10-0119_TETRA TECH, INC._Personal Services Agreement 1st AmdFIRST AMENDMENT TO PERSONAL SERVICES AGREEMENT THIS FIRST AMENDMENT TO THE PERSONAL SERVICES AGREEMENT between the CITY OF SAN JUAN CAPISTRANO ("City") and TetraTech, Inc., ("Consultant") is made and entered into, to be effective the 4th day of June, 2010, as follows RECITALS WHEREAS, the City and Consultant have entered into that Personal Services Agreement dated January 19, 2010 for Engineering Design services (the "Agreement"); and WHEREAS, the City and Consultant desire to amend the terms of the Agreement as provided hereunder. AMENDMENT NOW, THEREFORE, in consideration of the promises and mutual covenants contained therein, City and Consultant agree to the amend Sections 1, 2, and 3 of the Agreement as follows: Section 1. Consultant shall provide Construction Engineering Support for the project, including review of submittals, construction methods, post construction videos, and requests for information and changes to the project. Consultant will conduct monthly progress meetings. Consultant will perform a final job walk and prepare a project punch list. Consultant will prepare as -built record drawings and necessary changes to the project specifications. Services shall not include full-time inspection services or materials testing. Section 2. All services required shall be completed by October 30, 2010. Section 3. The total compensation for the services shall be increased by $13,040. All other provisions of the Agreement not amended hereunder shall remain in full force and effect. West Curry, Assistant Utilities Director SUBJECT: Consideration of Amendment No. 1 to the Personal Services Agreement for Civil Engineering Services for Hydraulic Capacity Project No. 1 (CIP 07703) (Tetra Tech) RECOMMENDATION: By motion, approve Amendment No. 1 to the Personal Services Agreement for Civil Engineering Services for additional work on Hydraulic Capacity Project No.1 to Tetra Tech, Inc. in the amount of $13,040; and authorize the City Manager to execute the agreement. SITUATION: In May 2009, the City entered into an agreement with Tetra Tech, nc. to provide design services to complete the Civil Engineering on Hydraulic Capacity Projects No. 1 &6 (CIP 07703). This $45,000 contract was to complete the preliminary plans developed by LAN/Carrollo. In January City Council approved a $40,065 amendment to the contract to add the design for the rehabilitation of an additional 5,000 L.F. of pipeline and 50 manholes. City Council approved the Plans and Specifications in March. The project was bid out in April and award was made in May. The scope of work in the agreement only provided for design services. Staff desires to have Tetra Tech perform Construction Support for this project, including review of submittals, construction methods, post construction videos, and requests for information and changes to the project. Consultant will conduct monthly progress meetings. Consultant will perform a final job walk and prepare a project punch list. Consultant will prepare as -built record drawings and necessary changes to the project specifications. Services shall not include full-time inspection services or materials testing. This work as well as construction management will be provided in-house. Staff recommends approval of a PSA Amendment in the amount of $13,040 for these services. Tetra Tech is prepared to begin work, including review of recently submitted Shop Drawing submittals, immediately. FINANCIAL CONSIDERATIONS: The fiscal year 2009/20010 budget for the Hydraulic .Capacity Projects No. 1 & 6 (CIP #07703) is $3,198,043. The amount of the Tetra Tech request for amendment for this project is $13,040, and within the amount budgeted.
