tl 2 3� 4 5 f� 8 9 10 11 12 13. 14 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 CW:mr 1 1031., Y COMMUNICATIONS AGREEMENT THIS AGREEMENT, made and entered into by and between the CITY OF SAN JUAN CAPISTRANO , a municipal corporation, located in the County of Orange, hereinafter designated as "CITY," and the COUNTY OF ORANGE, a body politic and corporate, hereinafter designated as "COUNTY," W I T N E S S E T H: WHEREAS, the COUNTY owns, maintains Ind operates a communication system for public safety communications for police, fire and special emergency services, and WHEREAS, the CITY desires the COUNTY to establish and maintain remote dispatch facilities in and for the use of said CITY for police purposes and is desirous of having same maintained under a licensed supervising technician of COUNTY, NOW, THEREFORE, for and in consideration of the mutual covenants and promises of the parties hereto, hereinafter contained, it is mutually agreed by and between the parties as follows: 1. (a) The COUNTY agrees to install and maintain base station facilities for said system, and remote dispatch facilities for use by said CITY for police purposes, including the necessary antenna or antennas and the necessary structures therefor, to be operated by a communications connection between CITY'S dispatch station and said COUNTS communication system, under the rules and regulations of the Federal Communications Commission. COUNTY also agrees to install and maintain base station facilities for fire radio service, and special emergency radio service limited to Civil Defense County -wide communication system and lifeguard service. C (b) All labor costs of installation and maintenance of the dispatch.facilities shall be borne by the COUNTY. (c) All equipment, material, apparatus and parts required for use at the antenna site shall be furnished by and at the expense of the COUNTY, and shall remain the property of the COUNTY. 1. 1 2 3 4 5 .6 7' 8 9 10 11 12 13' 14 Wr ,oza 15 1p W0, w 16 Zz OZR 0 0 17 U In 19 20 21 22 23 24 25 26 27 28 29 30 31 32 (d) COUNTY further agrees to install and maintain mobile unitl radar speed meters, pack sets, surveillance equipment and other electro equipment used by CITY on mobile equipment in carrying out the official functions of the police and fire services, and special emergency radio service limited to Civil Defense County -wide communications and life- guard service. (e) All equipment, material, apparatus and parts to be re- quired for installation at the dispatch point, base station and on mobil equipment shall be furnished by and at the expense of the CITY. In puri chasing equipment, CITY agrees to conform to the established communica-1 tions systems and operations presently in effect. Mobile radio units may be 30 watt output but shall not exceed 50 watt output. Motorcycle radio units may be 12 watt output and shall not exceed 30 watt output. (f) Before COUNTY provides base or mobile installation servic� or maintenance, CITY shall obtain the appropriate Federal Communicat Commission authorization to operate all of its transmitting equipment. (g) All radio equipment for the Public Safety Services of CITY shall be installed, serviced and maintained by COUNTY; however, nothing in this agreement shall authorize or be construed as requiring COUNTY to install or maintain any equipment of any kind in vehicles, buildings, or premises not owned by or under lease to CITY and under the full-time control of CITY. 2. The COUNTY agrees to furnish a licensed supervising technician, who shall hold a valid first-class radio telephone license issued by the Federal Communications Commission, and said base and mobile equipment furnished pursuant to paragraph 1 (d) above shall be maintained under hi supervision. 3. Said remote dispatch facilities shall be in continuous connecti with the dispatching point of the County Connnunications Center, whenever CITY provides office dispatching personnel for a minimum of sixteen (16) hours per day, and the police officers of the CITY shall be permitted to dispatch over the air at any time the system is not actually being used E 1 by other authorized agencies. 2 4. It is further agreed and understood that any local message of 3 important emergency nature shall have preference over any routine 4 traffic, and the facilities for dispatching such emergency messages shall 511 be made available upon request. In case of a dispute over priority of .6 7 8 9 10 emergency messages originating in more than one department, the dispatc on duty at.the County Communications Center shall be the final authority in deciding which emergency message shall have priority. 5. The CITY proposes to use said Communications System only for such purposes and in such manner as may be permitted by the Federal 1111 Communications Commission 12 13 14 The dispatcher on duty at the Communications) Center shall monitor all dispatches and shall have the authority to take) said remote dispatch facilities off the air should any rules or regula- tions for the management of the County Communications Center, as adopted) by the Board of Supervisors, or any rules and regulations adopted by the Federal Communications Commission, or any provisions of the Federal Communications Act of 1934, as amended, be violated. 18 6. The CITY agrees that so long as this Agreement remains in effect 19 it will not apply to the Federal Communications Commission for a license 20 or individual authority to operate a base station transmitter in the 21 Police Radio Service, unless said CITY shall have first given notice of 22 cancellation to the COUNTY as provided in paragraph 7 of this Agreement. 23 7. This Agreement shall become effective on the first day of the 24 month next following the date of COUNTY execution, or on such date if it 25 is the first.day of the month, and shall remain in effect thereafter 26 subject to cancellation by either party -upon six (6) months' notice gives 27 to the other party in writing. 28 8. This Agreement supersedes all agreements heretofore entered int+ 29 between the parties hereto relating to radio communications and the 30 installation and maintenance of radio transmission equipment, and upon 31 the execution of this :agreement, all such prior agreements shall be 32 1 3. IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their respective officers thereunto duly authorized upon the date set forth opposite their respective signatures. IN RE: COMMUNICATIONS AGREEMENT USE OF COUNTY RADIO FACILITES CITY OF SAN JUAN CAPISTRANO On motion of Supervisor Caspers,.duly seconded and unanimously carried by Board members present, the Chairman and the Clerk are author- ized to sign the Communications Agreement dated May 2, 1972, between the County of Orange and the City of San Juan Capistrano, providing for said City's use of County Radio facilities. IN RE: EXTEND INVITATION CALIFORNIA ASSOCIATION OF AIRPORT EXECUTIVES' 1974 ANNUAL CONVENTION On motion of Supervisor Clark, duly seconded and unanimously carried by Board members present, the Chairman of the Board of Supervi is authorized to extend an invitation to the California Association of Airport Executives to hold its July, 1974 annual convention in Orange County, as recommended by the Director of Aviation in his letter dated April 19, 1972. IN RE: EXTEND INVITATION CALIFORNIA ASSOCIATION OF AIRPORT EXECUTIVES' 1976 ANNUAL CONVENTION On motion of Supervisor Clark, duly seconded and unanimously carried by Board members present, the Chairman of the Board of Superviso is authorized to extend an invitation to the Ame-scan Association of Airport Executives to hold its annual convention in June of 1976 in Orange County and the Director of Aviation is authorized to represent Orange County in attempting to secure the convention, as recommended in his letter dated April 19, 1972. 1 1019-2.2
