This Program Supplement is hereby incorporated into the Local Agency -State Agreement
for Federal -Aid which was entered into between the LOCAL AGENCY and the STATE on
1-25-84 and is subject to all the terma and conditions thereof. This Program
Supplement is adopted in accordance with Paragraph 2 of Article 11 of the aforementioned
Master Agreement under authority of Resolution No. 87-2-17-5 , approved by the
LOCAL AGENCY on 2/17/87 (See copy attached).
The L -cal Agency further stipulates that as a condition to payment of funds obligated to this project.

SPECIAL COVENANTS OR REMARKS
1. All maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will
be performed by the City of San Juan Capistrano at regular
intervals or as required for efficient operation of the
completed improvements.
2. The City of San Juan Capistrano will advertise, award
and administer this project. The City will obtain STate's
cu,,ourrencc prior to either award or rejection of contract.
3. In awarding, or agreeing to award the contract, the Local
Agency agrees the payment of Federal funds will be limited
to the detail estimate amount approved by the Federal
Highway Administration in the Federal -Aid Project Agreement
(PR -2), or its modification PR -2A, and accepts any increases
in Local Agency funds.
4. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal -Aid Program.

Written Communications:
Report dated February 17, 1987, from the Director of Public Works, advising that
the City's application to Caltrans for use of Federal Funds to install raised
reflective markers on various streets had been approved and federal funds
authorized. The report forwarded an agreement with the State for use of the
funds. The agreement provided that the Federal funds will cover $16,517, or 86% of
the project costs. The remaining amount of $2,525, or 14%, will be provided by local
funds which are budgeted in the striping/marking maintenance account.
Approval of Agreement for City -Wide Raised Pavement Marking Project:
It was moved by Councilman Schwartze, seconded by Councilman Buchheim that the
following Resolution be adopted:
CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, APPROVING PROGRAM SUPPLEMENT NO. 2 TO

The Resolution approved the Agreement with the State for the project; the City
Clerk was directed to forward a certified copy of the Resolution and the Agreement

Amendment to Agreement - City -Wide Raised Pavement Marking
Project (CALTRANS)
In August, 1985 the Engineering Division applied to CALTRANS for the use of Federal
Funds (PMS) to install raised reflective markers on various streets within San Juan
Capistrano. CALTRANS recently notified the City that our application had been
approved and that federal funds had been authorized for use on the pavement marking
project.
In order to utilize these funds it is necessary for the City to approve an Agreement with
the State.
Staff is therefore requesting approval of Program Supplement No. 2 to the Local Agency
- State Agreement No. 07-5372 which was approved by the City Council in 1984. The
present Agreement incorporates Program Supplement No. 2 for the pavement marking
project into the Master Agreement with the State for Federal -Aid projects in the City.
A brief Resolution is attached for approval due to State requirements.
Plans and Specifications are complete for the proposed work, however, the City must
await CALTRANS' authorization to actually solicit bids. It is expected that such an
authorization will be forthcoming after CALTRANS receives the City approved Program
Supplement No. 2 to the Local Agency - State Agreement No. 07-5372.

FINANCIAL CONSIDERATIONS
The Agreement provides that the Federal Aid (PMS) program will fund $16,517 (86%) of
the project costs with the remaining estimated amount of $2525 (14%) to be provided by
local funds, which in this case would be from the regularly budgeted striping/marking
maintenance account.

RECOMMENDATION
By Resolution, approve Program Supplement No. 2 to the Local Agency - State

funding for said project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
San Juan Capistrano does hereby approve Program Supplement No. 2 to the Local Agency
- State Agreement No. 07-5372 for the City -Wide raised pavement marking project with
CALTRANS.
BE IT FURTHER RESOLVED that the City Clerk is directed to forwa(d a
certified copy of this Resolution to CALTRANS along with Program Supplement No. 2 to
the Local Agency - State Agreement No. 07-5372.
