That for 10 years following the date upon: which this Agreement becomes effective, CITY will not offer said property for sale. 3. That within 10 years from the date this Agreement becomes effective CITY will. either devote said property to public access purposes or reconvey the property to the State of California as provided for in paragraph 4 herein. . 4. That in the event CITY fails to devote said property to public access purposes within 10 years after this Agreement becomes effective, or CITY desires to divest itself of said property within said 10 year period, CITY will execute a deed to the State of California re - conveying to the State all the right, title and interest of the State in the property which CITY obtained by the deed executed by the Orange County Tax Collector pursuant to this Agreement. Thereafter, such property shall be held as tax -deeded property by the State. 5. That a breach of the conditions described in paragraphs 2, 3, and 4 of this Agreement shall cause said property to revert to the State of California which shall have the right of immediate re-entry upon said property, to be exercised by its agent the Orange County Tax Collector, in the event of any such breach. 6. That as provided by Section 3808 of the California Revenue and Taxation Code, CITY will not share in distribution of the "PURCHASE PRICE' paid pursuant to this Agreement to the Orange County Tax Collector. 8. That as provided in Section 3800 of the California Revenue and Taxation Code, the cost of giving notice of this Agreement shall be paid by CITY. Murphy, Director of Public Works SUBJECT: Approval of Agreement - Purchase of Tax Delinquent Property for Public Access, AP Nos. 666-120-02 and 668-230-02 SITUATION At a previous City Council meeting, action was taken to purchase tax delinquent properties designated by AP Nos. 666-120-02 and 668-230-02 for public access purposes. (See attached exhibits.) The County has been advised of this intent and subsequently, the execution of the attached agreement and adoption of a resolution are necessary to finalize this transaction. The terms of the agreement include that within ten years following the date of purchase, the City will not offer said properties for resale. That within ten years from date of purchase, the City will devote said property to the public purpose for which they acquired it. That in the event the City fails to devote said property to the stated public purpose within ten years or the City attempts to sell the property for any reason, the terms of the agreement and the deed will automatically revert the property from the ownership of the City to the ownership of the State of California. FINANCIAL CONSIDERATIONS The purchase price for both properties is $200.00, which can be allocated from the General Fund for this purpose. ALTERNATE ACTIONS 1. Authorize the purchase of the properties. 2. Do not authorize the purchase of the properties. RECOMMENDATION By resolution, authorize the purchase of tax delinquent properties designated as AP Nos. 666-120-02 and 668-230-02 for the sum of $200.00 and authorize the Mayor and City Clerk to execute the agreement on behalf of the City.
