® A $150,000 contract with Caltrans approved by City Council in July 2010 to fund habitat restoration improvements along Trabuco Creek. • A $100,000 Year 2009 Habitat Conservation Fund (HCF) Program grant. Agenda [tem page 3 February 1 2011 The Orange County Conservation Corps (OCCC) bid proposal includes a $100,000 CALGRIP (California Gang Reduction, Intervention & Prevention) Grant for trail improvements and habitat restoration labor. This CALGRIP grant was awarded separately to OCCC; however, they have proposed to use a portion of their grant towards the 2C Ranch/Trabuco Creek Habitat Restoration Plan. The purpose of the CALGRIP grant is to expand OCCC's involvement with South County young adults, thus the 2C Ranch/Trabuco Creek Restoration project makes sense to OCCC as a partnership with the City of San Juan Capistrano and a logical use of their CALGRIP funds. Accordingly, while the OCCC contract would be funded with $70,320 in City of San Juan Capistrano grant funds, OCCC will provide the City with a total of $173,136 in work effort implementing the 2C Ranch/Trabuco Creek Habitat Restoration Plan. The specific scope of work for the OCCC contract adheres to the 2C Ranch/Trabuco Creek Restoration Plan and involves removal of invasive species (artichoke thistle, mustard, arundo, etc.) within a 13 acre portion of Trabuco Creek and throughout a 40 acre hillside portion of the 2C Ranch. OCCC crews will also clear and repair existing public trails, including repair of flood-damaged areas as directed by City staff and the City's open space consultant. OCCC crews will use Land tools, brush chippers and chain saws to perform their scope of work. On-site supervision will be maintained at all times by OCGC managerial staff and the City open space consultant. OCCC crews have been trained in low-impact work methods to ensure sensitive open space resources are protected during their work. Between the $1.5 million OCTA restoration award, the $150,000 Caltrans funds, the $100,000 State Habitat Conservation Fund Program grant, and the $100,000 Conservation Corps CALGRIP grant, the implementation of the restoration project will be fully grant funded and will not require any direct, out-of-pocket restoration costs by the City. PUBLIC NOTIFICATION Public notification has been provided through posting of the meeting agenda. RECOMMENDATION By motion, approve the Orange County Conservation Corps (OCCC) contract for conducting invasives removal and habitat restoration work in conjunction with the 2C Ranch/Trabuco Creek Habitat Restoration Plan and authorize the City Manager to execute an agreement with OCCC for $70,320 to be fully funded with Measure M, Caltrans Cooperative, and Habitat Conservation Fund Grant monies.
