hereinafter referred to as "COMPANY".
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES
CONTAINED HEREIN, THE PARTIES HERETO AGREE AS
FOLLOWS:
1. COMPANY shall process all parking citations issued by
AGENCY as provided in the following statement of work:
1. 1 Collection. COMPANY will provide for collection of
parking citation penalty amounts via mail to COMPANY'S
"Parking Administration" Post Office Box in accordance
with COMPANY'S established procedures. COMPANY will
provide for telephone and written interaction with
defendants. Daily collections will go directly into a
AGENCY account or as directed by AGENCY. Determination
of type of account and control of disbursements from
account is strictly a matter between the AGENCY and the
bank. Output from this task will be:
a) Monthly reporting on clearances by parking penalty
amount, detailed by citation number. (Note: this
detail will not include clearances not handled by
COMPANY) . Reports will provide complete audit trail
on citation transactions.
b) Transmittal forms and instructions regarding any
required disbursements of surcharges or fees (such as
DMV fees, court fees, court house building
surcharges, etc. )
1. 2 Management. COMPANY will receive, store and provide
retrieval of all citations.
1. 3 Data Entry and Registered Owner Inquiry. COMPANY will:
code and enter into a computerized notification system
the following data on hand-written citation and
retrieve, from personal computer (PC) , located on site,
uploaded citations from automated hand-held ticket
writer units:
a) Citation number
b) Date and time issued
c) License number and state
d) Make of vehicle
e) Violation code(s) (up to two per citation)
f) Parking penalty
g) Court appearance date
Output from this task will be:
a) Registered owner inquiries will be forwarded to DMV.
b) A printed listing containing key data on all
citations in citation number order.
c) A license number index to the citation listing.
1. 4 Registered Owner Notification. COMPANY will process
DMV's replies. An edit check will be made to delete
records with unreasonable discrepancies between the
vehicle make as noted on the citation and in the DMV
files. Notices of Intent as prescribed by CVC Section
40206 will be printed and mailed to registered owners.
1. 5 Notify DMV of Non-Compliance. COMPANY will acquire
data on clearances and, after the due date, will notify
DMV to place registration holds on vehicles for which no
response to the Notice of Intent was made.
1. 6 Lessee/Renter Notification. COMPANY will, at AGENCY'S
option, forward to lessees or renters valid notices of
intent which are returned to collecting agency claiming
lessee/rental as a defense against the charge(s) .
2 . AGENCY shall pay COMPANY as follows:
$1. 05 per citation filed
(optional fees on attachment A and B)
3 . This agreement shall become effective on T )ILA /9q3
and shall continue in full force and effect u�il+
terminated.
4 . This agreement may be terminated without cause upon
thirty (30) days written notice to the other party.
5. COMPANY shall invoice the AGENCY each month for
citations processed under this agreement during the
previous month.
6. AGENCY shall pay COMPANY within thirty (30) working days
after receipt of each invoice.
7 . COMPANY shall perform services under this agreement as
an independent contractor. Neither COMPANY nor its
officers, agents or employees shall be considered
employees of AGENCY. Rights and obligations of COMPANY
with AGENCY shall arise only from this agreement.
COMPANY shall retain all responsibility and authority
over its officers, agents and employees related to
fulfilling obligations under this agreement.
8 . COMPANY agrees to perform the services required under
this agreement with good workmanship in the art, skills,
and trades agreed to hereunder consistent with generally
accepted data processing procedures.
9 . COMPANY agrees that all citations, reports, analyses,
audits, computer tapes or cards, or other material
documents or data and working papers, whether or not in
final form, which have been obtained or prepared under
this agreement, shall be deemed the property of the
AGENCY and same shall be returned to the AGENCY upon
termination of this agreement.
10. AGENCY agrees to hold harmless and defend any legal
action commenced against COMPANY caused directly or
indirectly by wrongful or negligent acts of AGENCY'S
officers, employees, agents, or others engaged by
AGENCY and to indemnify COMPANY against any liability,
loss, cost or damages, including attorney 's fees
resulting therefrom.
11. COMPANY agrees to hold harmless and defend any legal
action commenced against AGENCY caused directly or
indirectly by wrongful or negligent acts of COMPANY'S
officers, employees, agents, or others engaged by
COMPANY and to indemnify AGENCY against any liability,
loss, cost or damages, including attorney's fees
resulting therefrom.
11. 1 In order to secure COMPANY'S obligations to hold AGENCY
harmless, COMPANY agrees to procure and maintain the
following:
a) Worker 's compensation insurance coverage for its
employees as prescribed by the State of California.
b) Comprehensive general liability policy coverage with
$500, 000 single limit liability.
11. 2 COMPANY agrees to furnish AGENCY with certificates of
insurance, evidencing the required coverages. COMPANY
shall name AGENCY as an additional insured on the
comprehensive general liability insurance policy. Both
certificates shall provide that each insurance carrier
shall give AGENCY thirty (30) days written notice prior
to any action by the carrier to reduce or terminate the
policy.
12 . Termination of Agreement. Upon termination of this
agreement for any reason, COMPANY shall not be
responsible for the retention and processing of
AGENCY'S data files for a period in excess of ninety
(90) days following notification of such termination.
During that period of time COMPANY agrees to cooperate
and assist AGENCY with the orderly transmission of
AGENCY data to whatever point of delivery designated by
AGENCY.
13 . This agreement expresses the full understanding between
the parties. Any changes or revision to the terms and
conditions hereof shall be made by written amendment and
shall be executed by persons authorized to do so by the
respective parties.

HEARING EXAMINER FEE
If AGENCY chooses, COMPANY will provide the services of a
qualified Hearing Examiner (typically a retired law
enforcement officer) , who will conduct hearings regarding
contested parking citations.
The location for these hearings will be provided by the
AGENCY and need to be set in an office in the City Hall,
council chambers, law enforcement building or other secure
space.
It is estimated that for the total South County (including
all unincorporated areas, the Airport and other agencies
included in the Sheriff ' s jurisdiction) , a hearing examiner
would be needed for approximately one to one-and-a-half days
per month. This estimation may be adjusted to suit the needs
of the AGENCIES.
The fee for the Hearing Examiner is $250. 00 per half-day and
will be pro-rated for each AGENCY dependant upon the quantity
of citations written by each AGENCY.

AUTOMATED PARKING CITATION PROCESSING SYSTEM
PROCESSING AND TICKET WRITER LEASE FEE
The cost for processing citations using the hand-held ticket
writer and/or manually written citations is $1. 05 for full-
service.
The lease fee for the hand-held ticket writer is as follows:
For every 1, 000 citations written per month, a ticket writer
will be provided at no cost to the Agency. (Ex: If the Agency
issues 2, 500 cites per month, two hand-held ticket writers
would be provided) .
If the quantity of citations falls under 1, 000 per month, a
lease fee of $100. 00 will be charged. (Ex: If the Agency
issues 2 , 500 cites per month and requests 3 hand-held ticket
writers, the first two would be provided at no cost and the
third would be $100 .00 per month. If the quantity increased
to 3 , 000 the next month, the third hand-held ticket writer
would be provided at no cost) .

1. INSURED. The City and the Community Redevelopment Agency, Its elected or appointed
officers, officials, employees and volunteers are included as insureds with regard to damages
and defense of claims arising from: (a) activities performed by or on behalf of the Named
Insured, (b) products and completed operations 'of the Named insured, or (c) premises owned,
leased or used by the Named Insured.
2. CONTRIBUTION NOT REQUIRED. As respects.- (a) work performed by the Named Insured
for or on behalf of the City; or (b) products sold by the Named Insured to the City; or (e)
premises leased by the Named Insured from the City, the Insurance afforded by this policy
shall be primary insurance as respects the City, its elected or appointed officers, officials,

Written Communication:
Report dated July 6, 1993, from Lt. Dan Martini of the San Juan Capistrano Police Services,
recommending that the City contract with Judicial Data for the processing of all parking citations
generated in the City,which would increase the amount the City's receives from each citation by 100%.
Consideration of the Contract was the result of Assembly Bill 408, effective July 1, 1993, which
decriminalized all parking violations and removed them from the criminal court process;and,transferred
responsibility for citation processing,citation review,and collection of fines from the courts to individual
cities.
IA. Martini made an oral presentation.
Council Member Campbell inquired bow much revenue the City currently receives from the issuance
of citations. Ms. Pendleton advised that the City received approximately 545,000 in revenue from
parking fines issued in the 1992-93 fiscal year, and $90,000 was projected for the 1993-94 fiscal year.

It was moved by Council Member Hausdorfer, seconded by Council Member Nash, and unanimously
carried that:
(1) The Agreement between the City and Judicial Data Systems Corporation be approved for the
processing of all parking citations generated in the City, effective July 6, 1993.
(2) Judicial Data seek, through the citation processing, the collection of appropriate fines and
revenue returns to the City.
(3) The purchase of one hand-held ticket writing unit be approved in the amount of S3,100.

1. APPROVAL OF FIVE-YEAR CONTRACT FOR AUDIT SERVICES (DIEHL EVANS&
COMPANY) 30)
Written Communication
Report dated July 6,1993,from the Interim Director of Administrative Services,recommending that the
City rotate auditors every five years and summarizing the proposals received from five firms that met
the criteria outlined in the Report. Staff recommended that the firm of Diehl, Evans & Company be
retained to conduct the annual audits of the City for a five-year period.
Ms. Pendleton made an oral presentation.
Council Member Vasquez inquired about the term of the contract and was advised that the 5-year term
allows a period for orientation of the new auditors to the City's system, after which more time would
then be spent by the auditors in evaluating the City's system and providing input. Ms. Pendleton noted
that a five-year contract is considered standard in the industry. Council Member Vasquez suggested that
a three-year contract with a two-year renewal option be considered in order to create opportunities for
the less experienced firms. Council Member Hausdorfer concurred with the contract revision in order

SUBJECT: Consideration of Contract for Parking Citation Processing
RECOMMENDATION:
By motion, the City of San Juan Capistrano contract with Judicial Data for the processing of all
parking citations generated in the City and that Judicial Data seek through the citation
processing, the collection of appropriate fines and revenue returns to the City of San Juan
Capistrano.
BACKGROUND:
As part of the Law Enforcement Services contract with the City of San Juan Capistrano the
Orange County Sheriff's Department enforces all California Vehicle Code and San Juan
Capistrano Municipal Code parking regulations. This is accomplished by both field deputies and
the parking control officer issuing citations. All citations generated in the City of San Juan
Capistrano are forwarded to the South Orange County Municipal Court for adjudication and
collection of fines. Currently the City of San Juan Capistrano receives approximately 30% or
$9/ per citation for the average $27.00 parking fine. The implementation of this contract would
increase the City revenue to $18.95 per average citation {100% increase}. This 100% increase
in revenue is reflected in the proposaed FY 1993-94 budget.
SITUATION:
State Assembly Bill 408 (Decriminalization of Parking Citations) becomes effective on July 1,
1993. AB 408 impacts the City of San Juan Capistrano with two major changes to the current
"court processed" parking citation procedures(s):
• Decriminalization of all parking violations and removal from the criminal
court process.
• Transfers responsibility for citation processing, hearing (citation review), and
collection of appropriate fines from the courts to the individual city(s).
FOR CITY COUNCIL AGEN I
AB 408 changes can be implemented on July 1, 1993, but must be operational by
January 1, 1994.
To facilitate these changes and to effectively transfer authority to the individual cities involved
with contract law enforcement from the Orange County Sheriff's Department, representatives
from Police Services of Mission Viejo, Laguna Hills, and Dana Point/San Juan Capistrano
conducted a study of several private firms capable of assuming the parking citation processing
for the cities. The intent of the study group was to locate the most capable and reliable firm to
represent all cities. The companies reviewed are:
Turbo Data
Data Ticket
Judicial Data
It is estimated that the Orange County Sheriff's Department will annually generate approximately
54,000 (plus) parking citations countywide in the contract cities, airport complex, and the
unincorporated areas. None of the companies offer a decrease in pricing based on the total
number of citations generated. All companies are willing to contract individually with each city
area separately. It was determined that for consistency in the processing of the citations, one
firm should be selected to represent all concerns.
The completed study offers an insight into the various functions of the companies surveyed.
There are several differences worth noting:
• Both Data Ticket and Turbo Data provide out-of-state collections; Judicial
Data does not [ Judicial data contracts this service from Turbo Data].
• Judicial Data will provide the Sheriffs Department with four (4) automatic
ticket writers at no cost. One of these units will be supplied to San Juan
Capistrano. These units are available through other firms for approximately
$3,100 each.
• Data Ticket and Judicial Data will provide two (2) on-site computers to be
located at the Sheriffs Sub Station, at no charge. This will allow the down-
loading of the hand held ticket writer information and for the retrieval of
citation statistical information.
• The Department of Motor Vehicle charges $3 per citation for registration holds
placed on citations not collected. Data Ticket will absorb the $3 fee per citation
for Department of Motor Vehicle holds on citations not collected. Turbo Data
and Judicial Data will subtract the $3 fee from any return to the city.
• Data Ticket requires a second notice to the violator be initiated prior to a
DMV hold being placed. When the second notice is sent, Data Ticket collects
50% of the monies received in payment for the citation.
State Assembly Bill 408 provides that individual cities may adjust their own bail schedules as
it relates to parking citations. It is important that all jurisdictions coordinate this effort to be
consistent within a judicial district to mitigate any potential litigation. This procedure has been
in effect in the South Orange County Judicial District for several years.

The financial responsibility to the City of San Juan Capistrano will be the cost for additional
hand held ticket writers. The recommended company, Judicial Data, will supply to the City of
San Juan Capistrano one (1) hand held unit at no cost. It is recommended the City purchase an
additional hand held writer (1) at a cost of approximately $3,100. This cost is in the 1993-94
budget and will be off-set by the additional revenue generated from this new approach.
The costs that would be incurred by the City of San Juan Capistrano would be substantially
higher if this process was handled in-house. These costs would include both staff time and
equipment costs. The staff time would be both for the processing of the citations and to convene
the required hearings. The equipment costs would be for the computer equipment required for
the data tracking and auditing that are required under the Assembly Bill.
NOTIFICATION:
None required by this action.
ALTERNATE ACTIONS:
1. The City contract with Judicial Data
2. The City decline to contract with Judicial Data in favor of another vendor
3. The City take this entire issue under advisement for further study.
RECOMMENDATION:
By motion, the City of San Juan Capistrano contract with Judicial Data for the processing of all
parking citations generated in the City and that Judicial Data seek through the citation
processing, the collection of appropriate fines and revenue returns to the City of San Juan
Capistrano. It is further recommended that the City of San Juan Capistrano purchase an

criminal court, or contested there (except after agency hearing and citizen wishes to

EXECUTIVE SUMMARY

State Assembly Bill 408, which becomes effective July 1,
1993, accomplishes two things. Number one, it
decriminalizes all parking violations and, number two, it
transfers responsibility for citation processing and fine
collection from the courts to the individual cities .
1 These changes can be implemented on July 1, 1993, but
' must be operational on January 1, 1994 .
In order to facilitate these changes, members of the
Sheriff's Department's South operations Division
interviewed representatives from three private firms
' which are currently processing citations and collecting
fines for other jurisdictions. These companies are;
Turbo Data, Data Ticket and Judicial Data.
1 While none of these companies would provide any price
break for the 54, 000 plus parking citations issued
annually in our contract cities, airport, and the
{ unincorporated area, the prices quoted assumes one vendor
i will be contracted with for these services. Each of
these firms is willing to contract with the
cities/airport/unincorporated area separately.
We have included a chart for comparison of the three
firms' offers. There are several differences worth an
additional mention.
1. Both Data Ticket and Turbo Data provides for out-of-
state collections; Judicial Data does not.
2. Judicial Data will provide the Sheriff's Department
with four (4) automatic ticket writers at no cost. These
are available through the other firms for about $3, 000
each.
j 3 . Data Ticket and Judicial Data will provide two on-
site computers, at no charge, for the down-loading of the
hand held ticket writers and for the retrieval of
citation statistical information.
4 . Data Ticket will absorb the $3 .00 fee per citation
for the placigg of Department of Motor vehicles holds on
those citations not paid. With Turbo Data and Judicial

RECOMMENDATION
I Of the three firms submitting proposals, Data Ticket
projects a net revenue to the cities/unincorporated area
of $19.05 per citation if the violator pays immediately
or after receiving the first notice. Judicial Data
projects the next highest net revenue of $18 . 95 per
citation and Turbo Data is last with $18 .71 per citation
paid at least upon receipt of the first notice.
JData Ticket, however, requires that they send a second
notice prior to placing a DMV hold and after this second
t notice is sent, they take 50% of all monies paid by the
violator. Once the DMV hold is placed, they state they
will waive the 50% collection fee.
Data Ticket' s price is good only as long as the major
ticket writers contract with them. Should an entity
which writes a large volume contracts with someone else,
they reserve the right to increase their per ticket
t price. Turbo Data and Judicial Data will guarantee the
price quoted regardless of the volume, subject to their
minimum charges.
Our recommendation is that all the areas served by the
t Sheriff's Department contract with Judicial Data. They
f present the lowest overall cost when the 50t collection
fee for Data Ticket is considered. Data Ticket estimates
about 25t of all parking citations will be collected as
a result of the second notice. By placing the DMV hold
after the first notice, the jurisdiction will collect all
of the fine amount, minus the $3 . 00 DMV hold fee.
Judicial Data will not increase the costs should any of

the jurisdictions choose another vendor. Data Ticket
does not have any experience in billing on a per citation
t basis . Their prior experience is based of a flat
percentage charge for their services. It was the opinion
of all those involved in the interview process, that
Judicial Data, with some 12 years in this business, who
has current experience with personalized billing for the
individual cities, made the most professional,

A.B. 408 CITATION PROCESSING
The parking enforcement officer as well as the patrol deputy may
write parking citations in one of two ways: Manually or utilizing
the automatic ticket writer. These ticket writers will be issued
'i to those areas which write the highest number of parking
citations. Benefits associated with the automated procedure
include:
1. Neatness.
�. 2. Downloading capability.
3. 10-298s of vehicles cited.
Utilizing the automated ticket writer does not necessarily save
time for the traffic enforcement officer.
When the parking enforcement officer completes his shift, he
downloads his automated ticket writer at the closest designated
computer terminal. All data entered during his tour of duty is
immediately stored into the computer. The processing agency
retrieves this information for further processing. We will have
two designated computer sites. One will be at the South
Substation.
Manually written citations will be picked up twice a week. These
citations will also be processed by the vendor.
1 When a violator receives a parking citation, he can enclose payment
in the envelope provided by the citing officer. The violator mails _
his check to the vendoris P.O. Box and the money is deposited into
J an account. Each city will have its own account and the vendor
i will have no access to it other than depositing funds into it.
1 Should the violator not pay his citation after receiving it from
the issuing officer, the vendor mails a notice. A second notice is
sent out if there is no response to the first one. A D.M.V. hold
is placed on the violator' s vehicle registration if the violator
does not respond to the second notice. D.M.V. charges 3.00 dollars
to the city for each hold it places. The 3.00 dollar fee could be
recovered by adjusting the bail schedule.
If the violator desires to contest the parking citation, he may do
so by requesting an administrative hearing. The administrative
hearing has two phases. These hearings will be arranged by the
+ vendor. The vendor notifies the city of the date and time of the
hearing. Several hearings can be scheduled once a week at a
designated locatiop or can take place telephonically. The
administrative sergeant or day shift sergeant could be the initial
hearing officer. In that capacity, he decides whether or not the
party is guilty or innocent. He would also be empowered to reduce
the fine as he deems appropriate.
Should the violator not be satisfied with the sergeants decision,
he could request an additional hearing. The secondary hearing
officer could be an employee of the city (non-law enforcement) ) or
could be an individual contracted by the vendor.
' If the violator desires to further appeal his case, he could do so
by petitioning the municipal court having jurisdiction over the
location where the citation was issued. Hail would be posted by
the violator prior to the hearing. if the violator wins his
appeal, the money is refunded and the citation is dismissed. The
various courts in the county may have additional requirements for
this last hearing. They are currently working on the details so
that things are in place by July 1, 1993,

Our parking citation collection service includes daily pickup of mail from a local P. O. Box.
Payments received at Turbo Data Systems, Inc. (TDS) will be deposited each day into a bank
account established by the Agency. This bank account is for the Agency's sole benefit. Records
of payment and other disposition 'information will be entered into the computer system at this time
to provide up-to-date inquiry ability to the Agency. Monies collected from parking citation bails
are never intermixed with monies due TDS for our contracted fees.
Weekly and monthly accounting is provided for the Agency. A weekly detailed payment
register is produced which is balanced to the total of the bank deposits made during the week. A
monthly register is produced including all payments made during the calendar month. This audit

accountability of public funds. If the Finance Department has additional requirements, we will
work with them to produce the required reports.
IWe will respond to all routine correspondence related to parking citations such as: requests for
citation copies, payments previously paid, not my vehicle, bad check, not guilty due to stolen or
' sold car, partial payment requests, hearing requests, etc. Our toll-free "800" number is staffed by
our own trained personnel. They are able to answer questions from violators of a non-judicial
nature,such as how/where to pay the citation,how to contest the citations,whether their payment
has been received, etc.

This service also includes hearing/court scheduling. When violators indicate that they wish to
contest a citation, they are given a hearing/court date and time (approved in advance from the
agency/court) approximately two weeks in the future. All other processing is stopped on that
citation. The violator is sent a letter informing them of the date, time and proper location to
appear. The original citation(or court approved computer printout)is then sent with a transmittal
list of all violators scheduled for that day to the agency/court. The agency/court records the final
disposition of each citation on the same transmittal list and returns it to TDS for updating of the
citation on the computer system. "No Shows'will be reactivated and continue on through the DMV

Our processing service is provided to solve your problems with lost revenue from out-of-
state violators with no increase in either staff or expense to you. Turbo Data Systems,
Inc. (TDS) is not a collection agency, but a revenue enhancing company using our "state-
of-the-art' Parking Citation Collection System (PCCS). We do this without impacting your
J out-of-state business customers and tourists. Some of the benefits of our services are:

Our service begins with the receiving and controlling of issued out-of-state parking citations
either on a magnetic tape or source documents. This input can be delivered to us by our own
courier service or by mail (UPS, Federal Express, US. Mail) on a negotiated frequency.
If the input media is source documents, transactions are entered on-line with tight controls to
ensure that errors do not occur during the data entry process. These controls are designed to
prevent erroneous information from entering the system. This process updates the database with
iall pertinent data.
1 If the input media is computerized, then the Agency's citation information will be directly
entered into the system database. Citations rejected during this process due to incorrectly keyed
data fields will be reentered manually.
The next process involves creating the R/O (registered owner) inquiry magnetic tape or
hardcopy listing from all outstanding citations without names on the database. This information
is then sent to the corresponding states' Department of Motor Vehicles to access their vehicle
j license database. We currently receive R/O information from the states and Canadian provinces
1 on the attached list. With contractual relationships with state motor vehicle divisions. TDS
exchanges information on a timely basis. The R/O information is then returned to us and entered
into the Agency's system database. The open citations now having a name record are ready for the
1 notice process.
'Notice of Delinquent Parking Violation" forms are generated and mailed weekly. Each notice
Iincludes a non-postpaid return envelope addressed to a designated payment location. Our system
allows for the customization of the message which prints on the notice form. This gives the
Agency the flexibility of changing the text without the expense of revising and reordering pre-
printed forms. The text portion of the notice usually includes payment instructions,consequences
of non-payment, where to call for more information, etc. These forms and postage are included
in the cost of our processing.

When a notice is returned due to an incorrect address, we flag the transaction and resend the
_ notice once the correct address has been identified. Also, we will send a second notice upon
i notification of name and address changes either from an individual or lease and rental agencies.
Payments made as a result of sending out-of-state notices will be directed to the same address
as all other payments for the Agency and be handled in the same way. The Agency will then_

database. If Turbo Data is processing the payments,the returned payment address will be our local
P. O. Box. TDS will provide the out-of-state violator with a toll-free *800, number for payment
I inquires on a standard basis between 9:00 a.m. and 5:00 p.m. Pacific Standard Time, five days per
week, except TDS' holidays.

We will keep cleared citations on our system for three (3)months in case the citation has to be
reactivated. For example, upon notification of a bounced check, we will add an additional fee
designated by the Agency, reactivate the citation, and resend the notice noting the reason for
reactivation. Citations with no activity will be removed from out Agency's database after thirty
(30) months of inactivity.
There are four(4)out-of-state activity reports. The'Monthly Citations Added Report"will list
all citations received from the Agency for the given month. The'Monthly Citations Aged Report'
will list the citations unpaid ninety(90)days after the generation of a notice. The 'Open Citation
Report"lists all open out-of-state citations currently on the database. The"Out-of-State Collected
Report" shows, in detail, each citation paid as a result of a notice being sent. This report is used
to determine our fee for providing the out-of-state service.
TDS will provide the Agency with telephone support on a standard basis between 9:00 a.m.and
5:00 p.m. Pacific Standard Time, five days per week, except TDS' holidays. Telephone support is
unlimited. This service is provided to assist you with day-to-day operational problems or special
assistance you may need to effectively and efficiently handle parking enforcement.
Our Parking Citation Collection System is both comprehensive and flexible. It can be tailored
to address the Agency's special needs and unique operational nuances.

i This Agreement is entered into by and between Turbo Data Systems, Inc. (TW)
a California Corporations and XXXX3t7[XXZZI (hereinafter %Custamer■) .
ubereas, TDS and the Customer desire to enter into an agreement whereby TDO
will process parking citations for the Customer pursuant to the terms and
conditions set forth herein.
=n consideration of the mutual covenants, conditions, representations and
warranties contained herein the parties hereby agree as follows:
1. PURPOSs. The purpose of this Agreement is for TDs to process parting
citations for the Customer in a timely manner.
2. SCOP= OF OOiVICsO. Whan and as directed by the Customer, TD/ &tali
perform the following services in processing &11 parking citations:
A. Process all parking Citations delivered to TDs until such time as TDO is
i) notified of their final disposition or 2) thirty (70) months has
passed after their data of issuanoe.
1 a. Provide monthly reports indicating the status of all citations, such
reports to be delivered to the Customer (or other appropriate L
destination) no later than the thirtieth (loth) day of the roliowing
Month. `
C. Attempt to Obtain names and address" Of registered eweers of cited
vehicles for those citations that have not been cleared prior to their h
delinquent date.
D. Print the required Notice of violation and mall to each registered owner
whose name has been retrieved within thirty (20) days after the citation
has beeeme delinquent, provided however, in psoosssing any citation
which was delinqufnt as or the effective data or this agreement, TM t
shall have two (2) moathe to mail the Notice or violation to the M
registered owner. The delinquent period shall be extended whenever
there is an unusual delay in delivery of information to TDt.

1. Transmit a Notlas of Delinquency to the California DIV for citations
issued in California to vehicles with California license plates attar a

not received notifications that the citation has been cleared. This
Notice of Delinquency will he transmitted to the MV within thirty (30) L
days after the data specified by the Custosar to be the DIN Data.

1. TDs shall process citations on vehicles not registered in California by L
entering the citation information into the system database and reporting
that along with all other citations on the database with the standard
reports. TDs shall have no further obligation to process citations on
non-California registered vehicles except as provided in exhibit "D• 1
which is attached hereto and incorporated herein by this reference. TDO
shall be entitled to full citation payment attar it has entered the
citation information into tam system database regardless of whether the
Custmer and TDs enter into Uhl it "D".
3. TEEM, This agreement &bail beams etfeative for a period of one (1)
year, provided however, the agreaent shall automatically be extended
annually for me (1) year periods unless either party given the other party
k at least sixty (40) days nation of its intent to terminate this agreement.

provided in this agreements Customer shall pay TDs pursuant to the tarn net
forth in Exhibit "A" which is attached hereto and incorporated herein by this

7. TDR or MRF03MNCZ. Time is of the essence, and TDO Wall perform the
services required by this agreement in an expeditious and timely manner so as
not to unreasonably delay the purpose of this agreement as set forth in }

V. INDZp==T co11TAAcToR. At all times during the term of this agreement,
l TDO shall be an independent contractor and shall not be an employee of the
3 Customer. The Customer shall have the right to control TDs only insofar as
the results Of TDe0s services rendered pursuant to this agroemsntt however,
Customer shall not have the right to control the means by wbich TDs
accomplishes the services rendered pursuant to this agreement.
9. FACILITIES AND NQUXN aNT. TDO .bail, at its own cost and expense,
provide all facilities and egcipmant which may be required for parfoarmance of L

10. 71en =1FICATX0N BY TOM DATA SlOTn1O, DIC. TDs is skilled in the L
professional calling necessary to perform the services and duties agreed to
be performad by TDO under this agseement, and Customer, net being skilled in
such asttarm, relies upon the skill and knowledge of TDs to perform said
services and duties in the most skillful manner- Therefore, TDO agrees to
indemnify, hold haraleam and defend every officer and empleyes at Customer,
from any and all liability or financial loss resulting from any suits,
claims, losses or actions brought by meq person or persons and from all costs
and expenses of litigation brought against the Customer, its officers and
employees, by reason of injury to any person or persons imcluding but not

limited to officers and employees or TDO or damage, destruction or loss of
psoperty of any kind vhatsoever and to vhowsoever it may bsiong, including
but not limited to that act of TDs resulting directly or indirectly from any
negligent eat or omission by TDO or any parson employed by TDs in the
Iperformance of this agreement. E
11. LXMLITY LIMITATION AND MDENNIFICATXM MY CusT010ZR. TDs shall use due `
j care in processing work of the Customer but TDs shall be responsible only to
the extent or correcting any errors which are due to the equipment or
I personnel of TDBr such errors shall be correatad by TDs at no additional
charge to the Customer. TDs shall be entitled to raimburaem"t from the ,
Customer for any expenses incurred by TDs for the correction of any erroneous
information provided by the Customer and 'PDO shall not be responsible for
Customers losses and expenses resulting Pram erroneous source materials
1 provided by the Customer. Neither party shall be liable to the other roe any
indirect or consequential losses or damages. The Customer shall indemnify j
and hold harmless TDs and its officers, directors, shareholders, supiayaes
and representatives from any and all claims, demands, liability, damages and k

I this agreement, TDO shall - amply with all applicable provisions of the
California Fair Moloyment Practices Act (California Labor Cods sections (410
at seq.) and the applicable equal employment provisions of the Civil Rights
Act of 1944 (42 U.B.C. 200. 217) , vhiabever is more restrictive. `
1 17. AGENCY. Exoept as Customer may opacity in writing, TDs shall have no
authority, expressed or Implied, to act an behalf of the Customer in any

implied, pursuant to this agreement to bind Customer to any obligation

14. CMANGMs XE LAN. should there be any obanges in the fan applicable to

reduce or eliminate Ehe amount of revenue received by the Customer from

17. TspaNkTION. This agreement may be terminated by either party upon sixty

entitled to recover their reasonable attorneys' re" and other costs incurred

Thank you for your patience in receiving this information
regarding the implementation of the Automated Parking
Citation Processing System by Judicial Data Systems (JDS) ,
and again, for setting up the recent meeting with your staff.
Included in this packet is a cost breakdown of using hand-
written citations and those written using the automatic
1 ticket writers, and a sample contract, as requested. Please
also find sample of citations currently being used in the
Orange County area.
1 As you can see by the enclosed statistics, the cost for both
{ hand-written and computer citations is very close. The only
determination that would need to be made is which agency
would use the computers and which would use conventional
cites. Of course, a combination of the two is no problem.
1 The only data missing from this letter is the cost incurred
if JDS provides a hearing examiner. We are still working with
interviews and until a choice is made, the numbers are
unknown. Since this is indeed a priority, you will be
notified the moment a decision is made.

i PROCESSING AND TICKET WRITER LEASE FEE
The cost for processing citations using the hand-held ticket
writer and/or manually written citations is $1.05 for full-
service.
The lease fee for the hand-held ticket writer is as follows:
For every 1, 000 citations written per month, a ticket writer
will be provided at no cost to the Agency. (Ex: If the Agency
issues 2,500 cites per month, two hand-held ticket writers
would be provided) .

If the quantity of citations falls under 1,000 per month, a
lease fee of $100. 00 will be charged. (Ex: If the Agency
issues 2,500 cites ,per month and requests 3 hand-held ticket
i writers, the first two would be provided at no cost and the
third would be $100. Oq per month. If the quantity increased
to 3 , 000 the next month, the third hand-held ticket writer
would be provided at no cost) .
JDS can provide "loaner" computers if none are available at
the agency to facilitate downloading and storage of citations
written with the hand-held writers.
Citations and envelopes may be ordered through JDS and are
approximately ten cents per unit (a unit consisting of a
citation and envelope) . A definite cost can be determined
after quantity and design are decided.

The effectiveness of the procedure is well documented.
Jurisdictions which have faithfully implemented the
process usually experience an 80% clearance rate as
compared to rates of 30% to 50% normally experienced
without such procedures.

OVERVIEW
The flow of the processing of a parking citation is as
follows:
1) The agency issues a citation by placing it upon
the illegally parked vehicle. JDS receives a
copy of the citation for entry into the
computerized management system.
2) The defendant may respond to the citation• by
posting the required bail (paying the fine) , or
by requesting a court appearance.
3) If the defendant fails to respond by the
specified date on the citation, said citation
is deemed delinquent, termed FTA for Failure to
Appear.
4) JDS relays the information of the delinquent
citation via on-line link to DMV for "Non-
urgent Registered Owner Inquiry".
5) The Registered Owner's name and address is
returner) to JDS. The name/address is matched
with the citation data and (if the citation is
still delinquent) a computer printed "Notice of
Illegal Parking and Intent to notify the
Department of Motor Vehicles" is mailed to the
+ registered owner. This notice contains all
required information including a due date and
bail amounts both before and after the due
date. These bail amounts have the appropriate
increases automatically added.
6) The notice of intent is mailed to the
registered owner.
7) The registered owner may respond to the notice
of intent by posting the required bail or by
court appearance.
8) If,= response occurs than the citation is FTA
on the notice.
9) JDS relays the appropriate data to DMV, placing
a registration hold on the vehicle.

10) DMV sends the registration renewal to the
registered owner with the required bail
forfeiture amount added to the registration
fee.
11) Registered owner forwards his registration
plus bail on to DMV.
12) DMV returns the bail to the agency via the
appropriate court of jurisdiction.

DESCRIPTION OF PARKING CITATION
• PROCESSING PROCEDURES
• A. Citation Receipt and Control.
For citation control, the main requirement is that the
transmittal form record the agency, the date, and a
complete list of citations being received. As citations
are issued in serial order by officers, it is generally
not necessary to list each citation but rather the
beginning and ending serial numbers for blocks of
'. citations.
The transmittal form provides the primary record of
citations presented for processing. This provides for
visibility over JDs performance as well as verifiable
control for any subsequent cancellation of the citation
by the issuing agency. For any agencies which are using
automated ticket writers JDs will provide a suitable
transmittal verification mechanism.
At the JDs processing facility each batch (reflected by
transmittal forms) will be logged into the system by the
assignment of a serialized "batch" number. This number
is also recorded on the transmittal.
1 JDs has historically and successfully used a batch
control methodology (not to be confused with batch
. processing - our systems are real time and on-line) to
provide rigorous external controls. There is a one-to-
one correspondence between each transmittal of citations;
each batch being identified with the issuing agency, the
date received, and the citation count. A traveling
worksheet goes with the batch thru processing and records
the data entry operators involved, various production and
quality control checks, and key processing dates.
Finally, the citations are filed by batch number together
with the worksheet.
1 Each citation}- in the system is tagged with its batch
1 identification number making for ease of retrieval. The
worksheet filled out with the batch also serves to record
post-processing activity such as citations forwarded to
the Court or citations which are cancelled by the issuing
agency (in conformity with the Vehicle Code) . The batch

• system allows for reliable control and the ability to
track the physical activity affecting each citation.
The batch system also permits timely response to
(� defendants seeking copies of citations under V.C.40206.5.
' B. Processing and Control of Payments.
I Payments will be received by mail. what follows is the
discussion of mail processing, collection and deposit
procedures.
money mail is processed according to procedures which JDs
has worked out over a decade of experience. Our technique
is simple, effective and successful.
All mail is sorted by agency and counted prior to
opening. All mail opening is done by at least two persons
with supervisory monitoring. JDB recommends that all
l agencies indicate on the notice forms that defendants not
mail cash. Nevertheless, as cash is occasionally received
it is immediately notated and counted by qualified JD8
collection clerks.
The number of checks received and the number of cash
payments received is recorded for each agency. Any
discrepancy, such as non-liability, request for Court
appearance, and empty envelope, etc. , between the mail
count and the payment count is recorded and tracked on a
verification form. The payments are then entered onto
deposit slips, one for each agency. Each payment is
associated with a document (citation, notice form, etc. )
indicating the citation number and issuing agency. If no
form is supplied, JDB will create one. The amount and
method of payment is written on each citation, notice
form, and check. These documents are then used to enter
payment data into the computer.

In the proven JD8 parking management program, the
computer verifies the citation data, accepts payments and
produces a clearance batch verification report. This
' report, one for each agency for each day, indicates every
payment. The,total count and amount of payments must
�. balance the deposit slip.
At JD8 there are three corroborating elements: the mail
count, the deposit slip, and the clearance batch

verification report. A copy of each of these items,
together with the surrendered citations, notices,
including envelopes, etc. are placed in another envelope
marked with the agency's name and the transaction date.
The envelopes are then filed.
The clearance date is logged in the computer and can be
used at any time to retrieve the original documents
regarding any payment transaction. The transaction date
identifies the envelope for the appropriate agency.
The JDS method of preparing a separate deposit slip• for
each agency for each day provides a month-end
verification comparing bank statement deposits with the
daily clearance batch verification reports.
JDS will make deposits into agency accounts on a daily
basis.
JDS proposes a city or court account, using an
endorsement stamp and deposit slips to prepare and make
deposits directly into this account. JDs will have no
other access to this account.
This approach provides the highest level of safety and
convenience to the agency. The agency will pay JDs for
its services, remit funds to the entities, and transfer
money into the various agency funds involved. JDs will
• provide an invoice and complete revenue distribution
accounting to assist the agency to perform these payments
and transfers. JDS will automatically receive duplicate
statements for reconciliation and returned checks for
follow-up, by arrangement with the bank.
Time and experience dictate this to be the superior
method, as opposed to having the vendor hold the funds,
pay itself first, and then write the checks to all of the
entities and the agency.

on DMV holds, voids, and dismissals.
3) COLLECTION REPORT: Provides verification of dispositions
including matched totals that correspond with deposit

clearance type.
5) DAILY CLEARANCE REPORT BY MONTE: Provides deposit and
clearance information by day, quantity and monetary
amount.
6) MASTER FILE STATISTICS: A monthly report covering
dispositions, pending action, notices mailed, holds
placed at DMV, and revenue collected on citations.
7) HABITUAL OFFENDER REPORT: Provides license number,
citation number, issue dates, times locations, status and
violations for habitual offenders.
8) OFFICER REPORT: Provides quantity of citations written by
each officer.

INOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES
CONTAINED HEREIN, THE PARTIES HERETO AGREE AS
FOLLOWS:
1. COMPANY shall process all parking citations issued by
AGENCY as provided in the following statement of work:
1. 1 Collection. COMPANY will provide for collection of
parking citation penalty amounts via mail to COMPANY'S
"Parking Administration" Post Office Box in accordance
with COMPANY'S established procedures. COMPANY will
provide for telephone and written interaction with
defendants. , Daily collections will go directly into a
AGENCY account or as directed by AGENCY. Determination
of type of account and control of disbursements from
account is strictly a matter between the AGENCY and the
bank. Output from this task will be:
a) Monthly reporting on clearances by parking penalty
amount, detailed by citation number. (Note: this
detail will not include clearances not handled by
COMPANY) .
b) Transmittal forms and instructions regarding any
required disbursements of surcharges or fees (such as
DMV fees, court fees, court house building
surcharges, etc. )
I1.2 Management. COMPANY will receive, store and provide
retrieval of all citations.
1.3 Data Entry and Registered Owner Inquiry. COMPANY will:
J code and enter into a computerized notification system
the following data on hand-written citation and
retrieve, from personal computer (PC) , located on site,
uploaded citations from automated hand-held ticket
writer units:
a) Citation number
b) Date and time issued
c) License number and state
d) Make of vehicle
e) Violation code(s) (up to two per citation)
f) Parking penalty
Ig) Court appearance date
Output from this task will be:
j a) Registered owner inquiries will be forwarded to DMV.
II b) A printed listing containing key data on all
citations in citation number order.
t c) A license number index to the citation listing.
t 1.4 Registered Owner Notification. COMPANY will process
DMV's replies. An edit check will be made to delete
records with unreasonable discrepancies between the
vehicle make as noted on the citation and in the DMV
files. Notices of Intent as prescribed by CVC Section
40206 will 'be printed and mailed to registered owners.

1.5 Notify DMV of Non-Compliance. COMPANY will acquire
data on clearances and, after the due date, will notify
DMV to place registration holds on vehicles for which no
response to the Notice of Intent was made.
1.6 Lessee/Renter Notification. COMPANY will, at AGENCY'S
option, forward to lessees or renters valid notices of
intent which are returned to collecting agency claiming
lessee/rental as a defense against the charge(s) . -
2. AGENCY shall pay COMPANY as follows:
$1.05 per citation filed.
3 . This agreement shall become effective on
and shall continue in full force and effect until
terminated.
4. This agreement may be terminated without cause upon
thirty (30) days written notice to the other party.
5. COMPANY shall invoice the AGENCY each month for
citations proces*ed under this agreement during the
1 previous month.
t• 6. AGENCY shall pay COMPANY within thirty (30) working days
after receipt of each invoice.
7. COMPANY shall perform services under this agreement as
an independent contractor. Neither COMPANY nor its
i officers, agents or employees shall be considered
employees of AGENCY. Rights and obligations of COMPANY
with AGENCY shall arise only from this agreement.
COMPANY shall retain all responsibility and authority
over its officers, agents and employees related to
fulfilling obligations under this agreement.
S. COMPANY agrees to perform the services required under
this agreement with good workmanship in the art, skills,
and trades agreed to hereunder consistent with generally
i accepted data processing procedures.
9. COMPANY agrees that all citations, reports, analyses,
audits, computer tapes or cards, or other material
i •
documents or data and working papers, whether or not in
} final form, which have been obtained or prepared under
this agreement, shall be deemed the property of the
AGENCY and same shall be returned to the AGENCY upon
termination of this agreement.

10. AGENCY agrees to hold harmless and defend any legal
action commenced against COKPANY caused directly or
indirectly by wrongful or negligent acts of AGENCY'S
officers, employees, agents, or others engaged by
AGENCY and to indemnify COKPANY against any liability,
loss, cost or damages, including attorney's fees
resulting therefrom.
11. COKPANY agrees to hold harmless and defend any legal
action commenced against AGENCY caused directly or
indirectly by wrongful or negligent acts of COKPANY18
officers, employees, agents, or others engaged by
COMPANY and to indemnify AGENCY against any liability,
loss, cost or damages, including attorney's fees
resulting therefrom.
11. 1 In order to secure CONPANY'8 obligations to hold AGENCY
harmless, COKPANY agrees to procure and maintain the
following:
a) Worker's compensation insurance coverage for its
Iemployees as prescribed by the State of California.
b) Comprehensive general liability policy coverage with
$500, 000 single limit liability.
11.2 COMPANY agrees to furnish AGENCY with certificates of
insurance, evidencing the required coverages. COKPANY
shall name AGENCY as an additional insured on the
comprehensive general liability insurance policy. Both
certificates shall provide that each insurance carrier
shall give AGENCY thirty (30) days written notice prior
to any action by the carrier to reduce or terminate the
policy.
12. Termination of Agreement. Upon termination of this
I" agreement for any reason, COKPANY shall not be
responsible for the retention and processing of

AGENCY'S data files for a period in excess of ninety
(90) days following notification of such termination.
During that period of time COMPANY agrees to cooperate
and assist AGENCY with the orderly transmission of
t AGENCY data to whatever point of delivery designated by
AGENCY.
t 13. This agreement expresses the full understanding between
j the parties. Any changes or revision to the terms and
conditions hereof shall be made by written amendment and
shall be executed by persons authorized to do so by the
respective parties.

4 . This agreement may be terminated without cause upon
thirty (30) days written notice to the other party.
S. COMPANY shall invoice the AGENCY each month for
citations processed under this agreement during the
previous month. .
I 6. AGENCY shall pay COMPANY within thirty (30) working days
after receipt of each invoice.
7. COMPANY shall perform services under this agreement as
an independent contractor. Neither COMPANY nor its
officers, agents or employees shall be considered
employees of AGENCY. Rights and obligations of COMPANY
with AGENCY shall arise only from this agreement.
COMPANY shall retain all responsibility and authority
over its officers, agents and employees related to
fulfilling obligations under this agreement.
S. COMPANY agrees to perform the services required under
this agreement with good workmanship in the art, skills,
and trades agreed to hereunder consistent with generally
accepted data processing procedures.
9. COMPANY agrees that all citations, reports, analyses,
audits, computer tapes or cards, or other material
documents or data and working papers, whether or not in
final form, which have been obtained or prepared under
this agreement, shall be deemed the property of the
AGENCY and same shall be returned to the AGENCY upon
termination of this agreement.
10. AGENCY agrees to hold harmless and defend any legal
action commenced against COMPANY caused directly or
indirectly by wrongful or negligent acts of AGENCY'S
officers, employees, agents, or others engaged by
AGENCY and to indemnify COMPANY against any liability,
loss, cost or damages, including attorney's fees
resulting therefrom.
11. COMPANY agrees to hold harmless and defend any legal

indirectly by wrongful or negligent acts of COMPANY18
officers, employees, agents, or others engaged by
COMPANY and to indemnify AGENCY against any liability,
loss, cost or damages, including attorney's fees

11. 1 In order to secure COMPANY'S obligations to hold AGENCY
harmless, COMPANY agrees to procure and maintain the
following:
a) Worker's compensation insurance coverage for its
iemployees as prescribed by the State of California.
b) Comprehensive general liability policy coverage with
$500,000 single limit liability.
11.2 COMPANY agrees to furnish AGENCY with certificates of
insurance, evidencing the required coverages. COMPANY
shall name AGENCY as an additional insured on the
comprehensive general liability insurance policy. Both
certificates shall provide that each insurance carrier
shall give AGENCY thirty (30) days written notice prior
to any action by the carrier to reduce or terminate the
policy.
12. Termination of Agreement. Upon termination of this
agreement for any reason, COMPANY shall not be
responsible for the retention and processing of

AGENCY'S data files for a period in excess of ninety
(90) days following notification of such termination.
During that period of time COMPANY agrees to cooperate
and assist AGENCY with the orderly transmission of
AGENCY data to whatever point of delivery designated by
AGENCY.
13. This agreement expresses the full understanding between
the parties. Any changes or revision to the terms and
conditions hereof shall be made by written amendment and

I This Agreement between the County of Orange, and Data Ticket,
Inc. is for the usage of a collection process designed to enhance
} , the City/County's ability to obtain parking revenue.

1 . Data Ticket is authorized to act as an agent for the
City/County to collect unpaid parking citations, and other items,
as specified by the City/County, for a period of three years with
automatic renewal. Either party may terminate this agreement
with 60 days written notice.

2. The City/County will provide a mutually suitable arrangement
for the collection of funds, and express authorization to do
._ business on the City/County's behalf with Department of Motor
.Vehicles in the United States and Canada.
_ 3. Data Ticket will: provide forms, notices, postage; maintain files
on collected information and provide this information to the
City/County to update its files; provide the City/County with
management reports; and use its best efforts to obtain maximum
results, to include the use of outside collection agencies.
Collection activities will be in strict compliance with federal, state
and local laws with adherence to the Fair Debt Collection Practices
Act (FDCPA).
4. Collections from this process will be charged at a rate of .95
per citation to the City/County to include the first notice. With
generation of the second notice, the rate will change to a 50-50
) split between Data Ticket and the City/County, of all collected

I 5. Data Ticket shall not be responsible for the City/County's
failure to provide correct or timely infraction information.
I 6. The terms of this document shall not be disclosed by the
City/County, except as required by law, unless written agreement

its competitors. Data Ticket proceeds in collection efforts when
the competition has written it off and sent it on to DK7 for
possible collection and certain expense to the Agency.
Data Ticket's reputation stands on the extremely good follow-up and
information systems which we pay for and use in collecting
citations which remain unpaid after the first notice is sent. This
effort represents exceedingly high revenue for the Agency at no
additional expense.

1. DMV Make/Mismatch - When a vehicle "make" has been mis-
identified, an agency (or another vendor)
may stop processing. This means that

returned to the agency for correction,
