AGREEMENT FOR FUNDING OF MANAGEMENT OF THE
SOUTH EAST REGIONAL RECLAMATION AUTHORITY,
PROJECT COMMITTEE NO. 15 4)1 C
THIS AGREEMENT is made this oJ4 day of 1,
1982, by and between the SOUTH EAST REGIONAL RECLAMATION
AUTHORITY, a joint powers agency created and existing pur-
suant to Section 6500 and following of the Government Code
of the State of California (hereinafter referred to in some
instances as "Authority") and following agencies:
City of San Clemente ("CSC"),
City of San Juan Capistrano ("CSJC"),
Moulton -Niguel Water District ("MNWD"), and
Santa Margarita Water District ("SMWD")
The foregoing parties of this Agreement are the
participating member agencies of authority for Project Com-
mittee No. 15 (hereinafter in some instances referred to as
Che "Participating Member Agencies");
W I T N E S S E T H:
WHEREAS, Authority operates regional wastewater
collection, treatment and disposal facilities in the San
Juan Basin portion of the County of Orange; and
WHEREAS, the Authority desires to take over con-
trol of the daily operation, maintenance and administration
of its Treatment Plants; and
WHEREAS, the Participating Member Agencies of
Authority desire that the administration of the daily affairs
of Authority be conducted by a General Manager and accompany-
ing clerical staff; and
WHEREAS, the Participating Member Agencies desire
to establish Project Committee No. 15 for the purpose of
funding the position of General Manager of Authority as well
as related clerical and office staff and facilities;
follows:
NOW, THEREFORE, the parties hereto do agree as
Section 1. Authority is authorized, pursuant to
the terms and conditions of this Agreement, to hire a quali-
fied individual to serve as Authority's General Manager to
administer the daily affairs of the Authority pursuant to
direction of the majority (as defined by Authority's Joint
Powers Agreement) of the Board of Directors of Authority.
Section 2. The Authority agrees that the first
task of General Manager is to submit to the Board of Direc-
tors a plan to operate and maintain its Treatment Plants
within sixty (60) days of the date hired.
Section 3. Each Participating Member Agency shall
bear its share of the total cost of funding the position of
the General Manager as well as clerical and office staff and
facilities in accordance with a budget to be prepared by the
Participating Member Agencies and which will be adjusted each

six (6) months during the term of this Agreement.
Section 4. This Agreement shall be binding upon
the successors and assigns of each party to this Agreement,
and upon any succession or assignment the successor or
assignee shall accept and assume in writing each and every
obligation applicable under this Agreement.
IN WITNESS WHEREOF, the parties hereto have caused
this Agreement to be executed on the day and year first
hereinabove written.

2. APPROVAL OF FIRST AMENDMENT TO CO -MANAGEMENT AGREEMENT
(38) Written Communications:
(79) Report dated May 17, 1983, from the Director of Public
Works, forwarding the First Amendment to the contract
between the Aliso Water Management Agency and SERRA for
additional clarification with regard to joint liability
protection for the activities of both agencies. The report
advises that the Amendment was approved by the Project
Committee No. 15 Board of SERRA on April 14.
Approval of Agreement:
It was moved by Councilman Schwartze, seconded by Councilman
Buchheim and unanimously carried to approve Amendment No. 1
to the Agreement between SERRA, on behalf of its Project
Committee No. 15, and the Aliso Water Management Agency for
Mutual Management Services. The Council action ratifies the
affirmative vote of the SERRA representative.

(38) Written Communications:
Report dated July 6, 1982, from the Director of Public Works
forwarding an agreement to establish a management position
to administer the operations of the Treatment Plant and the
general affairs of SERRA.
Approval of Agreement:
It was moved by Councilman Friess, seconded by Councilman
Hausdorfer and unanimously carried to approve the agreement
for funding of management of the South East Regional
Reclamation Authority Project Committee #15; the City's
participatory share will be 22% of the estimated annual
cost of $145,000. The Mayor and City Clerk were authorized
to execute the Agreement on behalf of the City.
Council requested receipt of a job description for the
position of manager.

At their meeting of July 6, 1982, the City Council
took unanimous action on the following:
1. Approved the Agreement for funding of management
services at $145,000 per year. Enclosed are the
original and one copy of this Agreement; please
execute both copies and return the "City" copy
to this office.
2. Approved the budget adjustment to Capital Projects
to increase the sanitary flow meter and sampler
account to $25,000, and authorized the transfer of
$10,000 from the Sewer Enterprise Fund.

Committee #15 - Management of the South East Regional
Reclamation Authority (SERRA)
SITUATION
At their regular SERRA meeting the Board of Directors were
distributed the agreement for Project Committee #15. Five of
the member agencies were in agreement to establish a management
position to administer the operations of the plant and the
general affairs of SERRA.
In accordance with established procedures for the creation of a
project committee, the attached agreement has been prepared for
approval by those members who wish to participate. Following
adoption of this agreement at the next SERRA Board meeting,
solicitation of applicants for the administrator's position will
commence.
FINANCIAL CONSIDERATIONS
All administrative expenses have been pro rated according to
participation through the previously adopted SERRA Project Com-
mittees budgets. The total annual cost is approximated to be
$145,000.
ALTERNATE ACTIONS
1. Adopt the agreement for funding of management of the South East
Regional Reclamation Authority Project Committee #15.
2. Do not adopt the agreement.
3. Refer to staff for additional information.
RECOMMENDATION
By motion, adopt the agreement for funding of management of the
South East Regional Reclamation Authority Project Committee #15
and authorize the Mayor and City Clerk to execute the necessary
document.
