The CITY, Ly Resolution --85-8-6-4-, desires and haz requested STATE to orovide to CITY existina operating STATE richt-of-way required by CITY to construct Federal Aid Urban (FAU) Program Project referred to herein as PROJECT as shown on Exhibits A and E ( shown colored in light blue) , attached and made a part of this agreement . 2 . CITY and STATE will incorporate into and make a part of CITY's FAU PROJECT, STATE's proposed. project to install traffic signals , safety lighting and channelization at the intersection of Camino Capistrano and the San Juan Creek Road southbound ramps , referred to herein and shown on Exhibit A as "INXROVEMENT" . 3. STATE: will relinquish to CITY that remaining portion of Camino Capistrano on existing STATE right-of-way in the vicinity of the San Juan Creek Road southbound ramps as shown colored in yellow on Exhibit B. STATE 's IMPROVEMENT and CITY's on-site drainage facilities are proposed within STATE 's right-of-way on Camino Capistrano as part of PROJECT. Camino Capistrano was previously relinquished to CITY beyond both sides of said existing STATE right-of-way. 4 . CITY's PROJECT proposes to replace the existing Camino Capistrano Bridge over San Juan Creek with a wider bridge structure , improve a portion of the San Juan Creek Channel , widen and improve Camino Capistrano and San Juan Creek Road, and install signals at the intersection of Camino Capistrano and San Juan Creek Road , as shown on Exhibit A. -2- 5. STATE will benefit from the aforementioned construction of PROJECT through the relief of congestion, improved operation and provision for additional traffic capacity of the Sar. Juan Creek Road southbound ramps . by making IMPROVEMENT a part of the CITY's PROJECT, in lieu of constructing IMPROVEMENT after CITY's PROJECT is constructed, STATE will benefit sooner and preclude the need to tear up newly constructed road improvements and again disrupt traffic service. 6 . STATE will be relieved of maintaining that afore- mentioned portion of Camino Capistrano being relinquished to the CITY , except that. STATE will maintain improvements noted in Section II, Article 3 and share with CITY maintenance and energy costs described in Section III, Article 13. SECTION I CITY AGREES: 1. To do all work necessary for the successful completion of PROJECT, except for that work which STATE agrees to perform in Section II of this Agreement . 2 . To furnish or cause to be furnished all labor, materials , tools and equipment to construct said PROJECT pursuant to the provisions of applicable laws and regulations . -3- 3. To construct. PROJECT at CITY's expense in accordance with plans and specifications prepared by CITY, and approved by STATE, except IMPROVEMENT part of PROJECT to be constructed by CITY at STATE expense as set forth hereinafter in Section II, Article 2 and as concurred to by Federal Highway Administration as to conformity to existing and future facilities. 4. To submit to STATE, checked detailed plans of the PROJECT when applying for an Encroachment Permit . 5 . Upon presentation by STATE to accept at no cost to CITY all of STATE's right , title and interest in and to that real property relinquished by STATE pursuant to this agreement. as set forth hereinafter in Section II, Article 8 . 6 . To accept on a form satisfactory to STATE an Encroachment Permit which will be required for construction of PROJECT. 7 . To acquire all rights-of-way required for PROJECT including STATE's rights-of-way by relinquishment as shown on Exhibit B. 8 . To waive the 90-day Notice of Intention required by Section 73 of Streets and flighways Code before California Transportation Commission (CTC) approval of the Right-of-Way Relinquishment . -4- 9 . Upon notification by CITY to STATE of CITY'S contractor 's relief of maintenance responsibility therefor, to maintain all improvements constructed pursuant to this Agreement which lie temporarily inside and permanently outside STATE's highway ( freeway) right-of-way, except those improvements noted in Section II, Article 3, and to make no claim against STATE for any portion of expense incurred therefor . 10 . To make any necessary arrangements with the owners of public or private utilities for the removal and/or relocation of all utility facilities which could conflict with the aforesaid construction, in accordance with applicable law, the provisions of any franchise , Master contracts or other agreements in effect with the respective utility owners , and to prepare the necessary notices to relocate, and/or Utility Agreements . Utility work under, over , across freeway right-of-way will be by STATE Highway Encroachment Permit . 11 . Immediately following the date of bid advertising to submit to STATE a billing in the amount of $84 ,000, which figure represents STATE's estimated cost of IMPROVEMENT part of PROJECT less the cost of STATE furnished Type 170 traffic signal controller . 12 . Upon completion of the aforesaid construction contract and settlement of contractor 's claims to furnish STATE with a detailed statement of the engineering and construction costs required to complete the IMPROVEMENT, and to release to STATE any amount of STATE's deposit as provided for in Section II, Article 1 , remaining after the actual costs to be borne by STATE have been deducted. -5- 13 . To retain or cause to be retained for audit for STATE or other government. auditors for a period of three ( 3) years from date of final payment all records and accounts relating to construction of IMPROVEMENT. SECTION II STATE AGREES: 1. To deposit with CITY within 30 days of receipt of billing therefor, the amount of $94, 000 which figure represents the total estimated cost of construction and construction engineering to complete IMPROVEMENT as part of PROJECT as shown on Exhibit C. In no event shall STATE's total obligation for said costs under this agreement exceed the amount of $91 , 700; provided that STATE may in its sole discretion, in writing, authorize a greater amount. 2 . To furnish to CITY at no cost to CITY a Type 170 traffic signal controller assembly to complete construction of IMPROVEMENT. 3 . To maintain the entire traffic control signal systems and safety lighting as installed as part of IMPROVEMENT. 4 . To prepare for CITY at no cost to CITY detailed contract plans , specifications and estimate of construction cost for STATE's IMPROVEMENT as shown on Exhibit A, said plans subject to review and approval by CITY and concurrence by Federal Highway Administration ( FHWA) . -6- 5 . To furnish CITY with an Encroachment Permit to enter and construct roadway improvements adjacent to and within STATE right-of-wap for the period of time requested by CITY, after execution of this Agreement, and upon approval by STATE of contract plans and specifications affecting the STATE highway. 6. To perform services at STATE expense including , but not limited to, the following : review and/or monitor said STATE part of PROJECT, prepare Cooperative Agreement, and review final plans and specifications affecting the STATE highway ( freeway) . 7. To obtain FHWA approval , subject to California Transportation Commission (CTC) approval , for STATE to relinquish STATE right-of-way required for PROJECT as shown in licht blue and yellow in Exhibit. B in accordance with STATE policies and procedures . 8 . To prepare Right-of-Way and Relinquishment Maps , to perform the necessary right-of-way engineering, write property descriptions of STATE right-of-way for use by STATE in the relinquishment of property rights to the CITY for the PROJECT. 9. To perform surveys required for STATE right-of-way monumentation at CITY's expense as part of the Encroachment Permit process and relinquish to CITY, subject to approval by the CTC, all right, title and interest held by STATE to right-of-way which will lie outside STATE's newly established freeway right-of-way lines as shown on Exhibit B. -7-.., 10 , Upon completion by CITY of all services performed for IATROVEMENT and upon receipt of a detailed statement and billing therefor , to reimburse CITY promptly, any additional amount due over and above funds deposited by STATE as defiend hereinbefore in Section I , Article 12. SECTION III IT IS MUTUALLY AGREED: 1 . That all obligations of STATE under the terms of this agreement are subject to the appropriation of resources by the Legislature and the allocation of resources by the California Transportation Commission . 2 . That , CITY may, at any time prior to award of a construction contract for the PROJECT, for any reason, terminate the PROJECT and shall immediately notify STATE in writing of such termination. 3 . That neither STATE nor any officer or employee thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by CITY under or in connection with any work , authority or jurisdiction delegated to CITY under this Agreement . It is also understood and agreed that , pursuant to Government. Code Section 895. 4, CITY shall fully indemnify and hold STATE harmless from any liability imposed for injury (as defined by Government Code Section 810.8) occurring by reasons of anything done or omitted to be done by CITY under or in connection with any work, authority, or jurisdiction delegated to CITY under this Agreement. -8- 4. That neither CITY, its consultants , nor any officer or employee thereof , is responsible for any damage or liability occurring by reason of anything done or omitted to be done by STATE under or in connection with any work, authority or jurisdiction not delegated to CITY under this Agreement. It is also understood and agreed that, pursuant to Government Code Section 895 .4, STATE shall fully indemnify and hold CITY and its consultants harmless from any liability imposed for .injury ( as defined by Government Code Section 810 .8 ) occurring by reason by anything done or omitted to be done by STATE under or in connection with any work, authority or jurisdiction not delegated to CITY under this Agreement . 5 . That if the lowest responsible bid received by the CITY for construction of the IMPROVEMENT does not exceed the Engineer 's Estimate by more than 11 percent, CITY may award the contract. STATE agrees to promptly deposit the overrun amount with the CITY prior to award of contract . 6. That if , upon opening of bids , it is found that a cost overrun exceeding 11 percent of the estimate for. the IMPROVEMENT will occur , STATE and CITY shall endeavor to agree upon an alternative course of action. 7. That after opening of bids for PROJECT estimate of cost will be revised based on actual bid prices . STATE's required deposit under Section II, Article 1 above will be increased or decreased to match said revised estimate. If deposit increase or decrease is less than $1,000 no refund or demand for additional deposit will be made until final accounting_ . -9- 8. That construction of IMPROVEMENT referred to herein may require alteration , deviation , additions to or omissions from CITY's plans and specifications , including increase or decrease of quantities in items of work. Any such changes as referred to herein will be accomplished in accordance with STATE's Standard Specifications and special provisions . 9. That any change requested by the parties hereto in the aforesaid construction that may be necessary or desirable prior to completion of the work for IMPROVEMENT shall require the written approval of STATE. The cost of an approved chance, if within the amount provided for contingency items , may be taken from the fund therefor provided. If the cost of an approved change exceeds the amount provided for in contingency items , STATE will , upon receipt of claim therefor , deposit with CITY the estimated cost of such approved change , plus twenty percent ( 20%) for contingencies . 10 . That in the construction of said work, CITY will furnish a Resident Engineer and STATE may at no cost to CITY furnish a representative to perform the usual functions of a Resident Engineer if it so desires , and that said Resident Engineer and representative will cooperate and consult with each other but the orders of CITY engineer shall be final , except for construction of IMPROVEMENT. 11 . That CITY grants to STATE, or its representative, the right, at no cost to CITY, to inspect the aforesaid CITY facilities construction inside of existing STATE;'s richt-of-wav as it -10- progresses , and to be present at the final inspection of all facilities construction for CITY pursuant to this agreement . 12 . That upon completion and acceptance of the contract by CITY and STATE for the work covered by this Agreement, the CITY will accept control and maintain, at its own costs and expense, those portions of PROJECT lying within rights-of-way relinquished by STATE to CITY as indicated by symbols on Exhibit B, except as noted hereinbefore in Section II, Article 3 . 13 . That maintenance and energy costs of operating the traffic control signal system and safety lighting shall be shared on the basis of the number of legs entering the intersection under each jurisdiction bears to the total number of legs, 50% for STATE and 50% for CITY. 14. That upon completion of all work under this agreement, ownership and title to materials , equipment and appurtenances which are installed within STATE's rights-of-way will automatically be vested in the STATE, and materials, equipment and appurtenances installed within rights-of-way relinquished. by STATE to CITY and outside of STATE's rights-of-way will automatically be vested in the CITY, except that ownership and title to all signal and lighting materials, equipment and appurtenances which are installed within STATE's rights-of-way and rights-of-way relinquished to CITY as part of IMPROVEMENT will be vested in the STATE. No further agreement will be necessary to transfer ownership as hereinabove stated. -11- 15 . That CITY is to fund all costs of PROJECT, except as noted in Section II, Articles 1, 2 and 4 , including any approved change orders and contractor 's claims . 16. That as part of the permit process CITY is to reimburse STATE for costs incurred by STATE to perform surveys required for STATE right-of-way monumentation resulting from the relinquishment to CITY of STATE property. 17. That compensation to CITY shall include reimbursement for all actual costs other than labor. Reimbursement for labor costs shall be based on the loaded hourly rates times the number of hours worked by each individual performing services pursuant to this Agreement . 18. That should CITY incur any additional. expense for IMPROVEMENT part of PROJECT necessary in carrying out this Agreement , said additional expense shall be paid by STATE even though not specifically defined in this Agreement , pursuant to the conditions set forth in Section I1, Article 10 , and Section III, Article 16 and Article 17 . To the extent feasible CITY shall notify STATE to obtain approval prior to incurring any additional expenses not specifically defined in this agreement. -12- 19 . That Exhibits A, B , and C attached hereto, have been prepared to depict as near as possible the general scope of work to be accomplished hereunder and to delineate the approximate areas of rights-of-way to be relinquished as set forth hereinbefore in this agreement. Actual areas relinquished and construction of facilities as shown on said exhibits may vary slightly from that which is ultimately accomplished . Work to be accomplished pursuant to this agreement shall be based on the approved plans referred to hereinbefore in Section I, Article 3, which plans shall take precedence over that which is shown on said Exhibits A and B, in the event of any difference which may appear thereon. -13- 20 . That this agreement shall terminate upon completion and acceptance of PROJECT by STATE: and CITY or on January 1, 1988 , whichever is earlier in time , unless extended by mutual agreement; however, the ownership and maintenance clauses shall remain in effect until terminated, in writing, by mutual agreement. NOW, THEREFORE, the City Council of the City of San Juan Capistrano does hereby resolve as follows: Section 1. The Cooperative Agreement is approved. Over the past two weeks several major steps were achieved and staff is optimistic that the authorization to advertise will be granted in September of this year. Recent items of major interest are as follows. 1) The State/City Supplemental Report is complete (7/17/85) and now awaiting final review and submittal to the California Transportation Commission for State right-of-way relinquishment. 2) The local agency Right-of-Way Certification has been signed indicating all right-of-way is acquired and submitted to the State Right-of-Way Division (7/17/85. ) Following approval, documents will be submitted for FHWA concurrence. 3) Final issues with Orange County Flood Control District are now being resolved. Following design modifications, the County permit should be issued. 4) Fish and Game have field-reviewed the project (7/12/85. ) They are now reviewing the construction plans and the permit is expected in early August. At this stage of the process it is now necessary for the City to formally adopt the Cooperative Agreement to obligate to the required conditions. PROJECT CATEGORY Caltrans ' signal project is a Category 5 project , categor- ically exempt under Class 1 of the Caltrans ' Environmental Regulations A FONSI document was approved by the FHWA for the City' s FAU project on March 12 , 1984 . III. BACKGROUND Caltrans prepared the PS&E for the above-described Caltrans ' project on December 20 , 1983 . The project was later shelved until after the City completed its FAU project . The City' s FAU project proposes to replace the existing Camino Capistrano Bridge over San Juan Creek with a wider bridge structure, improve a portion of the San Juan Creek Channel, widen and improve Camino Capistrano and San Juan Creek Road at the location and as shown on attached Vicinity and Location Maps , and install signals at the intersection of Camino Capistrano and San Juan Creek Road. The City' s FAU project is presently scheduled to go to contract in the 1985 Federal Fiscal Year. Construction time is estimated to be, 400 calendar days . IV, EXISTING FACILITIES Both southbound ramp termini, Camino Capistrano and San Juan Creek Road are each two lanes wide. Neither of the two intersections along Camino Capistrano are signalized. V, TRAFFIC DATA The construction of 800 homes is planned in the San Juan Hills , which will greatly increase the existing traffic volumes and, thereby, further congest this location. VI . DEFICIENCIES AND JUSTIFICATION Both Caltrans ' and City' s projects have been previously approved, separately. The City has obtained FHWA approval to fund the City project with FAU funds . Caltrans signal project is eligible for Federal 4-R Safety funds . VII . PROPOSAL DESCRIPTION A. Proposal It is proposed that: 1 . The PS&E prepared for Caltrans ' traffic signal project and then shelved, be updated and modified to be compatible with the City' s FAU project. -2- 2, Caltrans ' traffic signal project be combined with and made a part of the City' s FAU project . 3 . Existing State right-of-way for that portion of Camino Capistrano at the Route 5 southbound ramps be relinquished to the City. 4 . Existing operating State right-of-way along Camino Capistrano needed for City' s project be transferred to the City of San Juan Capistrano. A Caltrans/City Cooperative Agreement to be executed will detail the method of transfer. An Encroachment Permit will be granted the City for the construction phase. B. Cooperative Features The Contract for Caltrans ' traffic signal project , designed by Caltrans , is to be administered by the City as part of the City' s FAU project . The costs , including preliminary and construction engineering, for Caltrans ' project are to be paid by the State. Existing State right-of-way for that portion of Camino Capistrano at the southbound ramps will be relinquished to City of San Juan Capistrano. On site drainage facilities are proposed as part of the City' s FAU project within existing State R/W on Camino Capistrano. Existing operating State right-of-way needed to widen Camino Capistrano will be transferred to the City in return for benefits to the State by improved operation of the Route 5 south- bound ramps . INTRODUCTION It is proposed to install signals on Route 5, 0.1 mile south of San Juan Creek Road at the intersection of the southbound on/off-ramps at Camino Capistrano and interconnect with San Juan Creek Road to reduce congestion. Cost is estimated at $80, 000 to be funded from the HB43 Minor A Program in the 1983/84 fiscal year. This is a supplement to above project report to eliminate the cooperative agreement with the City of San Juan Capistrano. The cost and financing sections have been revised to reflect the 1008 Federal reimbursement. II. PROJECT CATEGORY ,This project is exempt per the "Procedures to Implemrent Projects under Section 176 (a) CAA" as a Category I-A, 12 project. -2- III . BACKGROUND The ramps at Camino Capistrano, a bulb connection interchange, were constructed under Contract No. 07-105224 and was completed on May 26, 1964. Signalization was not included as a part of this contract. IV. EXISTING FACILITY The southbound off-ramp from I-5 is two lanes wide at its terminus at Camino Capistrano. The southbound on-ramp from Camino Capistrano is two lanes wide at its beginning. Camino Capistrano is a two-lane facility. V. TRAFFIC DATA On January 21, 1981, there was a 4, 970 ADT on the southbound on-ramp and a 1, 950 ADT on the southbound off-ramp. There is about a 58 per year increase in traffic volumes. There have been 10 accidents from 1979 to 1981 with 6 injuries which is about 4. 5 times the expected rate. VI . DEFICIENCIES AND JUSTIFICATION There are congestion problems for left-turning vehicles exiting southbound to Camino- Capistrano and for left-turning vehicles entering the freeway southbound. There is no delay for right-turn movements . As stated previously, the accident rate is about 4. 5 times the expected rate. This project meets the signal warrants of (1) minimum vehicular volume, and ( 2) interruption of continuous traffic. There will be about 1/30 person-year of maintenance at this signalized intersection. VII. PROPOSAL DESCRIPTION A. Proposal Under Consideration It is proposed that a traffic signal with left-turn phasing for southbound traffic be installed at the intersection of Camino Capistrano at the southbound on/off-ramps and interconnected with the signal proposed by the City of San Juan Capistrano at San Juan Creek Road.
