CITY shall giant OWNER a permit to maintain said wall in CITY' s easement subject to the terms and conditions hereinafter set forth. 2 . OWNER agrees to provide and maintain openings of a minimum cross sectional area of six (6) square feet at the base of the wall. at both the easterly and westerly boundaries of said Lot 2. The opening shall insure that surface drainage in CITY' s easement is not diverted. onto Lot 3 of Tract 9373 and passes across OWNER' s Lot 2 of Tract 9373 . 3 . OWNER further agrees to pay CITY' s cost and provide approval of removing the wall From said storm drain easement if said Openings are not constructed by 5:00 p.m. September 30 , 1981. 4. OWNER shall be soleyresponsible for said storm drain from any damage arising from the placement of the wall and within CITY' s easement. OWNER agrees, moreover, to bear the expense of removing said wall for any repair or maintenance to the pipeline required by the City. 5. OWNER agrees to hold CITY harmless from any and all claims arising from the placement of the wall in CITY's easement. 14139Po 135U 6. A roval: It was moved by Councilman Nausdorfer, seconded by cvuncrl- man Buchheim, and unanimously carried to approve the Agree- ment with the owner, Keith L. Murphy, Director of Public Works SUBJECT: Agreement to Maintain Decorative Block Wall Over City Storm Drain Easement, Paseo Establo, Lot 2 Tract 9373 (Powell) SITUATION Staff is requesting approval of an agreement to permit a block wall across a City easement. The easement in question is adjacent to the equestrian trail at the southerly boundary of Tract 9373 (Patrick) and was the subject of concern by the Allen family in 1980 . The wall was constructed across the easement without a permit, and the agreement calls for obligations and corrections to the wall allowing for City maintenance and drainage . A map is attached indicating the wall location. FINANCIAL CONSIDERATIONS The provisions of the agreement require that the property owner pays for the removal of the wall and repair to the storm drain, if necessary. ALTERNATE ACTIONS 1. Approve the agreement. 2 . Deny the agreement and require removal of the wall. 3. Direct that the agreement be modified. RECOMMENDATION By motion, approve the agreement for private maintenance of a decorative block wall over the City drainage easement on Lot 2 of Tract 9373 and authorize the Mayor and City Clerk to execute the document on behalf of the City.
