This agreement, made and entered into this 19th day
of July, 1983, by and between the City of San Juan Capistrano,
a body politic of the State of California, hereinafter desig-
nated at "CITY", and the Roman Catholic Bishop of Orange, a
Corporation Sole, hereinafter designated as "CHURCH".
WITNESSETH:
WHEREAS, the CHURCH is planning to provide two
parking lots for the Great Stone Church, now under construction;
and,
WHEREAS, the City is planning to provide a parking
lot for the library now under construction; and,
WHEREAS, the City wishes to share one of the parking
lots for the library and community room when not in use by
the CHURCH: and,
WHEREAS, the library is closed on Sundays and will
not interfere with CHURCH'S peak parking period.
NOW, THEREFORE, it is mutually agreed by and between
the CITY and CHURCH as follows:
1. CHURCH agrees to allow library and community
room patrons the use of its parking lot on
E1 Camino Real/E1 Horno Street when not in
use for CHURCH activities.
2. CITY agrees to allow CHURCH the use of library
parking lot on El Camino Real when not in use
for library activities.
3. CITY agrees to pay the full cost of grading
the El Camino Real/E1 Horno Street lot if
grading can commence by August 1, 1983, and
if CITY has the right to use the lot in an
unimproved condition until such time as the
CHURCH is ready to proceed with full improvements.

years from the date of this agreement, at whic
time it will be re-evaluated

Agreement for Joint Use of Parking Lot
At their meeting of July 19, 1983, the City Council
approved the Agreement for joint use of the parking lot on E1
Horno Street and authorized staff to begin preparation of plans
and specifications for the necessary improvements. The Agreement
was amended to delete the words "for continuance" from the last
line of Article 5.
A fully -executed copy of the Agreement is enclosed for

(52) Report dated July 19, 1983, from the Senior Administrative
(63) Assistant, forwarding an agreement with the Diocese of
Orange for joint use of the parking lot on E1 Horno Street
for Church and Library patrons. The report recommends a
revision to the agreement to strike the works "for
continuance" from the last line of Article 5. Funds in the
amount of $32,000 have been budgeted in the 1983-84 budget.
Approval of Joint Use:
It was moved by Councilman Buchheim, seconded by Councilman
Hausdorfer and unanimously carried to approve the revised
agreement with the Diocese of Orange for joint use of its E1
Horno Street parking lot for Church and Library patrons, and
to authorize staff to begin preparation of plans and
specifications for necessary improvements. The Mayor and
City Clerk were authorized to execute the document on behalf
of the City.

SUBJECT: Agreement for Library Parking Lot (Diocese of Orange)
SITUATION:
Attached is an agreement between the City of San Juan Capistrano and the Diocese
of Orange regarding joint use of its proposed parking lot on El Horno Street for
Church and Library patrons. The only change recommended is that Article 5 be
amended to strike the last two words, "for continuance." The agreement can be
re-evaluated as often as the Diocese wishes, but continuance must never be in
question if public funds are used for improvements. This agreement will allow
the City to provide 108 parking spaces across from the Library. Improvements
will include rough grading, a rustic gravel surface, and realignment of the
E1 Horno/El Camino Real intersection.
COMMISSION/BOARD REVIEW, RECOMMENDATIONS:
Not applicable.
FINANCIAL CONSIDERATIONS:
There are funds budgeted for Church/Library parking lot improvements in the
1983-84 budget in the amount of $32,000. An account number has not yet been
assigned.
ALTERNATE ACTIONS:
1. Approve the agreement with the revision and authorize staff to prepare plans
and specifications for the project.
2. Approve the agreement with additional revisions.
3. Request further information.

RECOMMENDATION:
By motion, approve the revised agreement with the Diocese of Orange for joint
use of its E1 Horno Street parking lot for Church and Library patrons, and
authorize staff to begin preparation of plans and specifications for necessary
