04-0316_WILLDAN_Personal Services Agreement Amd No. 1. AMENDMENT NO. 1 TO PERSONAL SERVICES AGREEMENT THIS FIRST AMENDMENT TO THE PERSONAL SERVICES AGREEMENT between the CITY OF SAN JUAN CAPIST 10 ("City"l and WILLDAN ("Consultant") is made and entered into, to be effective the day o`, 2009, as follows. RECITALS WHEREAS, the City and Consultant have entered into that Personal Services Agreement dated March 18, 2004 for a total of $261,810.00 for the preparation of plans and specifications for the Del Obispo Street Circulation Improvement and Bridge Widening over Trabuco Creek from Alipaz Street to Los Rios Street (the "Agreement"); and WHEREAS, the City and Consultant desire to amend the terms of the Agreement as provided hereunder. ITILIAZIPIM:Q11111 NOW, THEREFORE, in consideration of the promises and muted covenants contained therein,. City and Consultant agree to the amend the Agreement to add to the Scope of Work, extend the term, and increase the total compensation amount as follows:. Section 1. Scope of Work The scope of work to be performed by the Consultant shall consist of those tasks as set forth in the original personal service agreement with the addition of those tasks as set forth in Exhibit "A," attached herewith and incorporated herein by reference. 2010. Section 2. Term The term of the Agreement is hereby extended to the new completion date of July 1, Section 3. Compensation 3.1 Amount. The City hereby agrees to pay the additional sum of Two Hundred Nineteen Thousand Four Hundred and Ten Dollars ($219,410.40) for a revised total not to exceed contract price of Four Hundred Eighty One Thousand Two Hundred and Twenty Dollars ($481,220.00) to Consultant for those services performed as set forth in Exhibit "A". 3.2 Method of Payment_ Subject to Section 3. 1, Consultant shall submit monthly invoices based on total services whim have been satisfactorily completed for such monthly period. The City will pay 540028.1 monthly progress payments based on approved invoices in accordance with this Section. The City eliminates the Rate Schedule subsection of the original agreement. Section 4. Entire Agreement This Amendment constitutes the entire understanding and agreement between the parties with respect to those additional services described herein and any other understandings, oral or in writing, are hereby superseded. Section 5. Other Terms All other provisions of the Agreement not amended hereunder shall remain in full force and effect. PROJECT UNDERSTANDING The City of San Juan Capistrano is requesting the revision 'of the Del Obispo Street Bridge Widening Over Trabuco Creek Bridge Project Traffic StWdy dated December 1, 2006 (Revised) to support the environmental documentation being dared by the City. The report will be revised based on new traff~rc data and the following criteria: • The project is expected to be constructed in the Year 2009 • A one percent growth factor will be applied to new existing count data to obtain Opening lay (Year 2009) volumes and future volumes Year 2035. B. SCOPE OF WORK Task 1.0 Traffic & Queueing Counts The work effort necessary to update the traffic study and evaluation is as follows: a. Obtain current count data at the four study intersections of • Del Obispo Street at Alipaz Street • lel Obispo Street at Paseo Adelarnto • Cel Obispo Street at Los Rios Street • Del Obispo Street at Camino Capistrano Per the City's guidelines, the counts wiH be conducted in the AM (7-9), Midday (11-1) and PM (3-6) peak hours. These counts will be performed on a Tuesday, "Wednesday and Thursday and the average of the three days will be utilized within the report The counts will be conducted while school is in session and before the summer months. b. 24-hour directional count on Del Obispo between Atipaz Street and Paseo Adelanto will also be conducted over a three day period. c_ A queuing count MR be performed for all Teff tum movements at each intersection court. Information such as the number of vehicles in the packet, the number of vehicles queued into the through lane and how many vehicles miss the cycle will be provided_ Page 2 ATTACHMENT A DEL OBISPO STREET" BRIDGE WIDENING OVER TRABUCO CREEK TRAFFIC ANALYSIS AND REPORT Task 2.0 Traffic Analysis & Report a. ,Analysis will be performed at each of the four study intersections: Del Obispo Street at Alipz Street, Del Obispo Street at Paseo Adelanto, Del Obispo Street at Los Rios Street and Del Obispo Street at, Camino Capistrano for the following conditions: • Existing with Existing Geometrics • Opening Day (Year 2009) with Earisting Geometrics • Opening Day (Year 20109) with Proposed Geometrics • Year 2035 with Existing Geometrics • Year 2035 with Proposed Geometrics . This analysis will be performed to determine the Level of Service at each of the intersections listed above utilizing the Intersection' Capacity Utilization (ICU) methodology for the signalized intersections and HCS for the non -signalized intersections. The Opening Day and Year 2035 analysis both with and without the project will also be analyzed utilizing SYNCHRO. . b, Previous comments made by City Traffic Engineer (Alan Oswald) dated 9218106 and the subsequently City apprpved Table 2 LOS Delay revisions provided to Mr. Oswald on 9122107 pertaining to the Traffic Analysis (Inter 1, 20106 — Revised) will be int orporated into the updated analysis and report c. Prepare a Draft Report to be submitted to the City for review and comment. d. Respond to City review comments, revise report accordingly and submit a Final Report. (This proposal incorporates one review process-) Task 3.0 Meetings Two 'V ildan employees will attend two meetings vuith City staff. One meeting will be held subsequent to City review of the Draft Report submittal to discuss City review comments. The second meeting will be held at the Final Report submittal to discuss the findings and conclusions. Willdan will.prepare and distribute meeting notes fair the first meeting. Task 4.0 Project Management & Administration This task includes progress monitoring and supervising to facilitate: task completion and delivery, coordination with proposed Del Obispo Street design worts and maintenance of project files. SCHEDULE In order to provide counts -outside the summer months, counts must be completed before June 1, 200& We would be prepared to begin work on this study upon recut of authorization. As Wtlklan and the City remobilize the design efforts on this accelerated schedule, a review of the project design status is needed starting from the end of 2014, when the work effort stopped, and what has transpired over the last year since the completion of the PACE report for San Juan Creek. Additionally, a review of the Scope of Work (Exhibit A of Personal Services Agreement dated March 16, 2004) and the world effort to complete the project design in May 2009 is also needed. .However, to expedite the project schedule and design work effort,. Wildan would like to initially address two preliminary engineering tasks that are the base work for subsequent design tasks: Task 3 - SurveyfRight of Way engineering and Task 5 - Geotechnical Engineering. Geotechnical Engineering (Task 5) is addressed in this request for additional work. Survey/Right of Way Engineering (Task 3), as well as other task updates, will be addressed in ford-ocarning requests. Liquefiable Soil Investigation and Analysis The original geotechnical field investigation and analysis was performed in 2004. Subsequent to the initial field investigation, Wlldan Geotechnical discovered liquefiable soils in Trabuco Creek at the Del Obispo Street. Bridge. The presence of liquefiable soils was not anticipated and, as a resr_ilt, additional field investigation and analyses was necessary toquantify the seismically -induced settlements due to the soil liquefaction on the existing bridge foundations and the proposed bridge widening foundations. Geotechnical Engineering Update Since the completion of the field investigation and geotechnical analysis and design in 2004, seismic analysis criteria and design standards have substantially changed resuffing in a need to redo the seismic and liquefaction analysis and revise the final geotechntcal report To complete the report and provide the information necessary for bridge design, the following tasks will be performed implementing the new seismic standards: • Update seismic design parameters; • Finalize the liquefaction analyses; • Design pile foundation based on latest a)dal, uplift, and lateral loads; • Perform slope stability analysis and design for embankment slopes; • Perform settlement analysis for embankment fillw, • Finalize boring log and laboratory test result compilation; and Prepare the final report. The effort required to complete this work is 98 hours for a fee of $14,930. Task Managefndht and Coordination Task ' management and coordination was provided for the liquetaction soil investigation and analysis and Will continue to be provided for the outstandind geotechnical engineering work to complete this "task. Management activities include sdiedUling field and design work,. coordinating work between design groups and subconsultants, maintaining records of correspondence and providing quality assurance and control. The effort required to complete this work is 12 hours for a fee of $1,820. RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to Prepare Plans and Specifications for the Del Obispo Street Circulation Improvements and Bridge Widening over Trabuco Creek from Alipaz Street to Los Rios Street; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by Consultant shall consist of those tasks as set forth in Exhibit 'A" attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and proceed in accordance with Project schedule as set forth in Exhibit "D," attached and incorporated herein by reference. Services required hereunder shall be completed by no later than December 31, 2005. Section 3. Compensation. 3.1 Amount. Submittals shall be in accordance with Consultant's proposal. 3.3 Method of Payment. Consultant shall submit monthly invoices based on total services which have been satisfactorily completed and specifying a percentage of projected completion for approval by the City. The City will pay monthly progress payments based on approved invoices in accordance with this Section. For extra work not part of this Agreement, a written authorization from City is required prior to Consultant undertaking any extra work. 3.4 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to City. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the proposed construction site, and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's findings, conclusions, and recommendations with any support documentation. All reports submitted to the City shall be in reproducible format. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. City's reuse of such materials on a project other than the project which is the subject of this agreement shall be at City's sole risk. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses ordamages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property resulting from the negligent acts, errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agents, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or better. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the following minimum amounts. $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/and general aggregate. 14.2 Comprehensive Automobile Liability. c:lmyfileslagreelpersonalsvcs.wpd 01/25/00 p:\Cicy Managcr\cmgr sharedlpersonalsvcs.wpd -4- Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non - owned vehicles in the following minimum amounts: $500,000 property damage; $500,000 injury to one personlany one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit the insurance certificates, including the deductible or self -retention amount, and an additional insured endorsement to the Consultant's general liability and umbrella liability policies using ISO form CG 20 10 11 85 (in no event with an edition date later than 1990) to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.5 Errors and Omissions Coverage Throughout the term of this Agreement, Consultant shall maintain Errors and Omissions Coverage (professional liability coverage) in an amount of not less than One Million Dollars ($1,000,000). Prior to beginning any work underthis Agreement, Consultant shall submit an insurance certificate to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.6 Notice of Cance IlationlTermination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.7 Terms of Compensation. c Amyfilcsragreelpersonalsvcs.wpd 01/25/00 p:1City Managerkmgr sharedlpeEsonalsvcs.wpd -5- Consultant shall not receive any compensation until all insurance provisions have been satisfied. 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written "Notice to Proceed" verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City and Consultant shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to the other party In addition, this Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. Section 16. Notice. Task I. Project Management 1.1 Kick-off Meeting Consultant will attend a kick-off meeting with the City of San Juan Capistrano to discuss the scope of work, specific project goals, to establish the basic design standards to be used for the project, and finalize the project schedule. This kick-off meeting will also establish a line of communication between Consultant and the City's staff and obtain reference information necessary to perform the work. The City will provide utility contact information, as -built drawings, copies of supportive studies and/or reports, environmental documentation and any other pertinent information necessary to complete the work. 1.2 Project Schedule Consultant's project manager will develop and maintain a detailed project schedule, including milestones for submittals to the various agencies. The project schedule will be prepared electronically using Microsoft Project. The project schedule will be updated and submitted to the City with the progress reports. 1.3 Progress Reports Consultant will prepare progress reports and submit them to the City of San Juan Capistrano. Consultant will establish an appropriate format for the progress report to update the City on the progress to date; work to be accomplished in the next period, and potential problems areas. At a minimum, the progress report will contain the following: • Highlights of Accomplishments • Current Project Status • Actual vs. Scheduled Percentages Complete per Task • Explanation of Schedule Deviations • Problem Areas • Actions Taken to Correct or Mitigate Problems • Responsible Authority Involved • Date for Problem Resolution • Accomplishments Planned for Next Reporting Period • Special Actions Required of the City 1.4 Project Coordination and Meetings Consultant's project manager will be available to attend meetings as requested to update the City and other affected agencies, such as the Corps, and the County of Orange representatives, of the status of the project. Consultant's project manager will also be available to attend a meeting with City staff after each design submittal to review comments provided by the City, Corps, and County Agencies. Consultant will prepare and submit meeting minutes to the City as necessary. Six (6) monthly meetings will be required for this project. Consultant's project manager will coordinate work performed by direct employees and subconsultants to ensure that the progression and quality of the work is achieved. Consultant will coordinate with important Pg. I Exhibit A agents of the City, including consultants employed by the City for environmental documentation, right-of-way appraisal, negotiations and acquisition, utility relocation, legal advice, or other services related to this project. I.5 Invoicing and Record Keeping Consultant will maintain records of correspondence with Corps, OCFCD, and utility companies for easy tracking. Upon completion of the project, Consultant will make copies of the correspondence and other pertinent documents available to the City upon request. Consultant will prepare and submit monthly invoices to the City and maintain accounting records to track project budgets by task. I.6 Quality Assurance/Quality Control Consultant's project manager and designated QA/QC manager will perform a detailed review of the entire construction package prior to submitting PS&E to the City. This review will be from a constructability perspective, identifying potential change orders, need for clarifications, inconsistencies between the various disciplinary designs, or any other potential conflicts that need to be resolved prior to final submittal. In addition, QA/QC manager will review the package for format, typographical errors, and overall appearance of the PS to ensure conformance with industry standards. Task 2. Preliminary Engineering 2.1 Research and Development Consultant will obtain available as -built drawings, reports, studies, survey data and utility contact information, from the City and the County of Orange pertaining to the design of the proposed improvements. This work may involve a search of City and County archives to obtain as -built drawings. 2.2 Utility Notifications and Mapping Consultant will prepare and send utility notifications to all utility companies known to operate within the project area. These notices will be sent to the contacts provided by the City. Each notice will contain a letter requesting all available atlases, as-builts, and proposed utilities within the project limits. The requests will also include a copy of the Thomas Brothers Map pages with the project area highlighted, and a response sheet. Consultant will maintain detailed records of all correspondence with utility companies, which will be made available to the City upon request at the completion of the work. Upon receipt of utility maps from the utility companies, Consultant will prepare a digital master file in AutoCAD 2000 format depicting the location of all known underground and above ground utilities within the project limits. Municipal services such as water, storm drain, and sewer lines will also be included in the master file plan. This master file will be referenced into the design drawings to identify and mitigate utility conflicts with the proposed improvements. 2.3 Field Review Consultant will perform a review of the project site to identify design constraints within the widening areas, verify as -built information, and observe the general site conditions. Underground and aerial utilities will be identified and potential conflicts will be noted and resolved during final design. Consultant's traffic engineer will determine if any of the existing traffic equipment can be reused/relocated as part of these improvements in an attempt to reduce project costs. Existing or future direct wire interconnects will be determined and the design plans will address the need to relocate/protect in place any existing or provide conduit to accommodate any future installation across the bridge. 2.4 Geometric Plan Consultant will prepare a geometric plan at a scale of 1 "=40' in AutoCAD 2000 digital format for approval by the City of San Juan Capistrano. The geometric plan will use the aerial topographic survey, existing utilities, right-of-way, and property lines as a base plan. The drawing will depict the locations of proposed curb and Pg. 2 Exhibit A gutter, raised medians, and lane configuration. The geometric plan will be based on the desired lane configurations identified in the RFP. The geometric plan will also identify areas of required right-of-way acquisition, temporary construction easements, and slope easements using hatching and tables. ConsuItant's structural engineering team will prepare a bridge widening general plan that will show the plan view, typical cross section, and type of structure for the bridge. Task 3. Survey/Right-of-Way Engineering 3.1 Survey Control Consultant will re-establish horizontal and vertical control using found monuments, benchmarks, and record survey data obtained from the Orange County Surveyors Office. 3.2 Aerial Topography Survey Consultant will set aerial targets sufficient for 1"=20'scale aerial mapping. The project site will be flown and the data compiled in AutoCAD digital format. The topography will include 1 -foot contours. A 200 -foot wide strip along Del Obispo Street from 300 feet west of Alipaz Street to the railroad tracks east of Los Rios Street will be mapped. In addition, a 200 -foot wide strip along Alipaz Street from Del Obispo Street to 600 feet north of Del Obispo will be mapped. The topographic survey will be provided in 3-D format suitable for roadway modeling using LDD software. 3.3 Cross -Sectional Survey Using the horizontal and vertical control established in Task 3.1 above, Consultant will survey cross sections every 50 feet and at critical locations within project limits. Consultant's surveyors will survey the bridge and channel to facilitate the structural design. As part of this task, Consultant's surveyors will dip and detail the existing storm drainage catch basins and manholes, survey the locations of existing valve covers, utility covers, manholes, and pull boxes, and determine the locations of existing parkway improvements such as fire hydrants, signs, utility cabinets, signal equipment, driveways, etc. which may be impacted by the proposed improvements. 3.4 Digital Files Using the digital topography performed in Task 3.2 above, and the cross-sectional survey performed in Task 3.3 above, Consultant will prepare a digital file in AutoCAD format to be used as a base for design. A digital terrain model (DTM) will be created using the topographic information and supplemented with the cross- sectional survey. Using the cross-sectional survey and DTM, Consultant will create cross-sections of the existing roadway at 100 -foot intervals and at critical locations along Del Obispo Street. 3.5 Preliminary Right -of -Way Engineering Consultant will research available right-of-way maps, assessor parcel maps, and utility easement information within the project limits. Based on this information, a digital file will be created in AutoCAD format, showing the property lines, right-of-way, Assessor Parcel Numbers, Owners, and utility easements within the project limits. Consultant's right-of-way engineer will work closely with the lead civil engineer to determine the extent of right-of-way acquisition and temporary construction easements necessary for each parcel. Consultant will obtain title reports for up to three (3) individual parcels. 3.6 Right -of -Way Map/Plats and Legal Descriptions Consultant will prepare plats and legal descriptions for right-of-way acquisitions and temporary construction easements for up to three (3) individual parcels. Pg, 3 Exhibit A 3.7 Appraisal and Acquisition Assistance Consultant's right-of-way engineering staff will be available to assist the City with appraisal and acquisition by providing right-of-way information, copies of title reports, assessor parcel maps, and other supplementary information that we have developed or obtained during the right-of-way engineering tasks outlined above. The City will perform the necessary appraisals and acquisitions for the project and Consultant will act in a support role only for this work. Task 4. Environmental Document Environmental documentation will be provided by the City. Task 5. Geotechnical Engineering The Consultant will provide geotechnical and soils engineering services for the design and construction. The scope of geotechnical work includes: • Initial site assessment along the proposed project limits. • Review available geotechnical data. Utilizing available geotechnical reports and geology maps pertinent to the site, will determine the most appropriate locations for borings. • Obtain the necessary encroachment permits from the City and OCFCD for the fieldwork. Clearance of subsurface utilities from Underground Service Alert will be obtained prior to commencement of field exploration. • Perform a subsurface exploration consisting of drilling, logging, and sampling of hollow -stem auger borings within the proposed site improvements. Representative undisturbed and bulk soil samples will be collected at selected depth intervals and transported to our laboratory for testing. • Perform laboratory testing of representative samples to determine engineering design parameters, static and dynamic, and chemical properties of material supporting the proposed improvements. • Prepare Materials/Pavement and Foundation report, to present our conclusions and recommendations for design and construction of the proposed improvements. The reports will include Recommendations for: ✓ Foundation design at abutments and piers considering vertical and lateral load -supporting capacities and settlement potential ✓ Retaining wall design parameters ✓ Seismic design parameters in accordance with CALTRANS design criteria ✓ Corrosivity and chemical attack mitigation measures, if necessary ✓ General site grading, including sub -grade preparation, fill placement, retaining wall backfill, and site drainage Analyses and recommendations will be discussed and coordinated with the project design team during the course of the investigation. The final report will be signed and stamped by a Geotechnical Engineer (GE) and a Certified Engineering Geologist (CEG) licensed by the State of California. Task 6. Final Design Upon approval of the geometrics by the City, Consultant will proceed with final design. All PS&E's will be prepared under the direct supervision of a registered engineer, licensed in the State of California. The plans will be stamped and signed by the responsible engineer. Consultant's CAD drafters will create base plans for the project using the city -provided title block, aerial topography, survey, right-of-way, and utility master files. The plans will be produced at a standard 24"06" size. Each roadway plan will include a plan view and profile of the proposed curbs, centerline survey control, construction notes, general notes, and details necessary to construct the improvements. Match lines will be provided for continuity between individual plan sheets. Drafting will adhere to the City Drafting Standards (if available) and Industry Standards. Using aerial topography and the supplementary cross-sectional survey performed in Task 3, Consultant will develop a Digital Terrain Model (DTM) of the existing topography. Consultant will create cross-sections showing both the existing ground surface and the proposed widening using the DTM and Land Development Desktop (LDD) software for AutoCAD. These cross-sections will be used to determine preliminary profile grades of the new curb and gutter as well as the limits of grading, need for retaining walls, impacts to adjacent facilities, and earthwork quantities. The final design cross-sections will be included on separate plan sheets and made part of the construction bid set. The Caltrans Highway Design Manual (HDM) will be used as the basis for the roadway design. Since this project proposes to widen an existing roadway, some flexibility may be necessary to match the existing grades. In this case, industry standard practice for design will govern. The design goal will be to achieve at least the minimum criteria for vertical curves, grade breaks, and sight distance as outlined in the HDM. The roadway drainage design will consist mainly of surface flow within the curb and gutter, directed to existing catch basins. If existing drainage inlets are encountered within the proposed widening limits, those facilities will be reconstructed at the new curb line at the same station. A hydrology/hydraulics study for roadway drainage is not included in this scope of work as this project involves the widening of an existing roadway with no indication of having existing drainage problems. Pg. 5 Exhibit A Consultant will work closely with the utility companies and municipalities to resolve conflicts with the proposed improvements. Since the project involves widening existing roadway, there will be existing facilities, including but not limited to, pull boxes, water meters, water valves, fire hydrants, manholes, meter cabinets, etc, that will require relocation, adjustment, and/or reconstruction to facilitate the proposed improvements. Using the information obtained in Task 2.2, Consultant will determine any conflicts with the proposed design. Utilities that are to be relocated/adjusted by agencies other than the City will be notified in writing and provided a copy of our design plans. Standard detail plans will be used to supplement the design. The City's standard plans, Standard Plans for Public Works Construction (APWA), Caltrans standard plans, and the County of Orange PF&RD standard plans will all be considered and used as applicable in the design. Non-standard design details will be drafted onto the plans. Copies of the standard plans used for this project will be included in an appendix in the project specifications. 6.2 Utility Design 6.2.1 Water Line Design The Domestic Water Master Plan project E-20 calls for replacement and consolidation of the existing 8" diameter and the 10" inch diameter water lines as a new 15" diameter line. 6.2.1.1 Consultant will design a new 16" line within the Del Obispo Street Bridge deck from Alipaz Street to Paseo Adelanto. A waterline plan will be prepared depicting the proposed improvements and the removal of the existing 8" water line. The design will also include a new gate valve and reducer/expander on either end of the new line. A new isolation valve will be installed on the existing 8" line in Del Obispo Street approximately 120' west of the new valve at Paseo Adelanto and Del Obispo, The 10" line that is on the south side of the bridge will remain in place. 6.2.2 Gas Pipeline Design The Gas Company has expressed an interest in upgrading their existing 6" diameter facility through the project. Their project reference is P.F. #03-321. It is anticipated that the Gas Company will prepare its own design for incorporation into this project. 6.2.2.1 Consultant will coordinate with the Gas Company and incorporate into the design of the bridge widening an opening to accommodate the proposed 6" gas line. 6.3 Structural Bridge Engineering In concert with the preliminary street roadway layout and hydraulic study, Consultant will develop the preliminary bridge configuration "General Plan". Factors that should be considered are: • Requirements for retrofitting existing bridge structure; • Requirements for rehabilitating existing deck and joints; • Widening girder type and girder depths; • Construction staging and traffic control; and • Construction time and flood control restrictions. The general plan will be accompanied with a cost estimate and schedule. After the City's approval of the bridge general plans, the final bridge design will be performed in accordance with Caltrans bridge design practice. Because the local funding source for the project, formal bridge type selection and bridge independent check will not be required for the project.. Pg. 6 Exhibit A 6.4 Channel Design The Corps is studying the channel improvements for Trabuco Creek. The Design Memorandum shows that the Corps is proposing to use parapet wall to raise the channel embankment to pass the flood. OCFCD has commented that the bridge at Del Obispo over Trabuco Creek is hydraulically deficient and has the potential to cause channel overtopping. Consequently, OCFCD may have interest in a joint project with the City. To determine whether the City's proposed bridge widening project will be of a type that will enable a convenient joint project, details of the City's plan for bridge widening should be forwarded to OCFCD. If OCFCD determines, after reviewing the City's proposal for bridge widening that OCFCD participation is beneficial, an agreement between the City and OCFCD is suggested to allow for a jointly funded project. If a joint project is inappropriate, the City's bridge widening project can proceed via permit from the County. OCFCD will review the City's permit submittal to ensure that hydraulic conditions at the bridge are not being made worse and the proposed bridge widening work allows for construction of future ultimate channel improvements without the need for major modifications to the proposed bridge project. Consultant will work with the City, County and the Corps to provide the best solution that is possible. 6.5 Water duality Consultant's water quality specialist will coordinate with the design engineers to determine the appropriate structural BMP's to be included in the project. The incorporation of catch basin inserts in all new storm drain inlets is anticipated, so is directing flow to these inlets through the use of curbs, gutters, ditches, dikes or graded swales. Sediment transport will be minimized through landscaping along embankments. A conceptual SWPPP will be prepared to depict the minimum construction BMP's to be incorporated into the contractor's SWPPP. These may include concrete washout and containment facilities, check damage and track washout areas. Consultant will coordinate with the City to determine the maximum extent practicable for water quality BMP's to be included in this project. 6.6 Landscape Architecture 6.6.1 Site Research, Information Gathering, & Project Coordination • Consultation with City staff and all pertinent representatives regarding all street and parkway improvements. Coordinate with other disciplines, i.e., civil and traffic engineering. In addition, confirm scope of work, roles and responsibilities, work program and schedule, and confirm objectives and design goals/desires. • Collect all available data from the City and pertinent agencies. • identification of existing and proposed street and parkway elements. Assess maintenance requirements. • Research landscape and irrigation requirements and specifications for the City and all pertinent agencies. Obtain record drawings. Research utility plans along with verifying available water source(s) and water pressures. In addition, determine potentiallexisting electrical power sources for the automatic irrigation system. 6.6.2 Design Development Plans • Develop a motif for the parkway landscape improvements that is harmonious with the surroundings. In addition, strive for congruency in existing, proposed and future improvements within the parkway. Pg. 7 Exhibit A Prepare one preliminary landscape plan (colored rendering with elevations) illustrating the parkway improvements. The preliminary landscape plan will address: o Planting palette suggestions and locations for groundcovers, shrubs and trees. o Irrigation systems, i.e., point of connection, valves, sprinkler equipment and automatic controllers. o Preserve trees and/or other significant features. o Address hardscape materials, i.e., stamped colored concrete, interlocking pavers and decompose granite. o Show locations for site furnishings, i.e. benches, trash receptacles and bus stop o Identify sidewalk areas. o Identify wall locations. • Submit the preliminary landscape plan to the City and other pertinent departments/agencies for review and comments. • Upon the review and comments from the City and other pertinent departments/agencies, prepare a final conceptual landscape plan that addresses the comments from all parties. • Submit the final conceptual landscape plan to the City and other pertinent agencies for review and approval. The construction documents for the landscape parkway improvements will not commence until the City and other pertinent departments/agencies has approved the conceptual landscape drawings. 6.6.3 Construction Documents • Preliminary PS&E — 75% stage. Preliminary PS&E will be prepared in conformance with the approved design development plan. These documents will be in the required format for final approval and will be submitted to the City and other responsible parties/governing agencies. This stage of completion will establish the approved scope of work. Any significant alterations to the work following approval of the 75 percent submittal will be considered a change in scope. • Preliminary PS&E — 90% stage. Following approval of the 75% submittal, the construction PS&E will be completed in detail and submitted to the City and responsible parties/governing agencies for review and approval. • Final PS&E —100% stage. Following review and approval of the 90% stage, adjust the PS&E to conform to plan check requirements of the regulating agencies. The contract documents will be completed in a form sufficient for solicitation of competitive public bids, along with all permit compliances. • Prepare technical specifications and engineer's cost estimate regarding all aspects pertaining to the construction of all items depicted in the landscape construction documents. 6.7 Quantities and Estimate Consultant will determine the construction quantities and prepare a cost estimate based on recent bid results for similar projects and cost databases maintained by Consultant. The cost estimate will be prepared electronically in a spreadsheet format using Microsoft Excel. The quantities and cost estimate will be updated with each submittal. Pg. 8 Exhibit A 6.8 Specifications Consultant will prepare a set of technical specifications for the proposed project. Using the City -provided boilerplate specification. Consultant will combine the technical provisions and standard provisions into one comprehensive set of project specifications. The specifications will be based on "Greenbook" Standard Specifications for Public Works Construction and/or the State of California Department of Transportation (Caltrans) Standard Specifications, as appropriate, and prepared electronically using Microsoft Word. Task 7. Agency Processing 7.1 San Juan Capistrano Engineering Department Consultant will, as part of the design process, submit PS&E to the City of San Juan Capistrano Engineering Department at 75%, 90%, and 100% completion. Consultant will address comments received from the City and make the appropriate changes to the PS&E. 7.2 County of Orange PF and RD Consultant will submit, to the County of Orange PF and RD, all channel improvement and bridge plans and calculations pertaining to the improvements within the flood control right-of-way. Consultant will address comments received from the County and make the appropriate changes to the plans and calculations. An encroachment permit will be obtained. 7.3 Permitting Agencies Consultant will meet with the Corps to discuss whether or not the project as proposed would qualify for Nationwide permit, which requires the total permanent channel wetland impacts of this project be under 1/2 acre. To that extent, Consultant is available to meet with the representative of the Corps to clarify definition of permanent impacts for the project and the Corps permit requirements. The information presented to the Corps may include the precise boundary limit of Corps jurisdiction, preliminary crossing plan and profile, the bridge configuration and foundation, limit of earth movement around the channel at the crossing, channel protection limit and method, estimated wetland disturbance acreage, bridge shading discussion, and any potential mitigations, and estimated construction cost. The only the portion of the exposed channel improvements and bridge columns within Corps' jurisdiction delineations should be counted on as permanent impact. Consultant will obtain the Corps 404 Permit, the 401 Permit from the California Regional Water Quality Control Board and the California Department of Fish and Game Streambed Alteration Agreement (1601 Permit). 7.4 Final Utility Notices Consultant will transmit notice and final plans to the affected utility agencies requesting them to contact the City to coordinate any adjustments and/or relocations necessary to facilitate the proposed improvements. The City will be provided with copies of correspondences. Task 8. Post Design Services 8.1 Pre -Bid Meeting Consultant's project manager will attend one (1) pre-bid meeting to explain the project and answer questions from prospective bidders. Consultant will prepare meeting minutes and submit to the City. Pg. 9 Exhibit A 8.2 Responding to RFPs Consultant will review and respond to Requests For Information (BFI's) from prospective bidders. No direct responses to individual bidders will be made. All BFI's and responses will be made in writing and submitted through the City. SITUATION Summary and Recommendation Plans and specifications for Del Obispo Street Widening at Trabuco Creels Bridge have been prepared. Staff is requesting City Council approval of the plans and specifications, and authorization to receive bids. A copy of the plans and specifications is available for review in the City Clerk's office. Approval of the design addendum for additional work performed by Willdan is also requested. Background At the September 16, 2033 meeting, City Council adopted the Traffic Congestion Relief Program (ICRP) as recommended by the Traffic Congestion Relief Ad -Hoc Committee. This project was ranked the #1 priority in the City's TCRP. In 2005, the City retained Willdan Engineering to prepare the prefiminary design plans for the proposed project. By .lune of 2006, the conceptual plans had been completed, the environmental review was in process, and City staff was prepared to move forward Agenda Report Page 2 August 18, 2009 with completing the preliminary design. However, in order to complete the preliminary design, the Orange County Flood Control District (OCFCD) needed to provide the City's consultant, Willdan Engineering, with the hydraulic analysis to determine the bridge abutment design. Beyond the City's control, OCFCD was unable to provide that information to Willdan until August 2008. As soon as OCFCD provided that information, the City and Willdan resumed design effort, the California Environmental Quality Act (CEQA) documentation, and moved forward with Commission review. Because the federal grant for the project was in jeopardy, an accelerated project schedule had to be followed starting December 2008 to meet a construction authorization process date of June 30, 2009 by Caltrans. Willdan has submitted an addendum, Exhibit A of Attachment 2, due to extensive coordination necessary to meet the accelerated schedule, and also additional work performed to obtain the following, - 1 . ollowing: 1. County of Orange Flood Control District permit to build the bridge. 2. CalTrans approval of the project for funding. 3. Necessary Resource Agency permits (Regional Water Quality Board and Fish and Game Department), Project Overview & Analysis The width of Del Obispo Street at the Trabuco Creek Bridge is an obstruction to efficient traffic flow through this area in San Juan Capistrano. Currently, Del Obispo Street at Trabuco Creek (Attachment 1) provides four undivided lanes of travel (two eastbound and two westbound lanes), back-to-back left turn packets for Paseo Adelanto and Alipaz Street and sidewalks on both sides of the bridge. The proposed project will widen Del Obispo Street between Paseo Adelanto and Alipaz Street to accommodate the four undivided travel lanes (two eastbound lanes and two westbound lanes), back-to-back left turn pockets for Paseo Adelanto and Alipaz Street, and an additional left turn lane for Alipaz Street, along with bike lanes and sidewalks on both sides of the street. In conjunction with the road widening at the bridge, intersection improvements are also included for Del Obispo Street and Alipaz Street and Dei Obispo Street and Paseo Adelanto. The improvements include dual westbound left turns from Del Obispo Street to Alipaz Street, dual westbound left turns from Del Obispo Street to Paseo Adelanto, widening of the west side of Paseo Adelanto to approximately 500 feet south of Del Obispo Street, and adjustments to signal phasing. Undergrounding of overhead utilities will also be constructed with this project. The underground design is currently underway. Both overhead lines that cross the creek at Del Obispo Street will be removed. Cox Cable, AT&T, SDGE, and MCI will be placed inside the bridge structure. Agenda Report Page 3 August 18; 2009 ENVIRONMENTAL REVIEW The Mitigated Negative Declaration (MND) was approved by City Council by Resolution 0903-03-03 on March 3, 2009, COMMISSION/ BOARD REVIEW AND RECOMMENDATIONS The project was presented to the Transportation Commission on August 13, 2008, and they concurred with the geometric design. On October 2, 2008, the Design Review Committee reviewed the landscape and bridge railing; their comments were addressed in the final design. On February 10, 2009, the Planning Commission reviewed progress plans for the project and their comments were related to landscaping issues; their comments were addressed in the attached set of plans. FINANCIAL CONSIDERATIONS This project has secured federal grant funding of approximately $2.7 million , and prior CalTrans authorization is required to advertise and receive bids. The necessary application form and project plans have already been submitted to CalTrans for review and approval before the June 30, 2008 submission deadline. The City is required to match 50% of the project construction cost for the grant. Wilidan has requested $219,410 for the additional work performed on this project. Staff has investigated potential . changes to the project design and construction to reduce overall costs. We have concluded that by eliminating widening on the south side of the bridge and a structural pier nose, the project will result in savings of approximately $500,000 in construction costs. The details of the design addendum with Willdan is attached to the report (attachment 2). The City and Willdan had to remobilize the design effort and perform on an accelerated schedule. As a result, a great amount of coordination was necessary with Orange County Flood Control District, Caltrans, Glenn Lukos Associates (environmental consultants), and the Resource Agencies. Additional work has been performed due to changes to the following since the original scope was determined: 1.) bridge design criteria, 2.) channel analysis, 3.) enhanced BMP's, 4.) Underground Utility District, 5.) and OCFCD requirements. The requested addendum by Willdan has been negotiated by staff and overall dollar amount has been reduced.
