1991-0204_DANA PT / LAGUNA NIGUEL / MISSION VJO_Memorandum of Understanding0 0 MEMORANDUM OF UNDERSTANDING BETWEEN THE CITIES OF DANA POINT, LAGUNA NIGUEL MISSION VIEJO, AND SAN JUAN CAPISTRANO FOR IMPLEMENTATION OF A COMMERCIAL VEHICLE ENFORCEMENT PROGRAM A MEMORANDUM OF UNDERSTANDING between the Cities of Dana Point, Laguna Niguel, Mission Viejo, and San Juan Capistrano entered into on February 4, 1991 for the implementation of a multi - jurisdictional Commercial Vehicle Enforcement Unit. The respective City Councils have approved participation in a multi -jurisdictional Commercial Vehicle Enforcement Program. This Memorandum of Understanding reflects the intent of the councils' direction. The above cities agree to participate in a multi -jurisdictional Commercial Vehicle Enforcement Program consisting of two vehicle units, plus equipment which will be shared according to use: Dana Point 12 hours/week Laguna Niguel 20 hours/week Mission Viejo 36 hours/week San Juan Capistrano 12 hours/week 144*10�1�14+J Personnel for the operation of the program will be provided by the Orange County Sheriff through the individual contracts of the identified cities. EQUIPMENT/VEHICLE Vehicle 1 - Vehicle 1 is owned by the City of Mission Viejo and maintenance is provided by the County. The cost of maintenance is paid through Mission Viejo's law enforcement contract with the County. The related equipment (weights, etc.) is owned by the City of Mission Viejo and maintenance costs are paid by the City. Vehicle 1 will be shared by the City of Mission Viejo and Laguna Niguel accordingly: Laguna Niguel 4 hours/week 10% Mission Viejo 36 hours/week 90% The City of Mission Viejo will bill the City of Laguna Niguel for Laguna Niguel's percentage of vehicle and equipment acquisition, maintenance. and insurance costs. Vehicle 2 - Vehicle 2 and related equipment will be purchased and owned by the City of Dana Point. The cost of the vehicle and equipment will be allocated to the participating cities based on their portion of service as indicated below. ON 0 Vehicle maintenance will be conducted by the County of Orange. The cost of vehicle maintenance will be paid to the County through the individual cities' law enforcement contracts based on the portion of service as indicated below. Equipment maintenance will be administered by the City of Dana Point with costs charged to the participating cities as indicated below. Vehicle 2 service allocation: Dana Point Laguna Niguel San Juan Capistrano 12 hours/week 30% 16 hours/week 40% 12 hours/week 30% The City of Dana Point will bill the Cities of Laguna Niguel and San Juan Capistrano for their portion of Vehicle 2 acquisition, related equipment acquisition, equipment maintenance and the insurance costs by percentage as indicated above. Maintenance costs for Vehicle 2 will be included in the individual law enforcement contracts with the County based on the above portion of service. VEHICLE 2/EQUIPMENT 1 - Cargo van, fully operational; black and white, overhead red and blue light bar, police radio, spotlights, etc.. 4 - Wheel load weighers. 4 - 15 inch cables. 1 - Printer with cable. 1 - Charging unit. The respective Cities will be invoiced at the time of purchase or service rendered. Payment will be due 30 days from the date of invoice. Notice of disputed invoices and the basis thereof shall be provided in writing to the invoicing City within 15 days of invoice. UNDERSTANDING DURATION/AMENDMENTS/TERMINATION Amendments - Any amendment, modification, or variation from the terms of this UNDERSTANDING shall be in writing and shall be effective only upon approval by the City Managers of the participating cities. Duration - This UNDERSTANDING shall remain in effect from the date signed until such time the UNDERSTANDING is terminated. This UNDERSTANDING may be terminated by any of the participating agencies, without cause, upon one hundred and eighty (180) days written notice to all other parties. All notices or other communications required or permitted under this UNDERSTANDING shall be in writing, and shall be either personally delivered or sent via the United States Mail addressed as follows: 1. Attention: City Manager City of San Juan Capistrano 32400 Paseo Adelanto San Juan Capistrano, Ca. 92675 All notices sent pursuant to this UNDERSTANDING shall be deemed received (1) immediately if served by personal delivery, and (2) on the fifth day after deposited in the custody of the U. S. Postal service if served by mail. Upon dissolution of the program, equipment and vehicle disposition will be based on the acquisition percentages as stated above. Value of the equipment and vehicle shall be determined upon agreement of the City Managers. AUTHORITY TO $%ECUTE UNDERSTANDING Cities do covenant that each individual executing this Understanding on behalf of each party is a person duly authorized and empowered to execute understandings for such party. 3 The parties hereto have caused this instrument to be executed the day and vear first written above.
