1979-0308_SERRA_Memorandum of Understanding:q_-. ,4, , MEMORANDUM OF UNDERSTANDING BETWEEN SOUTH EAST REGIONAL RECLAMATION AUTHORITY AND CITY OF SAN JUAN CAPISTRANO RELATIVE TO STAFFING OF TREATMENT FACILITIES THIS MEMORANDUM OF UNDERSTANDING is made this _day of /�L , 1979, by and between the SOUTH EAST REGIONAL RECLAMATION AUTHORITY, a Joint Powers Agency creating and existing pursuant to Section 6500 and fol- lowing of the Government Code of the State of California (hereinafter in some instances referred to as "SERRA") and the CITY OF SAN JUAN CAPISTRANO, a California municipal corporation (hereinafter in some instances referred to as "City"); W I T N E S S E T H: WHEREAS, SERRA and City have previously entered into that Agreement entitled, "OPERATIONS AND MAINTENANCE AGREEMENT FOR SERRA WASTEWATER TREATMENT PLANT", dated January Al 1979, which Agreement is on file with the Sec- retary of SERRA and by this reference is incorporated herein; and WHEREAS, said Agreement 'provides that the City shall operate on behalf of SERRA the J.B. Latham Regional Wastewater Treatment Facility at Dana Point, California, (the SERRA Treatment Plant) pursuant to the terms and condi- tions of said Agreement; and t WHEREAS, Section 8 of said Agreement provides that the City shall cause the SERRA Treatment Plant to be staffed for at least eight hours per day, every day, in- cluding Sundays and holidays but that SERRA in its discretion may elect to have the City cause the SERRA Treatment Plant to be staffed on a twenty-four hour basis; and WHEREAS, it is SERRA's desire at this time to elect to have the City staff the SERRA Treatment Plant on a twenty-four hour basis, every day, including Sundays and holidays; NOW, THEREFORE, in consideration of the mutual promises and conditions hereinafter set forth the parties do agree as follows: Section 1. City agrees pursuant to Section 8 of the hereinabove described Agreement with SERRA to cause the SERRA Treatment Plant to be staffed on the basis of twenty- four hours per day, every day, including Sundays and holi- days. Section 2. Please have the Mayor of San Juan Capistrano and the City Clerk execute all ten copies of the agreement and have them returned to us. We will secure the signature of Mr. Jeff Lodder for SERRA and then will send you a fully -executed copy of the agreement. This office is in contact with the members of SERRA's Project Committee No. 2.. As of this date, the City of San Juan Capistrano, Dana Point Sanitary District, and Moulton -Niguel Water District have approved the staffing agreement. The remain- ing members of the Committgqe are scheduled to consider the memorandum before the end df March. We will let you know when all members of the Committee have given their approval. The Council also took action to approve the SERRA budget of $90,475 for the additional personnel required to staff the plant. The City is recommending to SERRA 24-hour staffing of the plant to mitigate any future costly plant malfunctions that could happen in the evenings and any maintenance which may cause odors during the day, which could be otherwise formed at night. Attached is a copy of a Memorandum of Understanding between SERRA and the City of San Juan Capistrano. This Memorandum of Under- standing would provide for the City to operate and staff the treatment plant on a 24-hour per day, seven day per week basis. The Operations and Maintenance Agreement which has been approved by the Board of Directors of SERRA and the City Council provide for the City to operate the plant on an eight hour, seven day per week schedule. The agreement further provides for SERRA to elect to have the City operate the plant on a 24-hour per day, seven day per week basis. The Board of Directors of SERRA has indicated that it does desire 24-hour staffing of the treatment plant. FINANCIAL CONSIDERATIONS A project budget is attached to the Memorandum of Understanding and specifies a $90,475 cost for additional manpower to staff the plant on a 24-hour basis annually. Respective boards of Project Committee No. 2 must adopt this budget and the concept prior to execution by SERRA of the Memorandum of Understanding. The $90,475 is the cost for five additional personnel, including employee benefits. The present cost in manpower for the 11 member staff at the treatment plant is $217,886 annually. The total cost to SERRA and participants of Project Committee No. 2 for a 16 per- son staff is $308,361 annually. RECOMMENDATION By motion, approve the Memorandum of Understanding between the City of San Juan Capistrano and SERRA which would provide for the City to operate and staff the treatment plant on a 24-hour basis, and authorize the Mayor to execute same on behalf of the City; approve the budget in the amount of $90,475.
