1982-0316_WOODSIDE- KUBOTA / ASSOCIATES_Engineering Svcs Agreement"CITY COPY" AGREEMENT FOR RIGHT OF WAY ENGINEERING SERVICES CITY OF SAN JUAN CAPISTRANO, CALIFORNIA THIS AGREEMENT, made and entered into this 16th day of March, 1982, by and between the City of San Juan Capistrano, a body politic of the State of California, hereinafter designated as "CITY", and Woodside/Kubota & Associates, Inc., hereinafter designated as "ENGINEER." W I T N E S S E T H: WHEREAS, CITY intends to improve the southwest corner of the intersection of Alipaz Street and Del Obispo Street; and WHEREAS, CITY desires to retain ENGINEER to conduct the preliminary design and right of way engineering for said improvements. NOW, THEREFORE, it is mutually agreed by and between CITY and ENGINEER as follows: 1. The terms and conditions in ENGINEER'S letter to CITY, dated March 8, 1982, and attached hereto as Exhibit "A", are acceptable to both parties. The preliminary plan would be drawn on a City -furnished standard sheet according to Orange County standards. The right-of-way documents will be for street, slope and utility purposes. Field surveys will be made to locate all obstructions, utilities and existing topo along with all neces- sary elevations. All necessary survey data will be shown on the prelimin- ary plan in such a way that it can be used as the basis for a future final construction plan. Right-of-way documents will be prepared on City easement forms and will include all necessary legal descriptions and plat maps to properly cover all land needed for street purposes, slope easements and any utility for overhead or underground facilities. We would obtain a title report for the property. All work will be coordinated with City staff and be subject to their ap- proval. It is understood that the City will furnish standard sheets, plans of existing improvements, and any other pertinent data and will pro- vide the appraisal for the property. Woodside/Kubota & Associates, Inc. will negotiate with the property owner for a settlement based upon the furnished appraisal. Included in the negotiations would be possible improvements such as driveways, underground- ing utilities, replacement of trees, etc. Any items not required as re- placement of existing improvements would be discussed as being installed by the City and the cost thereof deducted from the appraised value of the land in the easements. If a settlement can't be reached within the basic limits established by the appraisal, the City staff would be consulted. Billing would be monthly. If field surveys are not necessary the maximum could be reduced by $1,000. We would be prepared to commence immediately upon receiving Notice to Proceed.
