Apple, AICP, Community Development Director SUBJECT: Consideration of Construction Contract Notice of Completion/Release of Retention — Montanez Adobe Repair and Rehabilitation (Mark Sauer Construction, Inc.) (CIP No. 07406) RECOMMENDATION: By motion: 1. Adopt a Resolution declaring the work performed by Mark Sauer Construction, Inc. for the Montanez Adobe Repair and Rehabilitation Capital Improvement Project complete, accepted and approved; and, 2. Direct the City Clerk to process the recording of a construction Notice of Completion; and 3. Authorize staff to release the approximate 10% retention, in the amount of $16,840.01, 35 days after recordation. SITUATION: A. Summary and Recommendation: The work performed by Mark Sauer Construction Inc. for the Montanez Adobe Repair and Rehabilitation project has been completed to the satisfaction of the City Community Development Director and is ready for acceptance and recordation of a construction Notice of Completion (NOC) with the County Recorder, The NOC is directly related to the specific contract for the construction work and is evidence that the contractor completed the work pursuant to the contract. When the NOC is filed with the County, it starts a 35-day statute of limitation for stop notice claims (against contract payment retention being held by the City). After the 35-day period, the retention is paid to the contractor. B. Background: The Montanez Adobe is on the City's Inventory of Historic and Cultural Landmarks (IHCL) and is listed in the National Register of Historic Places. The site is located at 31745 Los Rios Street, within the Los Rios Street National Agenda Report Page 2 May 18 2910 Register Historic District. The work performed by Mark Sauer Construction Inc. included removal of interior visually intrusive seismic frame steel columns; removal of a visually intrusive wood beam suspended under the ceiling; structural connection of a new roof truss and diaphragm structure to steel plates and then into the adobe wails hidden in the attic space to provide the necessary roof-to-wall connections; a new historically appropriate wood shingle roof to match existing and restoration of chamfered porch posts; lead-based paint abatement; restoration of the existing wood plank ceiling and re-creation of the . hard-packed earthen floor in both rooms; re-connection of dry utilities and less obtrusive electrical and lighting; and repair of adobe brick units and plaster cracks with application of mud plaster and lime whitewash to the Adobe walls. At the November 17, 2909, meeting the City Council awarded a contract for the rehabilitation and repair work to Mark Sauer Construction, Inc. This work is now complete and ready for acceptance by the City. There were no change orders necessary in association with the construction contract. Additional work items either have been or will be completed by others now that the contractor has demobilized. This work included staff and volunteer efforts, utilizing a combination of discounted and donated materials, to install final irrigation and drought tolerant plantings in the Los Rios Park planters around the Adobe that had been within the construction area. A second phase of planting will occur again in the fall. Telephone and security system reconnections are being coordinated with the pertinent companies by staff. The City is procuring tule reeds that will be attached with leather straps to cover the underside of the porch roofs from the Juaneno Band of Mission Indians who recently harvested the tules under permit in Orange County; the reeds are scheduled to be installed over two days in late June. Lastly, staff. is developing enhanced archaeological and historic period interpretive displays for the Adobe's interior. The interior displays and interpretation will be completed within the next two months. Staff is also working to establish and manage a volunteer docent schedule to open the Adobe more often on a regular basis. Staff anticipates being able to re-open the Montahez Adobe by July 2010. In addition to the information presented in the Financial Considerations section below, a comprehensive final report on overall project completion and total costs will be provided to the City Council in the near future. COMMISSIONS/BOARD REVIEW RECOMMENDATIONS Not applicable. FINANCIAL CONSIDERATIONS: The construction contract was awarded to Mark Sauer Construction, Inc., at $168,400 and the construction work was completed for that amount.
