SITUATION:

On October 5, 1987, the City of San Juan Capistrano entered into a License Agreement
with John McGraw for the purpose of constructing a wrought iron fence or gate within an
equestrian easement.
The contract states the term of the license agreement shall be for a period of two years
at which time the Property Owner and City shall review whether the fencing
arrangement is satisfactory to both parties. The two-year period is due to expire on
October 5, 1989.
On December 7, 1989, Tony Foster asked to be reminded in a year.
On November 30, 1990, Tony Foster stated that agreement is still in existence and to
remind him in a year.

LICENSE AGREEMENT
THIS LICENSE AGREEMENT is made this 5th day of October , 1987
by and between the CITY OF SAN JUAN CAPISTRANO, a Municipal corporation
hereinafter referred to as "City," and JOHN MCGRAW, an individual hereinafter
referred to as "Property Owner."
Recitals
WHEREAS, City owns an easement (hereinafter referred to as feeder trail) for
equestrian trail purposes located on Property Owner's land more particularly described as
31591 Aguacate Road, San Juan Capistrano; and
WHEREAS, the purpose of the easement is to give access to Parcels 10 and l l of
Tract No. 9795 to a major City equestrian trail; and
WHEREAS, Property Owner acknowledges the right of the owner of Parcel I l to
utilize said easement for access to the City's equestrian trail; and
WHEREAS, Property Owner has presented a gating plan to restrict other members
of the public from entering on or upon the feeder trail easement; and
WHEREAS, the City has no objection to installing a gating arrangement which will
restrict members of the general public from using said easement,
NOW, THEREFORE, BE IT RESOLVED between City and Property Owner as
follows:
1. City hereby grants to Property Owner a license for the purpose of allowing
Property Owner to construct a wrought iron fence or gate as set forth on the site plan
attached as Exhibit A and incorporated herein by reference. The wrought iron fence
shall be maintained at all times in strict conformance with the site plan attached hereto
as Exhibit A.
2. Property Owner agrees that he shall cooperate with the property owner of
Parcel 1 l to make the feeder easement on Property Owner's land available at all times to
the owner of Parcel l I for use of the feeder equestrian easement.
3. Property Owner agrees to hold City, its elected and appointed officials, and
employees harmless from any and all claims and liabilities which may arise out of
Property Owner's installation of said wrought iron fence or from any other claims or
liabilities arising out of usage of the equestrian easement.
4. The term of this license shall be for a period of two years at which time
Property Owner and City shall review whether the fencing arrangement is satisfactory to
both parties.
