A COOPERATIVE AGREEMENT BETWEEN THE CITY OF SAN JUAN CAPISTRANO
AND THE CAPISTRANO VALLEY WATER DISTRICT RELATING TO
THE RELOCATION OF A WATER LINE MADE NECESSARY BY
THE CONSTRUCTION OF THE CAMINO CAPISTRANO BRIDGE
THIS AGREEMENT is made by and between the City of San
Juan Capistrano (hereinafter referred to as CITY) and the
Capistrano Valley Water District (hereinafter referred to as
DISTRICT) this 4th day of February , 1986.
WHEREAS, the CITY has arranged for substantial federal
funding for the expansion of the Camino Capistrano Bridge under
the Federal Aid Urban Program (FAU) through the County of Orange
and the Department of Transportation, State of California; and
WHEREAS, DISTRICT's pipeline must be relocated as a
result of the aforesaid bridge expansion; and
WHEREAS, the DISTRICT proposes to appropriate
sufficient funds to cover construction and administrative costs
related to such relocation and not provided for through grant
funding; and
WHEREAS, the estimated allocation of funds for the
relocation are:
Construction = $30,000.00
Contingency = 3,000.00
Construction

WHEREAS, the CITY will administer the construction of
the project and the disbursement of the aforesaid funds.

NOW, THEREFORE, IT IS AGREED by the parties hereto
I. DISTRICT shall:
A. Provide sufficient funds to complete the
relocation of a waterline made necessary by
the construction of the Camino Capistrano
Bridge.
B. Immediately following execution of this
Agreement, submit to CITY the sum of
$5,237.00, which represents the DISTRICT's
advance deposit to finance the DISTRICT's
share of the total estimated cost of work
pursuant to this Agreement.
II. CITY shall:
A. Administer the project as further defined in
CITY's Cooperative Agreement with County.
B. Upon completion of the Project, furnish the
DISTRICT with a final detailed statement of
actual expenses.

Written Communications:
Report ate Fe ruary 4, 1986, from the Director of Public
Works, forwarding an agreement to fund the relocation of the
water main located within the construction limits of the
Camino Capistrano Bridge. The relocation is eligible for
Federal Aid Urban funding at a reimbursement rate of 86.228.
The Water District will fund 13.78% of the cost; the City
will not be required to participate in funding of the
project. Federal participation was estimated at $32,713;
the Water District participation was estimated at $5,237.
Approval ofAgreement:
It was moved by Councilman Buchheim, seconded by Councilman
Bland, and unanimously carried to approve the agreement
between the City and the Capistrano Valley Water District
Relating to the Relocation of a Waterline in the Camino
Capistrano Bridge. The Mayor and City Clerk were authorized
to execute the agreement on behalf of the City.

The City Council of the City of San Juan Capistrano at its
regular meeting held February 4. 1986, approved the Cooperative
Agreement between the City of San Juan Capistrano and the
Capistrano Valley Water District relating to the relocation of a
water line made necessary by the construction of the Camino
Capistrano Bridge. The Water District's share of the cost is
$5,237.00. Water District check No. 003527 in that amount was
received February 5, 1986.

Cooperative Agreement Between the City and Capistrano
Valley Water District Relating to the Relocation of a
Waterline in the Camino Capistrano Bridge
This proposed agreement between the Capistrano Valley Water
District and City is for the purpose of funding the relocation
of the water main located within the construction limits of
the Camino Capistrano Bridge. The agreement establishes the
funding obligations of the District and the City's obligation
to administer the construction of the waterline relocation.
It is expected that the Water Board will consider action on
this agreement at their meeting of February 4, 1986.

Not applicable.
FINANCIAL CONSIDERATIONS
The District's participation is based upon participation in
the relocation of the existing waterline only. The FAU has
determined that this relocation is eligible for funding at a
reimbursement ratio of 86.22%. The District is to fund 13.78%
of the relocation cost with no City participation. The alloca-
tion of costs are indicated below:
