This Program Supplement is hereby incorporated into the Local Agency -State
Agreement for Federal Aid which was entered into between the Local Agency
and the State on 01/25/84 and is subject to all the terms and conditions
thereof. This Program Supplement is adopted in accordance with Paragraph 3
of Article I of the aforementioned Master Agreement under authority of
Resolution No. 9/-6 -¢-7 approved by the Local Agency on

The Local Agency further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with the covenants or
remarks setforth on the following pages.

SPECIAL COVENANTS OR REMARKS
1. The cost of maintenance of the crossing shall be as allocated by
Public Utilities Commission.
2. All required pavement marking and advance warning signs shall
comform to the requirements of MUTCD, 1988 and shall be placed in
their proper location by the Local Agency at the time of
completion of the Railroad's work.
3. The Local Agency agrees the payment of Federal funds will be
limited to the amounts approved by the Federal Highway
Administration in the Federal -Aid Project Agreement (PR-2)/Detail
Estimate, or its modification (PR -2A) or the FNM -76, and accepts
any increases in Local Agency Funds as shown on the Finance or
Bid Letter or its modification as prepared by the Division of
Local Streets and Roads.
4. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal -Aid Program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, APPROVING THE
AGREEMENT WITH THE STATE OF CALIFORNIA FOR GRADE
CROSSING IMPROVEMENTS IN THE CITY OF SAN JUAN
CAPISTRANO
WHEREAS, The City of San Juan Capistrano is supportive of grade crossing
improvements which enhance the safety of such crossing; and,
WHEREAS, the City of San Juan Capistrano has reviewed and concurs with the
proposed improvements at Del Obispo Street and Avenida Aeropuerto; and,
WHEREAS, the LOSSAN Rail Corridor Agency has facilitated the use of
Federal Section 130 Rail -Highway Grade Crossing Improvements Program funds for grade
crossing improvements in San Juan Capistrano; and,
WHEREAS, the State of California Department of Transportation is the
contracting and coordinating agency for these grade crossing improvements and The
Atchison, Topeka and Santa Fe Railway Company will complete the actual construction.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby approve the agreement between the State of California
Department of Transportation and the City of San Juan Capistrano for grade crossing
improvements in the City of San Juan Capistrano.

SUBJECT: Rail Grade Crossing Improvements
SITUATION
A. Summary and Recommendation - Over the last year, Staff has
been working with CALTRANS, the Public Utilities Commission,
Santa Fe Railroad, and the LOSSAN Rail Corridor Agency to
facilitate grade crossing improvements at two locations in the
City of San Juan Capistrano. Through the efforts of LOSSAN,
Federal Section 130 Rail -Highway Grade Crossing Improvements
Programs funds are available for designated improvements in
the form of 90 percent federal and 10 percent local funds.
The crossings at Del Obispo and Avenida Aeropuerto would be
improved with cantilever flashers to increase railroad
crossing awareness and safety. The total cost of these
improvements is estimated at $82,038.00; the City's portion
would be $8,204.00. Staff recommends that the City Council
enter into the attached agreement with State of California
Department of Transportation for the completion of this work.
B. Background - In 1987, the City Council passed a Resolution
supporting the LOSSAN Rail Corridor Study and its
implementation. This study provided for various improvements
along the LOSSAN corridor to support intercity and commuter
rail. LOSSAN has been working with member cities, CALTRANS,
and the railroad to facilitate rail improvements along the
corridor, such as rail replacement and the rubberized crossing
that were installed last year. The City has participated and
will continue to participate in a variety of ways such as
trimming trees, providing advance warning signage and pavement
markings at various crossings, and notifying surrounding
residents of improvements.
As part of this on-going rail improvement program, Federal
Section 130 funds have been identified for grade crossing
improvements to enhance safety. These funds are available
based on a 90 percent federal and 10 percent local match.
CALTRANS will enter into Agreements with the local
jurisdictions for these improvements and their portion of the
match. CALTRANS will then coordinate the improvements with
the Santa Fe Railway Company who will be responsible for
completing the work. The work is expected to be completed by
the fall of 1991.
