HUD GRANT AGREEMENT

This Agreement is made by and between the City of San Juan Capistrano ("City')
and Mission San Juan Capistrano ("Mission").
RECITALS
1. The City applied to the United States Department of Housing and Urban
Development ("HUD") for a grant to be used for the rehabilitation and historic preservation
of Mission San Juan Capistrano. A copy of the City's grant application is attached as
Exhibit A and is incorporated into this Agreement by reference.
2. That grant application was accepted, and HUD has agreed to nine hundred
twenty five thousand dollars ($925,000) grant to the City, which will, in turn, sub -grant the
moneys to the Mission. As part of that grant process, the City is required to enter into a
"Grant Agreement" with HUD setting forth certain requirements and responsibilities of the
City. In a separate correspondence, HUD has advised that Davis -Bacon requirements do
not apply to this EDI Special Projects Grant, unless it is combined with otherfunding which
does require adherence to Davis Bacon.
3. Among the City's responsibilities pursuant to the "Grant Agreement" is that it
enter into a contract with the Mission, as the sub -grantee, giving for designated aspects
of project performance as identified in the City's Application and the "Grant Agreement."
This Agreement is meant to satisfy that requirement of the "Grant Agreement" and to
obligate the Mission to carry -out those responsibilities.
TERMS AND CONDITIONS
NOW THEREFORE, in consideration of the above, the Mission agrees as follows:
The Mission will hire contractors, subcontractors, and others necessary to ensure
rehabilitation and historic preservation of the Mission San Juan Capistrano. The Mission
will ensure that all of the requirements of the "Grant Agreement" over which the Mission
has control will be met. In particular, the Mission will ensure that the following
requirements of the Article II, Section C, of the Grant Agreement are met:
(1) The activities to be undertaken by the Mission, consistent with the
activities described in the City's application as modified by Article
VIII(A) of the Grant Agreement.
(2) All applicable equal opportunity requirements set forth in Article I,
Section B, of the Grant Agreement.
(3) Anti -lobbying requirements in 24 CFR Part 87, including the
requirement to provide certain certifications and/or disclosures to the

City.
(4) The requirements of 24 CFR Part 84 or Part 85 as appropriate and
Treasury Circular 1075, that grants funds shall not be requested or
disbursed by the City until needed and shall be the minimum amount
necessary. Additional requirements for drawdowns are in Articles III
and IV.
(5) The cost charges to the grant must be allowable (including the
"reasonable and necessary" standard) and allocable as specified in
OMB Circular A087, A-122 or A-21 (cost principles for Institutions of
Higher Education) as appropriate.
(6) 24 CFR Part 84 or Part 85 requirements related to retention of
records, open access to records by HUD and the City, reporting,
project close out, later disallowance and adjustments, and collection
of amounts due.

At their meeting of May 2, 2000, the City Council of the City of San Juan Capistrano
approved an agreement with the Mission San Juan Capistrano relating to the 2000 EDI
Special Project Grant for rehabilitation and historic preservation of the Mission. A fully

7. APPROVAL OF TIME LIMITED PARKING ON ALIPAZ STREET SOUTH OF

As set forth in the Report dated May 2, 2000, from the Engineering and Building
Director, the following Resolution was adopted approving installation of a 2 -hour time
limited parking zone in front of the businesses at 32111 and 32141 Alipaz Street, as
requested by those business owners:

the bid for purchase of 17 replacement computer workstations was awarded to the low
bidder, GST Micro City in the amount of $13,133.64. Council also received copies of
a corrected Attachment 1, summarizing the bid proposals that had been received.
9. APPROVAL OF CITY MANAGER COMPENSATION (600.30)

As set forth in the Report dated May 2, 2000, from the Mayor, the City Manager was
placed at the fifth step of his salary range, as set out in Resolution No. 99-9-21-2,
effective February 16, 2000.

Manager, the HUD Grant Agreement with the Mission San Juan Capistrano as sub -
Grantee was approved for purposes of the 2000 EDI Special Project Grant for
rehabilitation and historic preservation of the Mission and to assure compliance with
Federal requirements of the Grant.
11. APPROVAL OF AGREEMENT FOR WATER SERVICES WITH SOUTH COAST
WATER DISTRICT (600.50)
As set forth in the Report dated May 2, 2000, the Water Services Agreement with the
South Coast Water District, allowing the City to provide water services outside its
boundaries to a portion of Dana Point, an action required by the Local Agency
Formation Commission's approval of the merger of the Capistrano Valley Water District
and the City, was approved.

RECOMMENDATION:
By motion, approve the attached agreement with the Mission San Juan Capistrano as sub -
Grantee for purposes of the 2000 EDI Special Project Grant from HUD.
SITUATION:
In the Federal Budget, the Mission San Juan Capistrano was awarded $1,000,000 through
the Department of Housing and Urban Development (HUD) to assist the Mission with its
historic preservation and rehabilitation. Those funds were reduced to $925,000.
The grant is structured so that the funds are passed to a local unit of government (in this
case the City of San Juan Capistrano) and then given to the Mission as reimbursable for
work in progress. As the Grantee, the City is obligated to ensure that the grant funding
is allocated to the Mission in a manner which meets all HUD requirements. Obligations
include assuring that equal opportunity requirements, procurement, and record keeping
requirements are met. The City will be required to enforce compliance by the sub -grantee,
the Mission San Juan Capistrano, with the terms of the agreement.
The attached agreement obligates the Mission to comply with the necessary federal
requirements. Following the execution of the attached agreement, and once HUD has
given the necessary environmental clearance, the City may begin drawing down funds.
The funds will then be forwarded to the Mission in accordance with the provisions of the
agreement. At this time, it is recommended that the City Council approve the attached
agreement and authorize the Mayor to execute it on behalf of the City.

The $925,000 grant is critical for the Mission's preservation. Concurrently the Mission
continues to secure private and public funding commitments necessary to complete it's
preservation and conservation.
