DONATED SPACE AGREEMENT
THIS IS A DONATED SPACE AGREEMENT dated 0j u w e 19607 by and between

1. In consideration of the agreements herein contained, DONOR hereby grants to COUNTY
rent-free use of those certain premises described as
desk space at the San Juan Hot Springs Dance Hall
located at 32506 Paseo Adelanto , City of San Juan Capistrano County of
Orange, State of California, for purposes of providing more efficient and timely inspections
of food establishments, swimming pools and housing complaints in the City of San Juan
Capistrano. It will also create a closer liason with city officials and provide easier
access for city residents to contact this Agency.

A. Days of use Monday through Friday
B. Hours of use 7:30 a.m. and 9:00 a.m.
C. Frequency of use Each scheduled day
2. DONOR shall supply all repair, maintenance, janitorial supplies and services to
said premises.
3. DONOR shall be responsible for all charges for utilities supplied to said premises,
except charges for telephone service, which shall be the responsibility of COUNTY.
4. COUNTY shall indemnify and save harmless DONOR, its officers, agents, and employees,
from and against any and all claims, demands, losses, or liabilities of any kind or
nature which DONOR, its officers, agents, and employees may sustain or incur or which
may be imposed upon them or any of them for injury to or death of persons, or damage to
property as a result of, or arising out of, the sole negligence of COUNTY, its officers,
agents, employees, subtenants, invitees, or licensees, in connection with the occupancy
and use of the premises by COUNTY.
Likewise, DONOR shall indemnify and save harmless COUNTY, its officers, agents, and
employees from and against any and all claims, demands, losses, or liabilities of any
kind or nature which COUNTY, its officers, agents, and employees may sustain or incur
or.which may be imposed upon them or any of them for injury to or death of persons,
or damage to property as a result of, or arising out of, the sole negligence of DONOR,
its officers, agents, employees, invitees, or licensees, in connection with the owner-
ship, maintenance, or use of the premises.

Agency
In September 1986, the City was contacted by the County of Orange Health
Care Agency about space availability in our City facilities for a staff
Sanitarian. A copy of this written request is attached. Currently, the
Sanitarian assigned is working out of the Santa Ana office. She spends a
significant amount of time commuting to this County facility each week.
The Public Health and Medical Services agency has asked if the City has
desk space available on a daily basis from 7:30 a.m. to 9:00 a.m, for use by
this district Sanitarian. By basing this individual here, she wilt have more
time to conduct inspections of area food establishments and swimming
pools, and for investigating housing complaints. Also, this will allow for a
closer liaison between the City staff and our "City Health Inspector."
City staff have reviewed all City facilities and have determined that desk
space is available at the San Juan Hot Springs Dance Hall. As space is
needed only during the early morning hours, there will be no adverse
impacts on Community Services Department programs conducted regularly
at this facility. The County will provide a telephone for use by the district
Sanitarian. The City will underwrite the cost for normal building
maintenance and utilities.
The terms and conditions of our agreement to provide this space are
outlined in the attached "Donated Space Agreement." The agreement, if
approved by the City Council, can be terminated at any time by serving
thirty (30) days written notice.
COMMISSION/BOARD REVIEW AND RECOMMENDATIONS:

FINANCIAL CONSIDERATIONS:
The most significant cost associated with this agreement, that of providing
telephone service, will be borne by the County of Orange. The added cost
to the City to provide utilities and building upkeep necessitated by this
space allocation will be minimal and can be accomplished within the
parameters of the current budget.

I supervise a staff of sanitarians that conduct inspections of food
establishments, swimming pools and housing complaints in the South
County area. One of my staff, Kathleen MacVarish, handles the city of
San .Tuan Capistrano. As you are aware the city and surrounding areas
have expanded with increasing number of food establishments and swim-
ming pools.
At the present time Ms. MacVarish is assigned to our Santa Ana office
and must consume as least forty minutes driving to her district. This
lost time equates to one food establishment inspection per day. The
costs for mileage reimbursement are charged to food establishment op-
erations through Health Service Fees.
We would appreciate your considering the possibility of the city pro-
viding office space for Ms. MacVarish. Her normal office schedule is
from 7:30 to 9:00 a.m., Monday through Friday. After that time she
conducts field inspections, and does not return to the office for
the remainder of the day.
A City Hall office would greatly enhance this Agency's responsiveness
to the City's needs. It would allow Ms. MacVarish to conduct at least
one more inspection per day. There would be a closer liaison with
City staff. The citizens and food establishment operators would have
an improved accessibility to their City's Health Inspector.
We would appreciate your consideration in finding office space for our
