That for 10 years following the date upon which this Agreement becomes effective, CITY will not offer said property for sale. 3. That within 10 years from the date this Agreement becomes effective CITY wilt either devote said property to public access purpoees or reconvey the property to the State of California as provided for in paragraph 4 herein. 4. That in the event CITY fails to devote said property to public access purposes within 10 years after this Agreement becomes effective, or CITY desires to divest itself of said property within said 10 year period, CITY will execute a deed to the State of California re - conveying to the State all the right, title and interest of the State in the property which CITY obtained by the deed executed by the Orange County Tax Collector pursuant to this Agreement. Thereafter, such property shall be held as tax -deeded property by the State. 5. That a breach of the conditions described in paragraphs 2, 3, and 4 of this Agreement shall cause said property to revert to the State of California which shall have the right of immediate re-entry upon said Property, to be exercised by its agent the Orange County Tax Collector, in the event of any such breach. 6. That as provided by Section 3808 of the California Revenue and Taxation Code, CITY will not share in distribution of the "PURCHAS'1,PRICE' paid pursuant to this Agreement to the Orange County Tax Collector.`�c 8. The County was advised of this intent and subsequently the execution of the attached agreement and adoption of a resolution were determined as necessary to finalize this transaction. The terms of the agreement include that within ten years following the date of purchase the City will not offer said properties for resale. That within ten years from date of purchase the City will devote said property to the public purpose for which they acquired it. That in the event the City fails to devote said property to the stated public purpose within ten years or the City attempts to sell the property for any reason, the terms of the agreement and the deed will automatically revert the property from the ownership of the City to the ownership of the State of California. FINANCIAL CONSIDERATIONS The purchase price for both properties is $100.00 which has been approved for allocation from the General Fund. ALTERNATE ACTIONS 1. Murphy, Director of Public Works SUBJECT: Tax Collector Auction Sale No. 1278 - Sale of County Owned Property within City Limits, Assessor's Parcels Nos. 666-092-05 and 675-043-01 Situation The Orange County Board of Supervisors has taken action to initiate the sale of County -owned property within the City limits. The two parcels involved are somewhat insignificant in size (see attached maps for locations) but as they are adjacent to existing public right-of-way their purchase is justifiable. The County has offered the City the first right of purchase of these parcels for the minimum bid price of $50.00 each. The terms of the agreement will include: that for ten years following the date of pur- chase, the City will not offer said property for re -sale and that within ten years from date of purchase the City will devote said property to the public purpose for which they acquired it. FINANCIAL CONSIDERATIONS The total purchase cost for these parcels will be $100.00 which will need to be allocated from the General Fund. The maintenance costs associated with this property will be nominal due to the size of the lots and the existing City maintenance being provided to adjacent properties. ALTERNATE ACTIONS 1. Approve the purchase from the County of Orange of AP#666-092-05 and AP#675-043-01 for a total of $100 and advise the County to initiate the necessary actions for the sale of land to the City. 2.
