LEASE

This LEASE agreement is made this 9th day of June 1987, by
and between the SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT .AGENCY,
hereinafter referred to as "Lessee", and ROBERT DOLLEY, an individual, hereinafter
referred to as "Lessor",
WITNESSETH:
WHEREAS, Lessor is the owner of certain real property located within the City
of San Juan Capistrano, more particularly referred to and described in Exhibit A
attached and incorporated herein by reference; and
WHEREAS, Lessee desires to utilize said property to provide additional parking
spaces to alleviate parking demands along the east side of Camino Capistrano; and
WHEREAS, Lessor desires to cooperate with Lessee in improving the
availability of parking to the public along Camino Capistrano,
NOW, THEREFORE, BE IT RESOLVED between Lessor and Lessee as follows:
1. Lease of Real Property.
Lessor hereby leases to Lessee that certain real property referred to as Exhibit
A.
2. Use of the Property.
Lessee shall utilize said leased premises for the purpose of making additional
parking spaces available to those commercial users at the discretion of lessee to
ameliorate parking demands along Camino Capistrano. Lessor agrees that
Lessee shall have the right to improve the property by placing one or more
improvements consisting of gravel, fencing, and appropriate signing to
accommodate the parking of vehicles on said land.
3, Term.
The term of this lease shall be for a continuing period until such time as Lessor
determines to develop said property for other purposes. Lessor shall serve upon
Lessee a 90 day notice of termination prior to terminating this lease.
4. Compensation.
Lessee shall pay to Lessor ONE DOLLAR ($1.00) per year as consideration for
the possessory interest rights granted by this lease.
5, Hold Harmless.
Lessee agrees to hold Lessor harmless from any claims or liabilities that may
arise out of the course of Lessee's possession of the land.

6. Assignment Rights.
Lessee may assign this lease or any interest herein, or any right or privilege
appurtenant thereto, to use the premises for the same parking purposes
identified in this agreement without first obtaining either oral or written
consent from Lessor.
IN WITNESS WHEREOF the parties have executed this Lease on the day and
year first above written.

Dear Steve:
Enclosed is an executed temporary lease in the city's
favor to help with the parking problem for the short term.
I have inserted "not" in the last paragraph as I thought
the omission was probably a typing error. Please initial
as I have.
This lease is delivered to you with the express understanding
that it is temporary and will in no way adversely affect the
conditions of development of this property. As you know I
am in the process of development at this time. I received
the Pay Less Drug lease yesterday; and hope to be to the
city in about 60 days.
Otherwise, I am happy to cooperate.
