(53) Report dated March 20, 1984, from the Director of Public
(82) Works, forwarding an agreement with Caltrans which formally
establishes a means by which costs for State Highway
electrical facilities within the City are proportionally
shared. Only those facilities where City streets meet State
Highways will be affected. The report advises that the City
currently shares in those costs and has $3,500 allocated in
the 1983-84 fiscal budget, Account No. 01-4440-213-460.
Adoption of Resolution/Agreement:
It was moved by Councilman Hausdorfer, seconded by
Councilman Friess that the following Resolution be adopted:
RESOLUTION NO. 84-3-20-4, COST SHARING OF STATE HIGHWAY
ELECTRICAL FACILITIES - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
APPROVING AN AGREEMENT FOR THE COST-SHARING OF STATE
HIGHWAY ELECTRICAL FACILITIES IN THE CITY OF SAN JUAN
CAPISTRANO
The motion carried by the following vote:
AYES: Councilmen Friess, Hausdorfer, Buchheim,
and Mayor Bland
NOES: None
ABSENT: Councilman Schwartze
The Resolution approves the agreement for cost-sharing of
State Highway electrical facilities; and, authorizes the
Mayor and City Clerk to execute the document on behalf of
the City.

The attached agreement has recently been submitted by Caltrans to
the City for approval. It formally establishes a means by which
costs for State highway electrical facilities within the City are
proportionally shared. It should be pointed out that only those
facilities (see Exhibit A) where City streets meet State highways
are affected.

FINANCIAL CONSIDERATIONS
The City currently shares in these costs and has $3,500 allocated
in the 1983-84 fiscal budget for this purpose within the
01-4440-213-460 account.
ALTERNATE ACTIONS
1. Approve the agreement.
2. Do not approve the agreement.
3. Request further information from staff.
RECOMMENDATION
By resolution, approve the agreement with the State for the cost-
sharing of State highway electrical facilities within the City,
and authorize the Mayor and City Clerk to execute the appropriate
documents.

Attached are two copies of an Agreement for sharing cost of
utilities between the City and State on a pro -rata basis. Please
note that Section E, Legal Relations and Responsibilities has been
deleted from this Agreement with the concurrence of the State's
attorneys.
Please have the City officials execute their portion of the
Agreement and adopt a resolution approving the Agreement. Upon
completion, please return both copies of the Agreement to the
District for final processing.
When the Agreement has been signed by the District Director, we
will return a fully executed copy for your files.

This Agreement will supersede portions of the Agreement for
Maintenance of State Highways effective July 1, 1964.

THIS AGREEMENT made and executed in duplicate this 2 3 AeCL day

by throughthe Department of Transportation, hereinafter referred t&is
"STATE" and the CITY of SAN JUAN CAPISTRANO hereinafter referred as to
CITY.
WITNESSETH:
This agreement shall supersede any previous agreement and/or amendments
thereto for sharing State incurred costs in the CITY with the CITY.
ELECTRICAL FPCILITIES
Electrical facilities include flashing beacons, traffic signals,
traffic -signal systems, safety lighting and sign lighting on the
State Highway System.
The cost of operating and maintaining flashing beacons, traffic signals,
traffic -signal systems, safety lighting, and sign lighting now in place at
the intersection of any state highway route and any city street/road shall
be shared as shown in Exhibit A.
Basis for billing:
It is agreed that monthly billings for flashing beacons,
traffic signals, and traffic -signal systems shall be
based on actual intersection costs which are as follows:

It is agreed that monthly billings for safety lighting and sign lighting

It is agreed that monthly billings for utility-ouned and maintained
lighting will be based on calculated unit costs derived from utility
company billings.
Exhibit A will be amended as necessary by written concurrence of both
parties to reflect changes to the system.
This Agreement shall become effective Sul 1 1983 and shall
remain in full force and effect until amend or terminated.
The Agreement as above may be amended or terminated at any time upon
mutual consent of the parties thereto. This Agreement may also be
terminated by either party upon thirty (30) days' notice to the other
party-

WHEREAS, the State of California, through its
Department of Transportation has presented an Agreement for the
cost-sharing of State highway electrical facilities in the City
of San Juan Capistrano effective as of July 1, 1983, and to
remain in effect until amended or terminated; and,
WHEREAS, the City Council has read said Agreement in
full and is familiar with the contents thereof.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of San Juan Capistrano that said Agreement for the
cost-sharing of State highway electrical facilities in the City
is hereby approved and the Mayor and the City Clerk are directed
to sign the same on behalf of the City.
