1981-0714_ORANGE, COUNTY OF / CITIES_Emergency Management Agreement. 1,. 2 3 4 5 6 7 8 9 10 11 12 13 14 18 19 20 21 22 j 23 24 1I, 25 0 N 26 N : UNIFIED ORANGE COUNTY -CITIES 1 o EMERGENCY MANAGEMENT AGREEMENT THIS AGREEMENT is entered into this ( 7 day of , 1981, which date is enumerated for purpose of reference ly by and between the COUNTY OF ORANGE, hereafter referred to as "COUNTY," and the cities within Orange County which are signatories hereto; hereafter referred to as "CITY" or "CITIES," W I T N E S S E T H: WHEREAS, it is the intent of the parties hereto to coordinate their preparedness and response efforts for the purpose of preserving the safety of persons and property from the effects of natural, man-made, or war -caused disasters, hereafter referred to as "emergencies." NOW, THEREFORE, the parties hereto agree as follows: A. EXISTING AGREEMENTS: Nothing contained in this Agreement shall be construed as repealing or modifying any existing agreements, including riutual aid agreements, except this Agreement repeals the existing ` UNIFIED ORANGE COUNTY -CITIES DISASTER AGREEMENT dated December 5, 1972. B. LOCAL AUTHORITY: In the event of an actual or threatened emergency, COUNTY and each CITY shall retain the authority provided for by law respecting its jurisdiction. C. COUNTY SERVICES: COUNTY will provide the following services to CITIES: 1. Upon request by CITY, assist in the preparation, development and support of all aspects of an emergency management pro- gram for that CITY. 2. Prepare and develop an emergency management program which shall provide for the needs of the unincorporated areas of 1. 2 3 4 5 6 7 8 9 10 11 12 0 0 the COUNTY, and will take into account and be coordinated with the needs of CITIES in the event of an emergency. 3. Provide assistance during emergency incidents: a. When confined to one CITY, COUNTY will, if requested, offer assistance within the limits of its capabilities and will, if requested, coordinate assistance furnished by other CITIES. b. When affecting an area greater than one CITY, COUNTY will, if requested, offer assistance within the limits of its capabilities and will, if requested, direct and coordinate the assistance furnished by other CITIES. C. Notwithstanding any of the above, fire and law enforce- ment assistance shall be provided by COUNTY pursuant to applicable mutual aid agreements. 4. Maintain a current resource listing of the facilities, equipment and supplies available in the County for use in the event of an emergency. 5. Provide technical assistance in obtaining any federal or State funds which may become available to CITIES for emergency purposes. 6. Provide technical assistance in the acquisition by CITIES of surplus and excess government property. D. THE CITIES SHALL: 1. Accept primary responsibility for the development within each CITY of an emergency management program which shall be compatible with, and complementary to, the Countywide emergency management program. 2. Promote cooperation among CITIES and the COUNTY in order to 2. I improve the overall Countywide emergency management program. 2 3. Assure training within their respective CITIES. . 3 E. COORDINATION: It shall be the responsibility of the Orange 4 County Emergency Management Division to coordinate the efforts of the 5 parties to this Agreement for the accomplishment of its purposes. 6 F. ORGANIZATION: There is hereby established the Orange County - 7 Cities Emergency Management Organization, hereafter referred to as 8 "Organization." 9 1. Membership in the Organization shall consist of COUNTY and 10 all CITIES within the County which are signatories to this 11 Agreement. 12 2. The Manager, Emergency Management Division shall be the 13 COUNTY representative member, and shall provide clerical 14 support for the Organization. 15 3. A representative from each CITY shall be appointed, in 16 writing, by the City Manager/Administrator of that CITY. 17 4. Ex officio representatives from other public and private 18 agencies may actively participate as non-voting members 19 at the Organization's meetings and events. 20 5. Official action of the Organization requires a majority 21 vote of the membership. Each member shall have one vote. 22 6. Officers of the Organization and line of succession shall be, 23 President, First Vice President, and Second Vice President. 24 7. Officers of the Organization shall be elected at the first 25 meeting to be conducted after the effective date of this 26 Agreement, and annually thereafter. 27 8. The purposes of the Organization include the following: 28 a. Provide a forum for discussion and exchange of ideas 3. 2' 3, 4 5 6 7 8 9 10 11 12 13 14 18 19 20 that are of mutual concern to some or all jurisdictions. b. Identify and examine areas of common concern -and coordinate the development of appropriate plans and programs. C. Assist in the coordination of an annual training exer- cise which will be aimed at strengthening a specific aspect of the CITY -COUNTY disaster response relationship d. Encourage plans and programs leading toward an integrate Countywide preparedness for emergencies. e. Promote public education and individual emergency preparedness within the COUNTY and CITIES. f. Review legislation impacting emergency plans and pro- grams and propose concepts for new legislation. g. Provide technical advice to any requesting member jurisdiction. h. Review proposals of emergency mutual aid plans and agreements and recommend further review and approval of such proposals to member jurisdictions. 9. During calendar year 1981, the Organization shall meet monthly. Thereafter, regular meetings shall be held quarterly. In addition, special meetings may be called by the President. 10. The Organization has no authority to bind the COUNTY or any CITY to any financial arrangement. G. EFFECTIVE DATE: This Agreement shall take effect when executed by COUNTY and a majority of the Cities in Orange County. Thereafter, any City in Orange County may become a party hereto by executing this Agree- ment. 4. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 • H. WITHDRAWAL: Any party may withdraw from this Agreement by written notice to the Board of Supervisors and the President of the Organization. Said notice shall be given 30 days before withdrawal from this Agreement. IN WITNESS WHEREOF, the parties hereto have executed this Agreement. Murphy, Director of Public Works SUBJECT: Unified Orange County/Cities Emergency Management Agreement SITUATION Since 1973, the City of San Juan Capistrano has had an agreement with Orange County for Disaster Planning and Assistance. This contract entitled Unified Orange County/Cities Disaster Agreement provided fora nominal fee,County emergency services and training. This service was extended to all County jurisdictions. Within the last year, the County Board of Supervisors requested a total revision of the agreement to encourage more cities to participate and increase the involvement previously shown in this area of emergency preparedness. Following a Blue Ribbon Committee report and recommendations, the Supervisors decided to offer this service without charge. The attached agreement would replace the old contract and supplement mutual aid understandings. FINANCIAL CONSIDERATIONS There are no monetary costs associated with this agreement other than City personnel time spent to work with the County Staff. ALTERNATE ACTIONS: 1. Adopt the Unified Orange County/Cities Emergency Management Agreement to replace the existing County/City Disaster Agreement. 2. Do not adopt the agreement. 3. Refer to Staff for additional information. RECOMMENDATION By motion, adopt the Unified Orange County/Cities Emergency Management Agreement to replace the existing County/City Disaster Agreement. In order to encourage timely ratification of this agreement by the cities, we are sending you two (2) copies of the Agreement and a copy of Board of Supervisors Resolution No. 81-1104. Please execute both copies and return them to the Emergency Management Division. One copy will be returned to your city, so that you'll have an original executed version for the record. The Orange County -Cities Emergency Management Organization was formed to improve county -city coordination in disaster planning, and in answer to the recommendations of the Blue Ribbon Committee on Emergency Preparedness and Civil Defense, which was the subject of my letter to you on September 3, 1980. A subcommittee of the Organiza- tion reviewed the old Unified Agreement and recommended major revisions including the elimination of annual fees. This revised agreement was approved by the County Emergency Management Council and submitted to each City Manager for review and approval. A majority of the cities have responded favorably either directly or through their representatives in the Emergency Management Organization. Consequently, the Organization voted to approve the new agreement, and recommended that it be forwarded to the Board of Supervisors. On July 14, 1981, the Board unanimously approved the revised agreement by Resolution No. 81-1104. The Board also rescinded the original Agreement dated December 5, 1972. County officials are very encouraged by the response to this effort at improving Countywide emergency planning and believe that it will prove advantageous to all of our citizens. Action to ratify and return the enclosed copies of the agreement at your earliest convenience will be appreciated. Clark Chairman, Board of Supervisors RBC: Id Enclosures J 1 2 3 4 5 6 7 8 9 10 11 12 13 14 18 19 20 21 22 23 24 a 25 C 2 26 27 E PW 0 1] RESOLUTION OF THE BOARD OF SUPERVISORS OF ORANGE COUNTY, CALIFORNIA July 14, 1981 On motion of Supervisor Clark, duly seconded and carried, the following Resolution was adopted: WHEREAS, the Blue Ribbon Committee on Emergency Preparedness and Civil Defense recommended to the Board of Supervisors that the fees paid annually by the Cities for services rendered by the County, in accordance with the terms of the existing Unified Orange County -Cities Disaster Agreement, should be eliminated from the Agreement, and WHEREAS, the newly constituted Orange County -Cities Emergency Management Organization has accomplished a thorough review and revision including retitling, of the aforesaid Agreement to clarify the purposes of the Organization, and to simplify the administration of the County - Cities emergency preparedness function, as well as to eliminate all fiscal provisions from the Agreement, in accordance with the Blue Ribbon Committee recommendation, and WHEREAS, the aforementioned revision, newly titled the Unified Orange County -Cities Emergency Management Agreement, has been reviewed and approved by the Orange County Emergency Management Council, NOW, THEREFORE, BE IT RESOLVED as follows: 1. The Unified Orange County -Cities Emergency Management Agreement dated July 14, 1981 is hereby approved, and - 2.
